The brand name justification shall be prepared to reflect this subpart in accordance with 41 U.S.C. 1901 and shall make the brand name justification publicly available with the solicitation. In accordance with FAR 13.501(a)(2)(i), for a proposed contract exceeding $150,000, but not exceeding $700,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.
5. Reason for Authority Cited:
The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. It has been found that the Leica ScanStation P40 3-D scanner is the only 3-D scanner that will fulfill the Government’s requirements based on the following findings:
The 3-D terrestrial scanner is an emerging and specialized technology. The number of brands and models are very small with each option carving out a specific niche for the market. For example, scanners that have greater range will sacrifice accuracy. Scanners with ultra-high accuracy may have limited environmental conditions in which it will perform optimally. It was determined by the researchers that the Leica ScanStation P40 in combination with the Leica Cyclone software package was the one model that best suited the diverse needs of the researchers that expressed a need for this capability. The combination of key features on this model that were not found on competing models include the ability to scan items at a range of 0.5-270 meters with 2-6mm accuracy in the first 100m, an integrated camera and video that can allow for seamless texture mapping, light ranges that allow for scanning in all interior and exterior conditions, active real time dual axis compensation and the ability to operate the equipment remotely and wirelessly. On-site training once equipment has been obtained is also a requirement, and research indicates that this training is included in the purchase of some models.
6. Actions to Increase Competition: The solicitation will be posted on the Federal Business Opportunities website in order to obtain competition between the manufacturer and various dealers of this equipment.
7. Market Research:
Research was performed in November 2015 by Carey Baxter and Andrew Hamblin. Research included online searches of company websites and data sheets, telephone conversations with representatives of 3 of the 4 companies that produce 3-D scanners, meeting with the head of the 3-D imaging laboratory at University of Illinois, Urbana-Champaign to discuss needs and equipment options. This equipment, training and support was found to be available from only one vendor with a GSA contract, therefore, this purchase will not be limited to GSA schedules.
Although there are others dealers found for the equipment, only the manufacturer (Leica Geosystems – a large business) and one dealer (IMAGINiT – a small business) were found to be capable of providing the required training and software support specified in this procurement.
