FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: 411th CSB, ATTN: ASCC-KOY-S, UNIT #15289, APO AP 96271-5590
2. Description of Action: 607 MMS, Daegu AB requests a Firm Fixed Price new Contract with Hanwha 63 City Col, Ltd. The Government projects award for Mar 2019 and fiscal year 2019 Operations and Maintenance funds will be used.

3. Description of Supplies/Services: Base Maintenance Contract (BMC) Services at Daegu AB, Gimhae AB, Gwangju AB, Cheongju AB and Wonju AB

4. Authority Cited:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
A. The current contract expires on 27 March 2019. The follow-on contract for this project is funded by CY19 LCS, W91QVN-19-D-0004 was sent J-4 for ROK Government’s Approval on 21 Feb 2019. The Special Measures Agreement under which the Logistic Cost Sharing funds are governed has been signed however, LCS spending bill has not been approved by the ROK Congress. 607th MMS has submitted a request and funding for a sole source contract to cover critical functions covered under the requirements proportion of the contract. These functions which man critical components 24 hours a day are essential to the readiness of the USFK forces here in Korea.
B. At present, the only viable solution to the lapse in services for BMC due to LCS funding delays would be to award a sole source contract to the incumbent contractor.
The current contractor possess the required tools, equipment and significant technical expertise to maintain existing systems. Based on the unique situation the Government cannot reasonably expect another company would be able to take over the performance of these critical components at five (5) collocated Air Bases in such a short window and failure would be devastating to the USFK’s mission here in Korea.
C. The contract is crucial to the maintenance and repair of the infrastructure for Daegu, Gimhae, Gwangju, Suwon and Cheongju Air Bases. Any loss of service could not only incur permanent damage on an already aged infrastructure, but also jeopardize the health and safety of US and ROKAF forces, consequently diminishing mission capabilities at each location.

8. Market Research: No additional sources will be solicited for this contract requirement. Due to lack of time and the amount of preparation needed for a contractor to start performance the Government cannot reasonably expect a new contractor to successfully perform this requirement given the circumstances.
Therefore the Government is not aware of any other responsible source other than the incumbent, Hanwha 63 City Co., Ltd which is currently performing and has staff in place. The authority cited in FAR Part 6.302-1, One Responsible Source and no other supplies or services will satisfy agency requirements. – Authority Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1).

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based on a price analysis which examines current prices being paid for the services and IGE versus the incumbents proposed prices.
14. Contracting Officer Certification/Approval:
Based on the foregoing justification, I hereby approve the procurement of BMC Contract Services for Daegu, Gimhae, Gwangju, Suwon and Cheongju Air Bases on an other than full and open competition basis pursuant to the authority of 10 U.S.C.2304(c) (1), FAR Part 6.302-1, subject to availability of funds, and provided that the services or property herein described have otherwise been authorized for acquisition.
