52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

1 Evaluation Process

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. This is a commercial acquisition to obtain a venue for the 3637th Tier 1 and 2 Event.

(b) In accordance with the “best value” definition outlined in FAR 2.101, the award will be made based on the best overall (i.e., best value) proposal, using a best value trade off method. It is anticipated one award will be made to the best overall proposal determined to be the most beneficial to the Government.

(c) The Government reserves the right to make no award, or one award.

(d) A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

2 Basis For Contract Award

(a) Any award made will be based on the most advantageous (i.e., FAR 52.212-2 Evaluation Commercial Items – Oct 2014) to the Government, price and other factors considered using the best value trade off method

An evaluation will be conducted on the basis of the rating of th efollowing factors:

(5) Evaluation Factors Order of Importance Factor 1 - Technical Factor 2 - Price

Technical is considered more important than price.

FACTOR 1 –Technical The Government will evaluate the quotations based upon two components: the Offeror’s understanding of the requirement and the Offeror’s feasibility of approach relative to the evaluation will consist of an assessment of all relevant aspects of the Offerors’ technical quotation based on the following:

a) Understanding of the Requirements. The extent to which the Quotation demonstrates a clear understanding of the Statement of Work (SOW) and the quotation adequately and completely considers, defines, and satisfies the requirements specified in the solicitation.

b) Feasibility of Approach. The extent to which the quotation is workable and the end results achievable. The extent to which successful performance is contingent upon proven devices and techniques which do not require excessive development. The quotation will be evaluated to determine how the Offeror’s methods and approach in meeting the requirements to ensure successful performance. The extent to which the Offeror is expected to be able to successfully complete the proposed tasks and requirements within the proposed schedule.

FACTOR 2 – Price The Government will evaluate the offeror’s proposal to determine if the proposed price represents the best value (as defined in FAR 2.101) to meet the government’s needs. A determination will be made as to whether an Offeror has completed all aspects of the quotation properly and whether the amounts listed in the price proposal are calculated accurately. In terms of “price reasonableness” the Government will focus on whether the price is too high to be considered fair and reasonable. In terms of “completeness”, the Government will focus on whether the price appears to cover all of the work identified in the SOW.

3. Table of Ratings

4. Definitions

Best Value is the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement.

Clarifications are limited exchanges between the Government and offerors that may occur whenaward without discussions is contemplated.

Communications are exchanges, between the Government and offerors, after receipt of proposals, leading to establishment of the competitive range.

Discussions are negotiations that are conducted in a competitive acquisition and take place after the establishment of the competitive range.

Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.

Proposals rated deficient in any factor shall not be eligible for contract award.

Minor or Clerical Error is a minor informality or irregularity that is merely a matter of form and not of substance or a clerical error apparent on its face in the proposal.

Performance Confidence Assessment is an evaluation of the likelihood (or Government’s confidence) that the offeror will successfully perform the solicitation’s requirements; the evaluation is based upon recent, relevant past performance information.

Quality is how well the contractor has performed on past contracts. It will be obtained from performance information from questionnaires or narratives tailored to the circumstances of the acquisition and from other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract reporting System (eSRS), or other databases; the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.

Rating is the adjective/color descriptor assigned by the evaluators’ to the non- Cost/Price Factors and corresponding Subfactors. It represents their conclusions as to the quality of the proposal, supported by narrative write-ups identifying the associated strengths, weaknesses, deficiencies, risks, and uncertainties. The strengths, weaknesses, etc., are the findings that support the rating adjective/color. For the purposes of this requirement, the Government shall be utilizing adjectival descriptors as outlined on the included tables.

Recency, as it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is generally expressed as a time period during which past performance references are considered relevant. For the purpose of this requirement and RFP, past performance information must be within three (3) years of the RFP memorandum date to be considered recent.

Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

Risk, as it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.

Significant Strength is an aspect of an offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.

Strength is an aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Tradeoff Process is the process which permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal.

Uncertainty is any aspect of a non-cost/price factor proposal for which the intent of the offer is unclear (e.g. more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).

Weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.
