About this file

This is an exemption verification letter from the Northwest Florida Water Management District to Leon County Public Works regarding the Old St. Augustine Road Sidewalk Project (Application #PDEX-073-327645-1). The District determined that the project is eligible for an exemption under Florida Administrative Code rules 62-330.051(4)(d) and 62-330.051(4)(c), meaning the project will not require a District permit. The exemption also constitutes an express waiver of water quality certification under Section 401 of the Clean Water Act. The letter, dated December 4, 2025, was issued by Selina Potter, P.E., Chief of the Bureau of Regulatory Permits, and notes that applicant Chris Muehlemann may contact Ashley Austin at (850) 951-4660 with any questions.

The exemption verification applies only to the requirements of the Northwest Florida Water Management District and does not relieve the applicant of meeting permit requirements from other agencies. This letter supports the concurrent Leon County procurement for sidewalk construction along Old St. Augustine Road, which has a mandatory pre-bid meeting scheduled for July 1, 2026, and proposals due July 21, 2026. The procurement documents reference this Water District Exemption along with City of Tallahassee permits and Federal Terms, indicating that additional regulatory compliance may be required from other jurisdictions despite this District exemption.

Re: Old St. Augustine Road Sidewalk Application # PDEX-073-327645-1 (Please reference the above number on all correspondence)

Dear Chris Muehlemann:

The Northwest Florida Water Management District (District) received your application on November 21, 2025 requesting an exemption verification for the referenced project.

Based on the information provided, the District has determined that the project is eligible for an exemption under 62-330.051(4)(d), 62-330.051(4)(c). Therefore, the project will not need a District permit pursuant to rule reference.

This permit also constitutes an express waiver of water quality certification under Section 401 of the Clean Water Act, 33 U.S.C. Section 1341. Pursuant to Rule 62-330.062, F.A.C., State Water Quality Certification is waived for activities that are exempt under rule 62-330.051 or 62-330.0511, F.A.C.

This exemption verification only applies to the requirements of the District and does not relieve you of meeting the permit requirements of other agencies. Please contact Ashley Austin at (850) 951- 4660 if you have any questions.

Sincerely, Selina Potter, P.E., Chief Bureau of Regulatory Permits
