Update #1 ·

Justification and Approval for Other Than Full and Open Competition

1. Agency and Contracting Activity: Office Of Secretary Of Defense, Defense Microelectronics Activity (DMEA).

2. Nature/Description of Action Being Approved: Sole Source purchase of one base year and three option years of annual support for 12 user licenses of Silvaco Technology Computer Assist Design (TCAD), Universal Transistor Modeling SofTware (UTMOST) and Semiconductor Program with Integrated Circuit Emphasis (SPICE) tools using RDTE funds.

3. Description of Supplies/Services: The contractor will supply software licenses manufactured by Silvaco Inc. and delivered to DMEA, 4234 54th Street, McClellan, CA 95652-2100. Estimated total cost of the software licenses is $645,000.

4. Authority Cited: FAR 13.501(a)(1)(ii) Test Program for Certain Commercial Items, this document constitutes justification for other than full and open competition for the acquisition described herein, under the authority of 41 U.S.C. 1901.

5. Reason for Authority Cited: Silvaco Inc. is the only contractor who can supply the software licensing for the TCAD, UTMOST and SPICE tools set already in use in the DMEA facility. The Silvaco tools are proprietary and information on the software tools is not provided to other commercial firms. Silvaco computer software licenses are provided to the public directly by Silvaco Inc.

6. Efforts to Obtain Competition: This acquisition will be publicized on FedBizOpps to make the contract action publicly available.

7. Contracting Officer's Anticipated Cost Fair and Reasonable Determination:

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable, and this justification is accurate and complete to the best of my knowledge.

8. Market Research: Market research was conducted via the internet in April 2015 for this procurement. Maintenance and technical support of the software used in the DMEA development environment is proprietary and is only available through Silvaco, Inc. and from no other vendor(s). A Request for Information/Sources Sought was posted to FedBizOpps on July 16, 2015, and no responses were received.

9. Other Facts Supporting the Use of Other Than Full and Open Competition: DMEA has continuing collaborative technical programs with other Government labs that utilize these Silvaco software tools, including National Aeronautics and Space Administration (NASA) and the Space and Naval Warfare Systems Center, Pacific (SPAWARSYSCEN Pacific).

Although several vendors distribute these type of software tools, alternative solutions would require DMEA to purchase an entire, completely separate tools package, plus extensive user training for these new tools. Comprehensive DMEA process directories would not be compatible with a different suite of tools in an alternate simulation hierarchy. Implementing these alternatives would have substantial initial startup costs, plus substantial resource duplication and time expenditure.

10. Listing of Sources:
Silvaco, Inc.
4701 Patrick Henry Drive, Bldg. #2
Santa Clara, CA 95054

11. Actions to Remove or Overcome Barriers to Competition: None.

12. Technical or Requirements Certification:

I certify that the supporting data that I provided are accurate and complete and necessary to support my recommendation for other than full and open competition.
