4. Authority Cited:

(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

5. Reason for Authority Cited: Kirk Army Health Clinic, Aberdeen Proving Grounds, MD, under the supervision of Kimbrough Ambulatory Care Center, Fort Meade, MD requires urgent Hospital Laundry and Linen services. Nixon Uniform Service has provided such services for the last 5 years.

Therefore, Nixon Uniform Service is able to provide continuing service without any break in service or degradation of quality. If another vendor attempts to provide the required service, the possibility is likely that there will be a lapse in service due to costs and time-consuming transition related functions.

A lapse in coverage would translate to Infection Control deficiencies, Joint Commission adverse findings and Occupational Safety and Health Administration (OSHA) violations, which demand closure of the Kirk Army Health Clinic. Failure to provide the needed services could ultimately jeopardize patient care and mission accomplishment.

6. Actions to Increase Competition: Due to the time sensitivity of this requested bridge contract, no sources Sought Notice will be posted on the Federal Business Opportunities (fbo.gov) website. No additional action will be taken to increase competition for this requirement.

This not will be posted on FBO to increase competition.

7. Market Survey: Market Research was conducted in accordance with FAR Part 10. The Small Business Administration’s Dynamic Small Business Search tool for queried for NAICS 812320. The Dynamic Small Business Search revealed the following concerns that are able to provide these services under NAICS 812320: 30 HubZone Certified; 24 Certified 8(a); 169 Veteran Owned; 224 Woman or Women Owned; 4 SDB Certified; 111 Service-Disabled Veteran. A special notice was posted to Federal Business Opportunities to notify vendors that a one year bridge contract would be put in place with the current vendor. The notice also let them know that a future competitive follow-on effort is planned at the conclusion of the one year bridge (see PCF B.01). Four vendors expressed interest in the competitive follow-on effort. Vendors were informed that their company information would be saved and they would receive an e-mail once the future solicitation is posted.

8. Procurement History:

Previous Contract or Purchase Order Number: W91YTZ-19-A-0016 or N/A Previously competed? N/A No Yes Previous procurement was as a 100% small business set-aside. There were 4 respondents. 1 of the vendors was NOT a Small Business and 2 vendors were excessive in pricing. The selected vendor amended their pricing post award. That pricing was deemed excessive. In essence, the appearance is that the vendor submitted an unrealistically low price to win the LPTA procurement.

Time constraints now dictate a bridge contract.
