Pricing must be quoted F.O.B. destination with freight prepaid and allowed. Firm pricing is required for 30 days from the response due date. Delivery must occur within 14 calendar days unless otherwise specified.
Respondents must provide a Texas Identification Number and Federal Employer Identification Number prior to contract award. Responses must comply with Texas purchasing regulations and TDCJ requirements, including submission on the designated form. Responses cannot be altered after opening time, and late or unsigned responses will not be considered. TDCJ reserves the right to reject any or all responses at its sole discretion.
Standard certifications and compliance requirements apply: E-Verify system usage for employment verification, suspension and debarment status certifications, child support obligation compliance, human trafficking prohibition, indemnification of the State and TDCJ from all liability, and compliance with the Americans with Disabilities Act and Occupational Safety and Health Act. Purchases for State of Texas use are exempt from state sales tax and federal excise tax; TDCJ will provide tax exemption certificates upon request. The respondent is responsible for all federal, state, and local taxes resulting from the contract. The contract is subject to availability of state appropriated funds, and TDCJ may terminate for non-appropriation without penalty or prior notice.
