FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval
1. Contracting Activity: 411th CSB, APO AP 96251
2. Description of Action: 621st Air Control Squadron requests a firm-fixed-price with CORNET TECHNOLOGY. The Government projects award for Sep 2018 and fiscal year 2018, funds type Operations and Maintenance funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The 621st Air Control Squadron (621 ACS) requires an IPGate Upgrade to existing TVCS-MR conference switch
Period of Performance: 45 Days ARO Total Value:
4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5:
Other: The purpose of this contract is to fulfill a dire mission requirement for the 621st ACS to have a contingency comm suite to be deployed, prepared, and utilized upon direction of the 607 AOC/CC or higher headquarters directive.
5. Reason for Authority Cited:
a) The 621 ACS deploys this CORNET system currently for use in controlling aircraft in wartime and armistice operations. CORNET provides the comm background and architecture that the controllers use to keep aircraft safe and direct missions in a time-sensitive situation. When personnel arrive on station, they are trained in the use of this software and given a qualification to use it. Upon request, the 621 ACS will be tasked by the Commander, 7AF to deploy to a contingency location and the expectation is that we will deploy and be ready to execute control of wartime assets within 24 hrs. This means that the backup system must be a mirror image of the primary system. This allows maximum efficiency in setup of the backup system reducing man-hours required to establish the backup site. More importantly, controllers will be more familiar with the backup system which directly reduces the chances of fratricide or malfunctions as well as reducing the chances of mission failure.

Program/Equipment: IPGATE Upgrade
b) Alternatives: Alternative systems exist that could meet this requirement, however the pursuit of such systems would cost the government a larger amount due to the need to purchase 2x systems in order for the backup to mirror the primary. Additionally, CORNET’s system is combat tested and is the primary operating system for CENTCOM’s operational C2 network.
(c) Following additional justification
1) Without this equipment, the 621 ACS ability to deploy to a contingency operating location is significantly degraded. We would require a significantly longer amount of time to dismantle our primary system, transport it, and then set it back up and this would all require the equipment to not be damaged in an attack. This would lead to an extended period of time where no English-speaking tactical C2 exists in the theater which would put an additional stress on airborne C2 platforms which are already overtasked in a wartime scenario.
2) This equipment meets CSAF mandated requirement for Korea tactical units to gain/maintain a COOP (continuity of operations) capability
3) Not pursuing this purchase would put lives in jeopardy due to the possibility that the primary system could be damaged in an attack and no backup system being in place.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201.
7. Actions to Increase Competition: Competition is not available due to CORNET being the only contractor that could meet this requirement based on the previously mentioned justification. Buying 2 new systems would cost more time/money and no other system has been as tested or proven in a combat situation.
8. Market Research: Market Research that has been done is investigating COMPUNETIX for a similar capability. The system this contractor produces does not meet our mission requirements currently.
9. Interested Sources: To date, no other sources have written to express interest in the acquisition.
10. Other Facts:
a. Procurement History:
(1) FY17-W90VN6-17-P0061 - TCT 8000 Upgrade - met by CORNET due to only contractor available to upgrade our system to it’s current capability
Program/Equipment: IPGATE Upgrade

(3) FY16 - W90VN6-16-P0068 - CIP Upgrade awarded to Cornet due to them being the original contractor that created the equipment that we needed upgraded.
