Procurement Request Number:

JUSTIFICATION AND APPROVAL

TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304(c)(b).

JUSTIFICATION

1. Agency and Contracting Activity:

Agency:

National Ground Intelligence Center

2055 Boulders Road

Charlottesville, VA 22911

Contracting Activity:

Defense Information Systems Agency

Defense Information Technology Contracting Organization

Scott Field Office, 2300 East Drive, Bldg. 3600, Scott AFB, IL 62225-5406.

2. Nature/Description of Action(s):

This modification of Information Technology Enterprise Solutions 2 Services (ITES-2S ) task order W91QUZ-06-D-0016-KH04 extends the period of performance of Option Year 2 by 3 additional months from March 29, 2012 until June 30th, 2012 with two additional one month options for extension. The contracting effort provides for required database and programming maintenance and improvements to the current System Parametrics Information and Relational Intelligence Tool (SPIRIT) application. A follow-on task order encompassing SPIRIT requirements, entitled Support for Parametric Information Database Administration and Software (SPIDAS), is expected to be awarded by June and the extension will allow for the government to continue operations while the award is being made.

The SPIRIT application is the core National Ground Intelligence Center (NGIC) infrastructure database and analytical tool enabling ground systems analysts to collect, store and disseminate timely scientific and technical (S&T) characteristic and performance (C&P) data of known weapon systems, medical systems and other systems of interest. The NGIC analysts, the Intelligence Community (IC) and allied nations (Australia, Canada and New Zealand) rely upon continued SPIRIT program support to achieve their mission.

The SPIRIT application supports the NGIC and the DoD Analytic Agenda and is a critical resource for Joint Worldwide Intelligence Communication System (JWICS) and SIPRNET consumers of intelligence. The SPIRIT program supports Australia and Canada under existing Foreign Military Sales (FMS) agreements and is positioned to support the quadripartite community in the future. The NGIC is tasked by Department of Defense (DoD) Directive 8260.01 "Data Collection, Development, and Management in Support of Strategic Analysis" and DoD Instruction 8260.2 "Implementation of Data Collection Development, and Management for Strategic Analysis” to meet the intelligence needs of their customers within the NGIC area of all-source analysis.

3. Description of Supplies/Services: This modification will allow for completion of key processes and activities allowing for the implementation of SPIRIT v7.0 while ensuring continued operations and maintenance support on JWICS and SIPRNET. The scope of the current task order remains the same during the extension.

Procurement History: The original ITES-2S task order was competitive and all ITES-2S contractors were solicited. W91QUZ-06-D-0016-KH04 was awarded to SAIC on 22 SEP 2008 and included one base plus two option years. The Task Order life cycle value is $2,911,416.94. Base Period of Performance: 30 SEPT 2008 – 29 SEPT 2009; Option Year One: 30 SEPT 2009 – 29 SEPT 2010; Option Year Two: 30 SEPT 2010 – 29 SEPT 2011. On 29 SEPT 2011 the task order was extended by six months to 29 MAR 2012 IAW FAR 52.217-8. The reason for the initial extension was directed by US Army Intelligence and Security Command (INSCOM) because they reasoned that a new Army Intelligence IDIQ was scheduled to be awarded by December and that would be an appropriate vehicle for a new SPIRIT award to be placed. Since that time, the Army Intelligence IDIQ has been postponed indefinitely.

If the modification to the existing task order was not approved, the Government would be required to operate SPIRIT at risk with no supporting technical experts. This would carry high risk of loss of support for the SPIRIT application until a follow on task order can be established. NGIC anticipates this would occur in June, leaving a 3 month period of non-support. If the incumbent was not selected, NGIC anticipates an additional 3-6 month delay in implementation of SPIRIT v7.0. Additionally, historically, the hiring of staff with requisite skills and TS/SCI clearances takes in excess of 30 days, re-activation of, or obtaining TS/SCI clearances takes from 3-18 months. Any loss or gaps in contractor support would most likely lead to additional slips of 1-3 months in the SPIRIT project milestones if staffing was not held constant. A slip in software increment delivery dates equates to an estimated $200k per month. This cost is well in excess of any costs that could be recovered through the competitive process.

4. Identification of Statutory Authority: 10 U.S.C. 2304c(b)(3), Task and Delivery Order Contracts: Orders – Fair Opportunity Exceptions, the task or delivery order should be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to a task or delivery order already issued on a competitive basis..

5. Demonstration of Contractor’s Unique Qualifications:

a. SAIC is uniquely qualified to provide these services to the National Ground Intelligence Center (NGIC) based upon the following reasons:

1. SAIC personnel provide subject matter expertise on the SPIRIT application that is used by NGIC analysts and allied nations Australia and Canada. This expertise can only be gained through working across the mission, requirements, and system capabilities used to perform the SPIRIT tasks to meet NGIC mission requirements. Additionally, each staff member on the team is highly knowledgeable on the NGIC GMI and S&TI missions and the established collaborative processes with other Intelligence and DoD organizations.

2. The SAIC staff has the breadth of experience across mission, requirements, software, databases, data, analysis and reporting. This breath of knowledge is key to the success of the NGIC SPIRIT Program.

3. SAIC has been assessed as CMMI Level 5. Utilization of these mature, internationally recognized management and engineering processes enables support to the government management and technical team through the use of data and metrics.

4. SAIC provides TS//SCI cleared personnel to meet requirements for all task areas.

b. In accordance with FAR 16.505(b)(2)(i)(C), exceptions to the fair opportunity process, this 5-month extension will be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to a task order already issued under the ITES-2S contract on a competitive basis .

6. FedBizOpps Announcement/Potential Sources: In accordance with FAR 16.505(a)(1), the Contracting Officer does not synopsize orders under indefinite-delivery contracts. Also, since this action is made under the terms of an existing contract that was previously synopsized in sufficient detail, a synopsis is not required in accordance with FAR 5.202(a)(11).

7. Determination of Fair and Reasonable Cost: All rates set forth in the task order were based on full and open competition and a price analysis was accomplished. This is a time and materials (T&M) task order and the contractor’s original rates were included and audited as part of DITCO’s review of the contractor’s proposal. It is estimated that the work performed under this task order provides for fair and reasonable compensation for the contractor and government. The total estimated value for the increased requirement is approximately $413K.

8. Description of Market Research: A competitive request for proposal for this effort was issued to all ITES-2S vendors. SAIC was awarded the current ITES-2S task order on 22 SEP 2008.

Formal market research was completed prior to this award with market research updates conducted prior to awarding the subsequent option year executions in 2009, 2010 and 2011. This included research on IDIQ contract vehicles, vendor capabilities and task order rates. All task order actions are reviewed by NGIC legal and require internal market research to ensure competitive rates. Based on the known capabilities and previous history, the option year 2 market research update did not provide any new information.

9. Any Other Supporting Facts: Not applicable.

10. Listing of Interested Sources: Not applicable. This is a modification to an existing ITES-2S task order, W91QUZ-06-D-0016-KH04.

11. Actions Taken to Remove Barriers to Competition: No action is necessary as all the contractors were given a fair opportunity to be considered for the original order and this is continued level of effort for the existing task order.

12. Reference to the Approved Acquisition Plan (AP)/Program Plan (PP): Not applicable.
