WBAMC EMT Solicitation Answers to Questions #1

1) There is no Attachment 4 as referenced on page 81 of the solicitation for Factor 2 - Past Performance. Page 68 of the solicitation lists Attachment 3 is for Past Performance. Is this an oversight or are we missing Attachment 4?

ANSWER: This is an oversight. There is no Attachment 4. Attachment 4 is the Past Performance form.

2) Can a Prime Offeror submit all the 2 Past Performance References of its proposed major subcontractor to be considered acceptable for award?

ANSWER: The Past Performance References must be from the Prime Offeror, not any potential subcontractors.

3) Does the Offeror have to submit a minimum of 2 Past Performance References to be considered for award? Or can the Offeror just submit 1 Past Performance?

ANSWER: If the Offeror does not provide two Past Performance references, they will be rated as neutral.

4) Are 8(a) Joint Venture allowed to submit their offer?

ANSWER: Code of Federal Regulation §124.513, paragraph, (2)(b) states the following:

Size of concerns to an 8(a) joint venture. (1) A joint venture of at least one 8(a) Participant and one or more other business concerns may submit an offer as a small business for a competitive 8(a) procurement so long as each concern is small under the size standard corresponding to the NAICS code assigned to the contract, provided:

(i) The size of at least one 8(a) Participant to the joint venture is less than one half the size standard corresponding to the NAICS code assigned to the contract; and

(ii)(A) For a procurement having a revenue-based size standard, the procurement exceeds half the size standard corresponding to the NAICS code assigned to the contract; or

(B) For a procurement having an employee-based size standard, the procurement exceeds $10 million.

5) Can we submit completed FAR Clauses (item # d, e, f, and i) in single document or do they have to be all separate submissions?

ANSWER: Either way is fine.

6) Is FAR 52.22.17 - Non Displacement of Qualified Workers applicable to this requirement?

ANSWER: Yes, FAR 52.222-17, Non-Displacement of a Qualified Worker, does apply to this requirement.

7) Is this a new requirement or an existing requirement? If existing can we be provided incumbent contract #, period of performance, contract value, # of incumbent personnel, and length of incumbent personnel service dates.

ANSWER: The contract number for the current contract is W91YU0-14-P-0257. That is the only information I can provide.

8) Section 401, page 57 for "Uniforms" requires contractor to furnish uniforms. Can we be provided with WBAMC prescribed uniform requirement?

ANSWER: Answer will be provided no later than Monday, 2 November 2015.

9) Will a copy of QC Plan as identified in section 1.9.1 on page 52 be made available prior to response submission deadline?

ANSWER: Answer will be provided no later than Monday, 2 November 2015.

10) If in our proposal we claim to have no relevant past performance, and are rated by your Contracting Officer as “Neutral” in Factor 2, Past Performance, how would our proposal be rated as compared to a company with a Substantial, Satisfactory, or Limited confidence Past Performance rating if ratings for Factor 1 (Recruitment and Staffing Plan) and Factor 3 (Price) are determined essentially equal for both our companies?

ANSWER: HCAA Local Clause 5005 replaces paragraph (a) of clause 52.212-2 and the proposal will be evaluated as follows:

The Government will award a contract to the responsible offeror whose offer will be most advantageous to the Government, using a tradeoff selection process, price and other factors considered. (ref: HCAA Local Clause 5005 paragraph "b"). In order to be considered for award all evaluation factors must be rated at least “Acceptable,” “Satisfactory Confidence” or “Neutral” (ref: HCAA Local Clause 5005, very last sentence of clause). Further, Factors 1 and 2 are equal in importance. When combined, factors 1 and 2 are significantly more important than factor 3, Price. However, price could become the determining factor, if the proposals are determined to be essentially equal (ref: HCAA Local Clause 5005, next to last sentence of clause).

Thus, since this is a tradeoff selection process, the answer to your question may be extrapolated with the explanation of the method of evaluation (shown above).

11. Is this a new requirement?
