Sole Source Justification for Actions under the Simplified Acquisition Threshold (Currently $250K)
1. Contracting Activity: Department of the Army United States Army Medical Command Army Health Contracting Activity Dalecarlia Health Contracting Cell
6021 5th Street, Building 1467 Fort Belvoir, VA 22060-5505
2. Description of Action: Annual Repair and Maintenance Services
Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: Total Dollar Value: $148,176.00
Name of Intended Contractor: Advanced Sterilization Products Street Address: 33 Technology Drive City, State, Zip: Irvine, CA 92618
Phone: 888-783-7723
3. Description of Supplies/Services: McDonald Army Health Center (MCAHC), Joint Base Langley-Eustis, Fort Eustis, VA has a requirement to purchase scheduled and unscheduled repair and maintenance services, including parts, for government-owned STERRAD Sterilizer (SN 073528) and EVOTECH ECR System and Disinfector (SN 5041160035).
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: ASP is the sole source proprietor to the current ASP Disinfector and Plasma Sterilizer System currently installed at the General Surgical Section at McDonald Army Health Center. The Sterilizer System uses hydrogen peroxide which at low temperatures is converted to a gas vapor as it is injected. An electric current breaks apart the chemical bonds in the vapor and it transforms into a highly charged plasma; a type of substance used for sterilization surgical and procedural instruments to kill bacteria, viruses, fungi, and even bacterial spores. The maintenance and repair services are critical to the STERRAD Sterilizer and EVOTECH ECR System. Only authorized servicing by personnel who have been trained and certified by Advanced Sterilization Products (ASP) can service this system. Any servicing attempted by other personnel will void all warranties or service agreements (See PCF Cabinet, file A.02.04 Service-Sole Proprietor Letter v1 dated 31 July 2018). Failure to provide these maintenance and repairs services will result in diminished care to patients.
6. Actions to Increase Competition: There are no practical alternatives available to increase competition for this requirement, as ASP has the proprietary rights to the software and operating systems needed to perform maintenance and repair services on the STERRAD Sterilizer and EVOTECH ECR System. APS field service technicians are the only authorized representatives to make necessary repairs and perform routine preventive maintenance to the STERRAD Sterilizer and EVOTECH ECR System currently in place at McDonald Army Health Center. Changing vendors, to add equipment that is already in place would require McDonald Army Health Center to invest in a whole new system. This would place a financial burden on the department and Health Center. In addition, this could require staff to be trained on a new system and would incur additional costs to the Government. Staff is fully trained on the current STERRAD Sterilizer and EVOTECH ECR System and allows for increased work efficiency.
7. Market Survey: Internet searches were performed to determine if any other sources were available.
