About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, Division of Engineering and Contract Administration, on behalf of the Kentucky Energy and Environment Cabinet and the Kentucky Division of Oil and Gas, is requesting proposals for orphan well plugging and remediation services in Whitley County under the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW), with proposals due October 23, 2026 at 3:00 PM Eastern Time.
The Commonwealth will apply reciprocal preference for Kentucky resident bidders and preferences for qualified bidders under 200 KAR 5:410. The evaluation committee will assess proposals using a 70-point total scoring system: 25 points for technical merit covering contractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas, and 45 points for cost. Pricing is evaluated on a proportional basis with the lowest bid receiving 45 points and higher bids scored proportionally lower.
The contractor must achieve substantial completion within 180 calendar days from award and final completion within one additional year. The contract is anticipated to be firm fixed-price in nature and subject to Davis-Bacon Act wage requirements and other federal and state regulations. All bids must be accompanied by a bid guarantee of not less than 5 percent of the lump sum base bid. Successful bidders must furnish a 100 percent Performance Bond and a separate 100 percent Payment Bond within five calendar days. Contractors must comply with Kentucky tax registration requirements and obtain Secretary of State certification if a foreign entity.
Liquidated damages of $200 per calendar day apply for delays beyond substantial and final completion dates. The contractor is responsible for maintaining a qualified full-time superintendent on-site, submitting detailed construction schedules, providing shop drawings and submittals within specified timeframes, and maintaining daily construction reports. A one-year warranty period applies to all materials, equipment, products, and workmanship following final completion.
Questions are due October 7, 2026 at 4:00 PM Eastern Time, with Commonwealth responses provided by October 11. Proposal evaluation is scheduled for November 4, 2026, with contract award anticipated by November 18. Responses should be submitted to the Division of Oil and Gas, 300 Sower Boulevard, 4th Floor, Frankfort, Kentucky 40601. Online bidding is permitted.
