JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command Division, Keyport Contracts Division Code 02.
2. Description of the Action Being Approved
Contract N0025320P0007 for a regular overhaul (ROH) of YTT- 10 was awarded by NUWC Keyport to Bay Ship & Yacht Co. on 17 October 2019 after full and open competition using a lowest price technically and past performance acceptable (LPTA) methodology. The awarded value was $3,106,444. Inspections conducted throughout the Period of Performance (PoP) of the YTT-10 ROH revealed that growth work beyond that originally solicited was required. Repair work is necessary to ensure the safe operation (and return to NUWC Keyport) of the vessel. To minimize safety, schedule, and cost risk, the work must be completed on current contract at Bay Ship & Yacht Co.’s facilities prior to the completed PoP.
Growth work will be negotiated on a sole-source basis with the contractor, since competing this requirement would preclude the repairs from being accomplished expeditiously.
Bay Ship & Yacht Co. will use its current workforce, facilities, and equipment to enact the repairs to allow the YTT-10 to return to Keyport, WA, and with as little disruption as possible to the scheduled and unscheduled operational needs of the vessel.
Authority to act under this J&A expires 06 April 2020.
3. Description of Supplies/Services
The following table identifies the growth work items that will result in a contract ceiling increase along with the proposed prices.
other YTT (YTT-11) is scheduled for an ROH from May – August 2020. Having both YTT craft out of commission concurrently would result in NUWC being unable to support customer range events, which would, in turn, seriously hinder the ability of key Navy programs to progress their work due to delays in ranging. As such, the YTT-10 is required to support critical operations beginning the latter part of April 2020.
Traction winch brake repairs: The ship cannot go into moor or conduct recovery operations using a remotely operated vehicle (ROV).
Forward line locker preservation: This is best done in a shipyard setup to handle the hazardous waste stream and strict environmental controls required by this work. Deferring this preservation will cause further deterioration to the ship.
Additional Schedule: This allows the critical work to be performed.
SAFETY IMPLICATIONS: Deferring the below growth work would also seriously impact the YTT-10’s and its crew’s ability to safely transit over 900 nautical miles back to NUWC Keyport.
Battery charger system: Required for the ship to be able to start its diesel engines. The diesel engines provide propulsion and electricity.
Ballast Tank Vent Check Valves and Piping: The check valves are located on the main deck, allow water to be added or removed from the ballast tanks, but also prevent seawater taken over the aft part of the ship from entering the ballast tanks. The corroded piping in the ballast tanks prevents the maintenance of proper tank level. The ballast tanks are crucial for vessel stability. On the trip down water over the aft decks flooded into the ship’s ballast tanks creating a potential unstable condition.
Circuit breaker replacement: The trip prevents the proper operation of the circuit breaker and the ship’s electric plant.
Fuel: The ship does not have enough fuel to return to Keyport, WA. The transit down to the shipyard consumed more fuel than anticipated due to heavy weather and adverse currents, therefore the SOW did not include the purchase of additional fuel.
Bow thruster vane shafts: The shafts are pitted causing the seals to leak and reduces the integrity of the bow thruster system. The bow thruster system is used in mooring evolutions.
SANITATION/ENVIRONMENTAL IMPLICATIONS: Prior to the 900 nautical mile transit back to NUWC Keyport key ship’s sanitation systems must be repaired.
Potable water tank: The tank is rusted and the pump’s suction pipe is rotted, rendering the system unsanitary. Potable water is used for washing, cooking, and showering.
Galley piping traps: have rotted through placing the galley sinks out of commission. The galley sinks are used to wash and clean utensils.
Gray water tank preservation system/piping: The preservation system has failed resulting in generalized rust, failure of pipe hangers, and holes in the tank and in the piping in the tank. The holes in the tank walls allow gray water to leak into and contaminate the ballast system, while the holes in the CHT piping inside of the ballast tank allow black water to contaminate the gray water. Ballast water is routinely pumped overboard. Pumping ballast water contaminated with gray water poses an environmental hazard when the ship is inport or in restricted waters.
Based on the foregoing analysis, it is the Government’s intent to have Bay Ship & Yacht Co. perform this critical growth work while the vessel is at their facility in order to protect the vessel from the risks described above. It is imperative to begin this work quickly in order to ensure its completion prior to the end of the Period of Performance.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
No other sources have expressed interest as this requirement has not been advertised or announced to the public. No additional market research has been conducted due to the urgency of the requirement.
The importance of making the permanent repair promptly impedes the Contracting Officers’ ability to solicit maximum competition. Based on the urgency of the repairs and lack of control over access to Bay Ship & Yacht’s facilities, it is impractical to request offers from other Offerors. The requirement will not be synopsized per FAR 5.202(a)(11) and FAR 13.105(a), as the proposed action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of
5.207 with respect to the current proposed contract action.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A are fair and reasonable. NUWC Keyport’s Port Engineer, who has over 15 years in the ship repair business will complete an independent government estimate (IGE).
8. Actions to Remove Barriers to Competition
The ROH for NUWC Keyport’s YTT-11 has been awarded. To preclude the need to request an increase in ceiling, that contract has built-in allowances for additional growth capacity.
