. 1 1352.213-70 EVALUATION CRITERIA

1352.213-70 EVALUATION UTILIZING SIMPLIFIED ACQUISITION PROCEDURES (APR

2010)

The Government will issue a purchase order resulting from this Request for Quotation (RFQ) to the responsible quoter offering the lowest evaluated quotation price that meets or exceeds the acceptability standards of the non-cost factors, considering both price and non-price factors. Past

Performance shall be considered more important than price in this evaluation.

The following factors shall be returned and will be used to evaluate quotations:

1. Past Performance.

The offeror's past performance on related contracts will be evaluated to determine as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, cost management, communications between contracting parties, proactive management and customer satisfaction.

- Offeror shall provide a list of at least two (2) past performance references (including

Government agencies if applicable) that you have successfully provided the listed items in the RFQ to in the past 3 years. Past performance references shall include the following information: Company name or Government agency, name of the project, address, contact person’s name and phone number, and the date of delivery of those items.

NOAA will evaluate the relevance and quality of the offeror’s past performance information. In evaluating quality, NOAA will evaluate the quality of service, cost control, timeliness of performance and business relations, proactive management, technical capability and customer satisfaction.

If a quoter has no relevant past performance history, a quoter must affirmatively state that it possesses no relevant past performance history. Offerors who fail to either provide past performance information or affirmatively state they have no past performance history may be considered non-compliant to the solicitation.

2. Price: The offeror’s quoted prices listed on line items 0001-0010 of this RFQ.

Price Proposal: NOAA will evaluate the quoter’s proposed prices for fairness and reasonableness in relation to this RFQ’s requirements. The government intends to award a single fixed price contract in response to this solicitation. The Government reserves the right not to award a contract.

All offers received will be evaluated in accordance with the evaluation criteria. The Government reserves the right to make an award without discussions based solely on initial proposals.

PAGE 11 OF 31 WC-133F-16-RQ-0305

Therefore, offerors should ensure that their initial proposal constitutes their best offer in terms of both price and the technical solution being proposed.

3. Insurance:

The offeror must provide proof of general business insurance.

4. Options:

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(4) [_] Have, [_] have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).

(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126).
