Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable””.

9. Do they provide military base housing or have resources to arrange off base housing?

If there are any details regarding off base housing, how best can we locate those resources or do you have a list of lodging used in current or previous contracts?

RESPONSE: Housing is not provided by the Government.

10. With fluctuations in exchange rates, please advise if you will consider removing the requirement to submit rates in Korean Won and be agreeable to accepting rates in U.S. Dollars?

RESPONSE: ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (Jan 2017), FACTOR III PRICE is amended to remove the statement that prices shall be in local currency (Korean Won). Prices submitted in currency other than United States Dollars (USD) shall be converted to USD using the Fiscal Year 2018 exchange rates on the closing date of this solicitation for evaluation purposes.”

11. If U.S. Dollars not accepted for pricing this contract, will Korean Won exchange rate be adjusted to match proposed contract rates if awarded this contract once invoicing begins?

RESPONSE: The Korean Won exchange rate will be based on the current U.S. Government Currency Exchange Rate for Fiscal Year 2018 in the awarded contract. 12. Please advises of invoicing protocols and payment protocols for this contract? (i.e. Net 15 days for certified Veteran Owned Small Business? Will copies of approved time sheets be required to accompany invoices?)

RESPONSE: Discount Terms as "NET 30 days" will be inserted when the contract is awarded.

13. Can vendor invoices be submitted electronically to Wide Area Work Flow (WAWF) for payment?

14. May I ask what is the expectation for Factor I 100 page limit? I was a bit confused, assuming the 4 subfactors wouldn’t total more than 10 – 20 pages. I think I must have missed something in the PWS.

RESPONSE: In accordance with Addendum to FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (Jan 2017), A.3.a. FACTOR, TECHNICAL, the technical volume has a 100 page limit. Technical volume cannot be more than 100 pages but can be less than 100 pages.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision) Addendum to FAR 52.212-2 Evaluation – Commercial Items (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Award will be made to the responsible Offeror submitting the Lowest Price Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.

FACTOR I TECHNICAL: Each factor and subfactor will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or subfactor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements outlined in one of the four (4) subfactors below, the subfactor, and overall proposal will be rated “unacceptable” and will not be eligible for award.

Technical Ratings

Rating
Description
Acceptable
Proposal meets the requirements of the solicitation.
Un-acceptable
Proposal does not meet the requirements of the solicitation.

Subfactor 1. Business Registration: The offeror will be evaluated based upon on submitted documentation demonstrating a current and valid Business Registration issued by System Award Management web.

Subfactor 2. FNP’s Education Certificate (PWS Para 1.6.8): The offeror will be evaluated based upon on submitted documentation demonstrating a Certificate Master Degree of Science in Nursing as a minimum requirement.

Subfactor 3. FNP’s Certification of BLS or CPR (PWS, Para 1.6.8.1.1.): The offeror will be evaluated based upon submitted documentation demonstrating a current and valid certification in either the American Heart Association Basic Life Support (BLS) (Course C) or the American Red Cross Cardiopulmonary Resuscitation (CPR)/BLS Course.

Subfactor 4. FNP’s Prior Experience (PWS Para 1.6.8.1.2.): The offeror will be evaluated on submitted individual resume for a minimum of three (3) years of total nursing experience including one (1) year of Family Nurse Practitioner (FNP) within five (5) years. Resume must clearly identify information as required below:

- Proposed position title

- A description of qualifying work experience

- Company Name/Employer, email/phone number of validating point of contact (POC)

- Length of work experience (year/month/date - year/month/date)

FACTOR II. PAST PERFORMANCE: Past performance will be evaluated on an acceptable/unacceptable basis. Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided.

The offeror shall provide recent and relevant past performance in the same or similar type of services for refuse collection services to U.S. military bases, ROK military bases or local commercial market. Recent past performance is within the last five (5) years from the issuance date of this solicitation. Relevant past performance are those that are the same or similar type of services.

The past performance will be evaluated for all offeror’s proposals by the Contract Specialist/Contracting Officer in the following manner:

(1) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.

(2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.

(3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance but is not obligated or compelled to consider all potential sources of past performance information..

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”

Past Performance Evaluation Ratings

Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above)
Un-acceptable
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

FACTOR III. PRICE: Proposed price will be reviewed to determine if the estimate is complete and reasonable. The price proposals will be evaluated IAW FAR 15.404-1(b). The following applies to that evaluation.

(1) Completeness. The offeror shall complete the pricing information for all CLINs/Sub-CLINs identified for base period plus four (4) options (total five (5) years). Any underlying assumptions including proposed escalation rates between the 1st and subsequent periods shall be clearly explained.

(2) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, current market prices for same or similar services and/or when compared among other technically acceptable offerors.

(3) Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period of five (5) years from the date of award. Price must include all CLINs/Sub-CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.

(4) FAR Clause 52.217-8 Option to Extend Services. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option, and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period.

(5) The Government will evaluate the offeror's price in accordance with FAR 15.404-1, Proposal Analysis Techniques. Prices submitted in currenty other than United States Dollars (USD) shall be convered to USD using the Fiscal Year 2018 exchange rates on the closing date of this solicitation for evaluation purposes.
