DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES

FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C244-23-AP-4980

1. Contracting Activity:

Department of Veterans Affairs, Veterans Integrated Service Network 04 (VISN04), Wilkes Barre VA Medical Center (VAMC), Network Contracting Office 4 (NCO4), PR# 693-24-4-113-0149.

2. Nature and Description of the Action Being Processed:

This sole source justification supports a short-term contract to maintain continuity of healthcare services at the VA Outreach Clinic at Wayne County, Pennsylvania (Wayne County Outreach Clinic), pending establishment of a long-term contract for these services. This action is conducted in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR

13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. The government anticipates award of a firm fixed price contract to include a one-year performance period. The total estimated contract value is

3. Description of Services Required to Meet the Agency’s Needs:

The Wayne County Outreach Clinic currently provides healthcare services to veterans residing in the vicinity of Wayne County, PA, under the authority of 38 U.S.C. 8153. The clinic provides a continuum of critical primary care services including prevention, diagnosis, treatment, and appropriate referral and follow-up services. Those patients that require specialty or follow-up care may be referred to the clinic’s parent facility: Wilkes Barre VAMC. The clinic provides coordinated care that is accessible, patient-centered, and consistent with VA standards as defined in VHA Directive 2006-

041. Wilkes Barre VAMC requires a short-term interim contract to provide continuity of healthcare services pending procurement of a long-term contract for the professional medical staff, diagnostic testing, referral arrangements, and associated services currently provided by the Wayne County Outreach Clinic.

4. Statutory Authority Permitting Other than Full and Open Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy

Agency Requirements ( ) (2) Unusual and Compelling Urgency ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute ( ) (6) National Security ( ) (7) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The incumbent contractor, Wayne County Memorial Community Healthcare Centers, a large not-for-profit business entity, is the only firm with the capability to maintain continuity of healthcare services within the required performance period. The incumbent provides these services within an existing Federally Qualified Health Center (FQHC), which is not typical of contracted VA outpatient primary care clinics. The required services are highly specialized, and competitive procurement at this time would result in unacceptable delays that would disrupt patient care. Recognizing that award to a new contractor may necessitate a period of approximately four months to identify a physical location, demonstrate compliance with Joint Commission, OIG, and VA standards of care for veterans, and commence services, NCO4 intends to establish a one-year interim contract with the incumbent to avoid disruption to patient care pending long-term contract procurement. The incumbent contractor has performed successfully and is the only source with the necessary systems and processes in place at this time pertinent to veteran eligibility, electronic patient records, diagnostic requests, invoicing, telemedicine, and other requirements to provide services in accordance with Joint Commission, OIG, and the Wilkes-Barre VAMC’s performance requirements.

The program office has submitted a procurement package for establishment of a long-term contract to succeed the subject effort.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Because the agency requires continuity of healthcare services at the current location, only the incumbent contractor will be solicited for this interim contract. As indicated in Section 5 above, only the incumbent contractor has the necessary systems and processes in place to ensure continuity of healthcare services at the physical site in accordance with Joint Commission, OIG, and the Wilkes- Barre VAMC’s performance requirements.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:

The incumbent contractor currently provides the required services to Wilkes Barre VAMC. This demonstrates the incumbent contractor’s understanding of the healthcare services required and capability to provide those services at fair and reasonable market pricing. Additionally, the incumbent contractor is registered in System for Award Management (SAM) as a not-for-profit
