Control No:18-0026 Contractor: Motorola Solutions, Inc.
Program: LMR-K Maintenance Support Services
Version – March 2017 FOR OFFICIAL USE ONLY
FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval
1. Contracting Activity: 411th Contracting Support Brigade, Unit #15289, APO AP 96205-5289
2. Description of Action: 1st Signal Brigade requests a Firm Fixed Price Contract with Motorola Solutions, Inc. The Government projects award for March 2018 and fiscal year 2018 Operations and Maintenance funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
NOTE: This action is a follow-on to contract W91QVN-17-C-0008. That contract was not competed under authority Far Part 6.302-1. Paragraph, “Actions to Increase Competition” of the previous justification, stated: Motorola is the only vendor authorized to maintain the existing Korea-LMR P25 IV&D system. Unless another operating system is purchased and implemented for the Pacific further competition cannot be obtained.
Those were not accomplished due to no purchase of another operation system. See the attachment 1 (A copy of the previous approved justification.)
3. Description of Supplies/Services: Provide Land Mobile Radio-Korea (LMR-K) Operational Maintenance (OM) support for the existing Korea-LMR P5 IV&D digital truck network system to include network preventative maintenance, dispatch service and onsite infrastructure response, infrastructure repair, security monitoring, technical support, and network monitoring services.
Period of Performance:
Base Year: 31 March 2018 thru 29 September 2018 Option Year 1: 30 September 18 thru 31 March 2018
4. Authority Cited: 10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: The Korea-LMR P25 IV&D system was designed, manufactured, installed, and integrated by Motorola. The system has been maintained by Motorola personnel. Motorola is the only vendor that can provide factory technical support 24 hours a day, 7 days a week for the Korea-LMR system. Motorola is the only vendor that operates a DOD/NSA approved secure monitoring to identify malicious activity that may cause system interference or corruption on the existing Korea-LMR system. Motorola is the only vendor that performs quarterly vulnerability scans on Motorola manufactured test systems using third party scanning tools to identify and

Version – March 2017 FOR OFFICIAL USE ONLY address new vulnerabilities and compliance issues. Motorola also obtains Information Assurance Vulnerability Management (IAVM) Alerts Issued by the Department of Defense Computer Emergency Response Center (DoD-CERT), and Original Equipment Manufacturer Bulletins and Technical Tips (Microsoft, Oracle, Solaris, RedHat, Adobe, etc.) to identify and address the new vulnerabilities identified. These vetted updates are provided and applied to the Korea-LMR system in the following manner;
- McAfee UNIX AV: Less than every fourteen days.
- UNIX, Linux and Third Party Patches: Quarterly.
As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. Only if Motorola agrees to enter into specific partnering agreements or provides licenses and certifications to other commercial entities, can other vendors maintain their systems.
The Korea-LMR P25 IV&D system provides sole communication to military police and fire personnel for base and post security. Lives/Safety would be in jeopardy if the radio network were not maintained in a state of full operational readiness. There would be complete mission failure for IMCOM-Korea and some subordinate 8th Army units that depend on reliable radio communication for command and control.
Currently new LMR system is being solicited on the open market to replace aging system.
6. Efforts to Obtain Competition: The 1st Signal Brigade routinely evaluates LMR capabilities from various manufacturers through interaction with the LMR Program Manager for the Pacific Area of Operation (AO). The Pacific AO determines the mobile land requirement and for any change for the Pacific. The Pacific AO Representative would have to make the decision to change the operating system and this would be extremely costly to implement with an estimated cost o
7. Actions to Increase Competition: Competition is neither available nor applicable as the Motorola System Solutions can only work with the brigade's existing LMR-K infrastructure. There are re-sellers of the same product, however, this Brand Name is the only source able to provide layer consists of end user building (EUB) switches that are required to be JITC approved, able to be DISA STIG’d, and managed through the NETCOM standard monitoring & management tool set. Competition can and does exist at the vendor/reseller level. Any authorized vendor/distributor will be able to participate in this solicitation. 1st Signal Brigade is the Operations & Management echelon and its supporting headquarters command serves as the LMR program manager for the entire Pacific AO. The program manager has contacts with various manufacturers, providing our requirements, asking the manufacturers to provide a viable solution for testing and further evaluation. Motorola Solutions provides the only equipment fully compatible with

A six month option period will not be exercised in case New LMR-K System comes to the 1st
Sig before the start date of the option period.
8. Market Research: Due to the existing U.S. Army LAN, mission requirements and market research, products are the only items that can be utilized to meet this particular requirement. 1st Signal Brigade and the LMR Program Manager has contacted possible sources, but no two vendors produce compatible items for the current requirement
