2. Description of Action:

b. The Department of Public Works (DPW) at ERDC-CRREL seeks to procure:

- All necessary Runtal parts to repair/extend the existing baseboard heating in the executive office area of the Lab Addition, 2nd floor. A complete parts listing is included in the contract file.

4. Authority:

Action using Simplified Acquisition Procedures

FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold

(SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization.)

5. Reason for Authority Cited:

Runtal North America manufactures the only products capable of fulfilling the Government’s requirement. Existing Runtal baseboard heating in the executive office area must be repaired and extended with units of the same brand to ensure full compatibility in form, fit, and function.

Market research failed to identify any alternate brands or products offering full compatibility with the longstanding units installed at CRREL. In addition, continued usage of the Runtal brand allows DPW to maintain fewer spare parts on hand. The affected offices are in the process of renovation and require these parts as soon as possible to complete the renovation and allow for occupancy.

6. Actions to Increase Competition:

Although the estimated value of this requirement falls below the public posting thresholds at

FAR 5.101(a)(1) and (2), a combined synopsis/solicitation (with redacted Brand Name

Justification) will be posted to the Federal Business Opportunities (FBO) website to promote competition to the maximum extent practicable.

7. Market Research:

Market research was conducted as prescribed by FAR 10.001(a). The contract specialist and technical point of contact were unable to identify any additional brands capable of fulfilling the

Government’s need. In addition to the Internet sources located by the CRREL technical point of contact, the contracting office retrieved a list of stock distributors from the Runtal website.

Three of the sources listed are registered in SAM.gov.

. The parts to be procured are commercial in nature and available for sale to the general public. See commerciality determination in contract file.
