About this opportunity
The New York Office of Employee Relations is seeking a contract reporter exemption for a single-source procurement of Jay Siegel as an arbitrator on the panel for the PEF Triage and Expedited Arbitration Program and Expedited Suspension Review, with the exemption request due October 7, 2026.
The procurement is structured as a non-competitive selection under Article 33 of the PEF Collective Bargaining Agreement, which establishes that the State and the Public Employees Federation jointly select and administer a panel of arbitrators for the term of the agreement. The State asserts that an open competitive bid process is not feasible because the selection process is defined by the CBA itself rather than discretionary procurement policy. The service term runs July 1, 2026 through June 30, 2027.
Opportunity text
The Office of Employee Relations (OER) is seeking a contract reporter exemption request from publishing the discretionary single source procurement for Jay Siegel to serve on the panel of selected arbitrators for PEF Triage and Expedited Arbitration Program ("The Program") and Expedited Suspension Review for the period of July 1, 2026 to June 30, 2027 pursuant to Article 33 of the PEF Collective Bargaining Agreement (CBA). It is not feasible for the State to peform an open competitive bid process because the non-competitive selection process is defined based upon Article 33 of the PEF collective bargaining agreement whereby the State and PEF jointly agreed to the creation of panel of select arbitrators to serve during the term of the Agreement and to be jointly selected and administered by the State of New York and PEF by an agreed upon Panel Administrator in the PEF collective bargaining agreement.
