About this opportunity

Cumberland County is requesting sealed bids for complete turnkey rebuild services on two BAC cooling towers (Model FXV-LQ661) at the Judge E. Maurice Braswell Courthouse in Fayetteville, North Carolina, with bids due September 30, 2026, and a mandatory pre-bid conference on September 2, 2026 at 10:00 a.m. at the project site. The procurement requires a single prime cooling tower manufacturer representative rebuild contractor—a sole-source specification that restricts bidding to authorized representatives of the cooling tower manufacturer.

The scope encompasses complete rebuild of both towers with all labor, equipment, and materials provided on a turnkey basis. The contractor must schedule work to isolate one unit at a time, with cooling tower 1 demolished and started before cooling tower 2 rebuild commences. Contractor responsibilities include mobilization, jobsite setup, material handling, site dumpsters, crane setup and lift-plan development with permits. The contractor must provide a 12-month complete parts and labor warranty from final acceptance.

The project completion deadline is 240 calendar days from written Notice to Proceed, with final completion required by June 30, 2027. Liquidated damages of $500 per day apply for each day exceeding the 240-day window. Place of performance is 117 Dick Street, Fayetteville, North Carolina.

Bid security of 5 percent of total bid amount (cash, certified check, or bid bond) is required, along with performance and payment bonds equal to 100 percent of the contract amount. Payments are made at 95 percent of monthly estimated costs until 50 percent completion; retainage is then released unless the contractor falls behind schedule, triggering reinstatement up to 2.5 percent. Final payment is due within thirty days of project completion and Owner acceptance.

The contractor must identify minority business utilization with corresponding dollar values and provide good faith effort affidavits or self-performance affidavits as required by North Carolina General Statutes. Insurance requirements include workers compensation, general liability of $1 million, vehicle bodily injury of $300,000 per occurrence and $500,000 annual aggregate, and property damage of $500,000 annual aggregate. The contractor bears all permit, license, and North Carolina sales tax recovery responsibilities.
