SUMMARY OF WORK
PART 1 GENERAL
1.1 PROJECT LOCATION AND DESCRIPTION
The Cape Porpoise Harbor Federal Navigation Project (FNP) is located in the town of Kennebunkport, Maine. The existing project was adopted on March 3, 1899, and modified by the Rivers & Harbors Acts of March 2, 1907 and June 30, 1948.
Natural shoaling processes have reduced available depths to as little as
1.0 foot in the 15-foot MLLW channel and anchorage, and 2.0 feet in the 6-foot MLLW channel making navigation hazardous or impossible at lower stages of the tide. Maintenance dredging of approximately 30,000 cubic yards of primarily fine and medium-grain sand, and silt from approximately 12 acres of the authorized project area will maintain the FNP to required and authorized dimensions. A Mechanical dredge and scows will be used to remove the material and then transport it for placement at the Cape Arundel Disposal Site (CADS).
1.2 WORK COVERED BY CONTRACT DOCUMENTS
a. The Contractor shall perform the work in strict accordance with the contract drawings and specifications and provide all supervision, plant, labor, materials, equipment, safety, and quality control necessary to perform all operations as necessary to accomplish the work, complete. The Contractor is responsible for providing and utilizing appropriate plant and equipment to remove and dispose of the dredged material.
b. The general description of the work described below is general in nature and is only given to indicate the approximate scope of work under this contract. It does not limit the work required under the project contract drawings and specifications.

15-Foot Channel, 15-Foot Anchorage, and 6-Foot Channel".
The contract price per cubic yard for Payment Item Number 0002, shall include all costs for removal of materials encountered from dredging the Federal Navigation Project (FNP) to the specified depths, including the 15-Foot Channel, the 15-Foot Anchorage, and the 6-Foot Channel and the transportation to and disposal of the dredged material at the designated disposal site as specified under Section 35 20 23 MECHANICAL DREDGING.
The total amount of material removed and paid for under the contract for this Item, will be measured by the cubic yard in place by computing the volume between the bottom surface shown by soundings of the last pre-dredge survey made before dredging begins and the bottom surface shown by the soundings of a after-dredge survey made as soon as practicable after the removal of the material. Dredged material will be included that is within the limits of the side slopes and specified overdepths as described in Section 35 20 23 MECHANICAL DREDGING, paragraph "Dredging Limits", less any deductions that may be required for misplaced material described in subparagraph "Disposal In Non-Approved Areas".
The contract drawings are believed to accurately represent conditions existing on the date of the survey shown on the drawings, but the depths and the specific areas to be dredged shown thereon may be verified and corrected by soundings taken by the Government before dredging begins. Determination of quantities removed and the deductions made to determine quantities after having once been made by the Contracting Officer, will not be reopened, except on evidence of collusion, fraud, or obvious error. Refer to Special Contract Requirements, subpart "Contract Drawings and Specifications" for additional information and requirements regarding contract drawings.
Monthly partial payments will be based on approximate quantities determined by Contractor quality control surveys. The pre-dredge survey made immediately before dredging, and the after dredge survey made as soon as practicable after the removal of the material, will be performed by the Government at no cost to the Contractor.
Also refer to Section 35 20 23 MECHANICAL DREDGING, Subpart
"DREDGING LIMITS".
Within the contract price per cubic yard for Payment Item Number 0002, the contractor shall include all costs for labor, equipment, and materials for the removal, retrieval, and delivery of 30 derelict moorings within the Federal Navigation Project. Refer to
SECTION 01 22 00 Page 3
Section 35 20 23 MECHANICAL DREDGING, Subpart "FLOATS AND MOORINGS", for what constitutes a derelict mooring and where they are to be delivered. Any derelict moorings encountered beyond the above mentioned quantity carried in the unit price shall be treated as debris.
A Box Cut Credit of payable volume below the Allowable Overdepth limits may be applied to the "Prescribed Box Cut" areas as outlined in Section 35 20 23 MECHANICAL DREDGING, Subpart "Prescribed Box Cut".
Unit of Measure: Cubic Yard (CD).

When contemplating a variation which results in lower cost, consider submission of the variation as a Value Engineering Change Proposal (VECP).
b. Specifically point out variations from contract requirements in transmittal letters. Failure to point out deviations may result in the Government requiring rejection and removal of such work at no additional cost to the Government.
1.9.2 Proposing Variations
a. When proposing variation, deliver written request to the Contracting Officer, with documentation of the nature and features of the variation and why the variation is desirable and beneficial to Government. If lower cost is a benefit, also include an estimate of the cost savings.
In addition to documentation required for variation, include the submittals required for the item. Clearly mark the proposed variation in all documentation.
b. Check the column "variation" of ENG Form 4025 for submittals which include proposed deviations requested by the Contractor. Set forth in writing the reason for any deviations and annotate such deviations on the submittal. The Government reserves the right to rescind inadvertent approval of submittals containing unnoted deviations.
