About this opportunity

The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Maintenance, is soliciting bids for a master agreement contract to procure guardrail and components for Elliott County. The Request for Bid (RFB) seeks an extensive range of materials including 100 guardrail terminal sections, 13,500 linear feet of guardrail "W" beam, 1,000 seven-foot guardrail posts, 5,000 nine-foot guardrail posts, 21,600 linear feet of various radius rail elements, 20,000 guardrail bolts in multiple specifications, 20,000 recessed guardrail nuts, 20,000 round guardrail washers, 50 pave contraction dowel assemblies, 1,000 basket stakes, and miscellaneous fasteners. All materials must comply with the 2012 edition of the Kentucky Department of Highways Standard Specifications for Road and Bridge Construction and corresponding standard drawings, be galvanized, and be manufactured in the United States in accordance with Buy America and Build America, Buy America Act requirements. The bid closing date is November 21, 2023, at 1:30 p.m. Eastern Time, with electronic submission required through the Kentucky Vendor Self Service website. The tentative award date is November 30, 2023, with the initial contract period beginning upon award and expiring November 31, 2024, followed by four optional one-year renewal periods. Evaluation of bids will utilize a best value approach allocating 95 points to price (with the lowest bidder receiving maximum points) and 5 points to delivery time. Price increases are prohibited during the first 12 months, with only one increase permitted during the initial contract term and one additional increase during any extended period, subject to industry-wide justification.

Reciprocal preferences apply to Kentucky resident bidders and qualified bidders, with Kentucky Correctional Industries receiving a 20% preference and Kentucky Industries for the Blind and qualified nonprofit agencies receiving a 15% preference, provided applicable documentation is submitted. All vendors must comply with the mandatory provisions of FHWA Form 1273, which applies to Federal-aid construction contracts and establishes comprehensive compliance requirements across nondiscrimination, equal employment opportunity, Davis-Bacon prevailing wage standards, contract work hours and safety standards, environmental protection, and debarment certification. Shipping must be F.O.B. Destination Freight Prepaid and Allowed to the KYTC Bailey Bridge Yard in Frankfort, Kentucky, with the vendor responsible for all freight charges and claim filing. Late delivery penalties of 1% per day apply unless delays result from factors outside the vendor's control. An Annual Affidavit for Bidders, Offerors and Contractors is required prior to contract award, completed by an authorized representative and notarized in compliance with Kentucky Revised Statutes (KRS) 45A.110 and 45A.115. No specific budget range or award value is provided in the solicitation documents.
