The U.S. Army Corps of Engineers (USACE), Baltimore District, Real Property Services Field Office (RSFO) has a requirement for a design-bid-build (DBB) construction services to be procured under a Two-Step Invitation for Bid (IFB) process. The NAICS code is 236220 with a size standard of $36,000,000.

The Government intend to award a Firm-Fixed-Price contract only to one contractor.

PROJECT SCOPE: Design bid build (DBB) construction services for a MILCON project to construct a concrete masonry unit building with a standing seam roof that contains a lobby, two offices, and restroom. Construct a VACP at the east entrance of the facility that consists of a guard booth, canopy, barriers, paving, storm drain system, lighting, building information systems, and security fencing. Construct a VACP at the west entrance of the facility that consists of a guard booth, canopy, barriers, paving, storm drain system, lighting, building information systems, and security fencing. The period of performance is 720 calendar days after receipt of Notice to Proceed.

The project will require the contractor to have an approved Facility Site Clearance at the time of offer is due, at the time of award, and duration of the contract. In the event of a Joint Venture (JV), the clearance requirement will apply to the JV. This means that the entity identified in block 14 of the Standard Form 1442 must have an approved Facility Clearance in that name along with the matching Cage Code. For example, if Company A and Company B form a Joint Venture called Company AB, then Company AB must have an active Facility Clearance. Even if both Company A and Company B, each individually possess the clearance, unless Company AB possess its own approved Facility Clearance, the proposal will not be eligible for award. See attached draft DD 254. Due to security restrictions, interested bidders will have to complete the attached SOA (Statement of Affiliations) and sent to Contracting POCs prior to the issuance of the STEP 1 solicitation.

In accordance with DFARS 236.204 - Disclosure of the Magnitude of Construction Projects, the magnitude of this project is between $10,000,000 and $25,000,000.

This will be a Two-Step Sealed Bid Process. The two-step procedure is designed to obtain the benefits of sealed bidding by awarding a contract to the lowest price, responsive, responsible offeror. A firm-fixed-price contract will be awarded to the responsive and responsible Bidder, whom the Government determined had an acceptable Step-One proposal, conforms to the solicitation, is fair and reasonable, and bids the lowest price.

Step One under this bidding process consists of the request for, submission, evaluation, and (if necessary) discussion of a technical proposal. Only one technical proposal may be submitted by each offeror. The proposals are evaluated for technical acceptability. The technical proposal shall not include prices or pricing information. The Government may make a final determination regarding a proposal's acceptability solely on the basis of the proposal as submitted. The Government may proceed with the second step without requesting further information from any offeror; however, the Government may request additional information from offerors of proposals that it considers reasonably susceptible of being made acceptable, and may discuss proposals with their offerors. A notice of unacceptability will be forwarded to the offeror upon completion of the proposal evaluation and final determination of unacceptability.

In the Step Two, the normal sealed bid process will be followed. Only bids based upon technical proposals determined to be acceptable, either initially or as a result of discussions in Step One, will be considered for award. Each bid in Step Two must be based on the bidder's own technical proposal. Each bidder shall comply with the specifications and the bidder's technical proposal.

It is anticipated that Step One will be released on or about 13 SEP 2019. The solicitation will be provided in an electronic format, free of charge to all authenticated account holders of Federal Business Opportunities (FBO) System. Step Two of the solicitation will be provided via amendment and will only be available to those offerors selected to advance.

Contractors must be registered with the System for Award Management (SAM) database to receive a Government contract award. Contractors must also be registered in Representations and Certifications Applications (included in SAM). The North American Industry Classification System (NAICS) Code applicable to this acquisition must be in vendor's SAM registration.
