About this opportunity

The Commonwealth of Kentucky's Justice and Public Safety Cabinet and Kentucky State Police are requesting proposals for legal representation services in the civil action Bethany Maynard v. JPSC and KSP (Franklin Circuit Court Civil Action 23-CI-453), with proposals due October 8, 2026 at 12:00 p.m. Eastern Time. Multiple legal service contracts may be awarded.

Vendors must hold Kentucky Bar Association membership in good standing and demonstrate detailed experience in complex employment law and whistleblower and discrimination litigation. Required capabilities include organizational capacity and staffing availability to support the matter, documented conflict-of-interest disclosure and management processes, and e-discovery capabilities. Vendors must be registered with the Kentucky Secretary of State and comply with KRS 45A requirements.

The initial contract term runs from October 16, 2026 to June 30, 2028, with potential renewal for additional two-year periods at the agency's discretion, subject to approval by the Secretary of the Finance and Administration Cabinet and the Legislative Research Commission Government Contract Review Committee. The cost proposal should provide hourly rates for partners or members (baseline $125), associates (baseline $100), and paralegals (baseline $40); vendors are encouraged to offer discounts or blended rates. Reimbursable expenses are limited to travel under Kentucky Governor's Chief of Staff Council policy. Required insurance includes Commercial General Liability of $1,000,000 per occurrence and $2,000,000 aggregate, and Professional Liability Insurance of $1,000,000 per claim.

Evaluation uses a 1,200-point rubric: technical criteria (800 points), cost proposals (200 points), and oral presentations if required (200 points). Technical evaluation criteria include Kentucky Bar membership verification, employment and whistleblower litigation experience, organizational capacity, conflict-of-interest processes, and e-discovery capabilities. Proposals must be submitted electronically through Kentucky's Vendor Self Service System in three separate sealed documents: Technical Proposal, Cost Proposal, and Proprietary Information. No bidders' conference is scheduled.
