About this opportunity
The U.S. Department of State has published a Notice of Intent to Sole Source for a contract modification with Greenway Enterprises, Incorporated LLC, a small business based in Helena, Montana. This notice pertains to updating ceiling systems, interior light fixtures, and HVAC diffusers at a construction project in Yerevan, Armenia that was suspended in August 2024. The modification is necessary to incorporate new security protocols mandated by the Overseas Security Policy Board that were not required when the original task order was competitively awarded. The Department of State emphasizes that this is not a Request for Quote or Request for Proposal, and no quotes or proposals will be requested or accepted. The estimated value of this modification is expected to exceed the simplified acquisition threshold, with rough estimates ranging between $350,000 and $600,000.
The purpose of this sole source modification is to allow Greenway Enterprises to resume and complete the suspended construction project by incorporating newly mandated security requirements into their existing design work. The Department of State is pursuing this action under FAR 6.302-1, arguing that awarding to any other contractor would result in substantial duplication of costs to the government that would not be recovered through competition. No telephone or email inquiries will be accepted due to the sensitive nature of the security changes, and no statement of work will be posted publicly. The modification will be structured as a firm fixed-price contract under NAICS code 236220 for Commercial and Institutional Building Construction. Contractors should note that the due date for this notice is August 1, 2025, though no proposals are being solicited, and the government will not be responsible for costs associated with any unsolicited materials sent in response to this notice.
Notice text
THIS IS A NOTICE OF INTENT TO SOLE SOURCE, NOT A REQUEST FOR A QUOTE (RFQ) OR A REQUEST FOR PROPOSAL (RFP). AN RFQ OR RFP WILL NOT BE ISSUED AND QUOTES OR PROPOSALS WILL NOT BE REQUESTED OR ACCEPTED.
The U.S. Department of State intends to award a modification to an already competitively awarded task order which was awarded under a multiple award indefinite-delivery contract to Greenway Enterprises, Incorporated LLC, a small business operating out of Helena, MT. This modification will allow the company to resume a currently suspended construction project in Yerevan, Armenia that was put on hold (i.e. suspended in August 2024) due to new security protocols now required that were not required when the task order was originally competed and awarded. As a result of these changes, the Department of State will negotiate a modification to the already competed task order which will allow Greenway to modify their already completed design for this project incorporating the new security protocols which will allow them to finish this construction project. The Rough Order of Magnitude for this modification is expected to exceed the simplified acquisition threshold.
Due to the sensitive nature of the changes, no telephone or email inquiries will be accepted. No statement of work will be posted.
This action is to be undertaken in accordance with FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements (i.e. (ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development….. thereof, when it is likely that award to any other source would result in-
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition;..)
The North American Industry Classification System (NAICS) for this requirement is 236220. The PSC code is R425. The resulting modification will be a firm fixed price. The determination not to compete this proposed change to an already competed contractual action is solely within the discretion of the Government. The Government will not be responsible for any costs for returning anything sent to it by parties reviewing this this notice.
