Service: LMR Security & Support Services for Korea Department of Army

FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: 411th Contracting Support Brigade, Unit #15289, APO AP 96205-5289

2. Description of Action: 1st Signal Brigade requests a firm-fixed-price contract with Motorola Solutions, Inc., 7031 Columbia Gateway Dr FL 3, Columbia, MD 21046-2583.

The Government projects award by 30 March 2016 for fiscal year 2016 and Operations and Maintenance Army funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services: Provide Land Mobile Radio-Korea (LMR-K) Operational Maintenance (OM) support for the existing Korea-LMR P5 IV&D digital truck network system to include network preventative maintenance, dispatch service and on-site infrastructure response, infrastructure repair, security monitoring, technical support, and network monitoring services.

Period of Performance: 31 March 2016 to 30 March 2017 Total Value:

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The Korea-LMR P25 IV&D system was designed, manufactured, installed, integrated and maintained by Motorola Solutions, Inc.

(Motorola) under contract W91CRB-12-C-0049 that was awarded on 1 June 2012. The current maintenance will expire on 30 March 2016. Motorola is the only vendor that can provide factory technical support 24 hours per day, 7 days per week, for this particular Korea-LMR P25 IV&D system. Motorola is the only vendor with certified and trained personnel to provide the required services on the existing system. Motorola is the only vendor that operates a DoD/NSA approved secure monitoring facility to identify malicious activity that may cause system interference or corruption on the existing Korea-LMR P25 IV&D system. Motorola is the only vendor that can perform quarterly vulnerability scans on Motorola manufactured test systems using third party scanning tools to identify and address new vulnerabilities and compliance issues. The Korea-LMR P25 IV&D system maintains an Information Assurance (IA) accreditation and only certified and tested components can be added to the joint system and Motorola is the only manufacturer of equipment that is certified to maintain the required IA accreditation on this system. In addition, Motorola is the only manufacturer of the DoD approved ASTRO 25 trunked RF repeater equipment that is Host Nation Approved for use in the Republic of Korea.

As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of

Service: LMR Security & Support Services for Korea supplies or services will satisfy agency requirements, full and open competition need not be provided for. Only if Motorola agrees to enter into specific partnering agreements or provides licenses and certifications to other commercial entities, can other vendors maintain their systems.

The Korea-LMR P25 IV&D system provides sole communication to military police and fire personnel for base and post security. Lives/Safety would be in jeopardy if the radio network were not maintained in a state of full operational readiness. There would be complete mission failure for IMCOM-Korea and some subordinate 8th Army units that depend on reliable radio communication for command and control.

6. Efforts to Obtain Competition: The 1st Signal Brigade routinely evaluates LMR capabilities from various manufacturers through interaction with the LMR Program Manager for the Pacific Area of Operation (AO). The Pacific AO determines the mobile land requirement and for any change for the Pacific. The Pacific AO Representative would have to make the decision to change the operating system and this would be extremely costly to implement with an estimated cost of $8M. Because this is a sole source action, effective competition is not applicable. The J&A will be posted appropriately IAW FAR 6.305.

7. Actions to Increase Competition: Motorola is the only vendor authorized to maintain the existing Korea-LMR P25 IV&D system. Unless another operating system is purchased and implemented for the Pacific further competition cannot be obtained.

8. Market Research: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought was posted to Federal Business Opportunities on 29 February 2016 for nine (9) days and no vendor responded to the sources sought notice.

9. Interested Sources: To date, no other sources have written to express interest in the acquisition.

10. Other Facts: N/A
