SECTION 01 11 00
SUMMARY OF WORK
08/15
PART 1 GENERAL
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:
SD-01 Preconstruction Submittals
1.2 WORK COVERED BY CONTRACT DOCUMENTS
1.2.1 Project Description
The work includes replacement and relocation of two (2) 25 kV pad-mounted switching gears inside the installation fenceline, associated medium-voltage distribution, and incidental related work. See contract drawings and notes for details. Match existing phase rotation.
1.2.1.1 Project Details
a. Demolition. The existing pad-mounted switching gear shall be demolished. This includes all incidental parts, connections, cables.
The Government does not desire to salvage this equipment and it shall be removed by the Contractor.
b. Site Preparation. See contract drawings for location of new pad-mounted switch gear. Exact location to be verified with BCE personnel. Clear and grub the site, including various tree removal.
Prepare the site for equipment pad/vault.
c. Excavation. Excavate from the new location to the existing pad/vault for installation of a two (2) by four (4) concrete encased ductbank.
d. Ductbank. Install the concrete encased ductbank as detailed in the contract drawings.
e. Switchgear. Pad mounted switchgear shall be S&C Pad-Mounted Gear, PMH-5 3R2, or equal. Voltage: 25 kV, with SME-20 Fuse Type. Equipment shall be properly grounded.
f. Vault. Install vault under Switchgear location. Vault shall have a false bottom.
g. Electrical Distribution. Provide and install two (2) feeds from the Westfield Gas & Electric (G&E) utility to the new switchgear and then returning to the existing pad/vault. Work includes pertinent splices and connections to electrical cabling and equipment. Coordinate outage with Westfield G&E and BCE personnel
h. Miscellaneous Work.
Prepare and replace manhole covers with lockable manhole covers and label "Electric".
Return disturb areas to grade and loam, seed, and dress areas of excavation.

1.2.2 Designation of Technical Representative
The Contracting Officer will appoint a qualified Contracting Officer's Representative (COR) for the purposes of technically administering the contract; however, all matters concerning this contract or any work ordered placed against this contract must first be approved by the Contracting Officer. This in no way authorizes anyone other than the Contracting Officer to commit the Government to changes in terms of the contract.
1.2.3 Location
The work is located at the 104th Fighter Wing, Barnes Air National Guard (ANG) Base, Westfield, Massachusetts, approximately as indicated. The exact location will be shown by the Contracting Officer.
1.2.4 Work Progress
Every other week meetings will be held with the Contractor, COR and Contracting Officer (KO) to discuss work progress, problems and potential change orders. Prior to beginning work on specific work elements of a project, the contractor shall confer with the COR and agree on a sequence of procedures and means of access to premises and buildings; space for storage of materials and equipment; delivery of materials; and use of approaches, use of corridors, stairways and similar means of passage.
1.3 OCCUPANCY OF PREMISES
Building(s) will be occupied during performance of work under this Contract.
Before work is started, arrange with the Contracting Officer a sequence of procedure, means of access, space for storage of materials and equipment, and use of approaches, corridors, and stairways.
1.4 EXISTING WORK
In addition to FAR 52.236-9 Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:
a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.
1.5 LOCATION OF UNDERGROUND UTILITIES
Obtain digging permits prior to start of excavation, and comply with Installation requirements for locating and marking underground utilities.
Verify existing utility locations indicated on contract drawings, within area of work.
1.5.1 Notification Prior to Excavation
Notify the Contracting Officer at least 72 hours prior to starting excavation work.

1.6 SALVAGE MATERIAL AND EQUIPMENT
Items designated by the Contracting Officer to be salvaged remain the property of the Government. Segregate, itemize, deliver and off-load the salvaged property at the Government designated storage area located within 1 miles of the construction site.
Provide a salvage plan, listing material and equipment to be salvaged, and their storage location. Maintain property control records for material or equipment designated as salvage. Use a system of property control that is approved by the Contracting Officer. Store and protect salvaged materials and equipment until disposition by the Contracting Officer.
1.7 UTILITY SERVICES
The Contracting Officer has determined that Government-operated utilities are adequate and will be furnished to the contractor without charge where existing outlets are available. The contractor is responsible for installing temporary service outlets, as necessary, at its expense in accordance with the clause entitled "Availability and Use of Utility Services" (FAR Clause 52.236-14). The following utilities will be available: electricity and water.
1.8 UNUSUALLY SEVERE WEATHER DELAYS
In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the contractor.
Weather delays will be based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The contractor's progress schedule must reflect consideration of these anticipated adverse weather delays in all weather dependent activities.
Upon acknowledgment of the notice to proceed (NTP) and continuing throughout the contract, the contractor will record on the daily Contractor Quality Control (CQC) report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delays must prevent work on critical activities for 50 percent or more of the contractor's scheduled workday.
The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a bilateral modification.

WORK RESTRICTIONS

PART 1 GENERAL
1.1 SUBMITTALS

1.2 CONTRACTOR ACCESS AND USE OF PREMISES
1.2.1 Activity Regulations
Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. Mark Contractor equipment for identification.
1.2.1.1 Subcontractors and Personnel Contacts
Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.2.1.2 No Smoking Policy
Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.

1.2.2 Working Hours
Regular working hours must consist of an 9 1/2 hour period established by the Contracting Officer, between 7 a.m. and 4:30 p.m., Monday through Friday, , excluding Government holidays.
The following Federal holidays are observed by this installation:

Any of the above holidays falling on a Saturday will be observed the preceding Friday; holidays falling on a Sunday will be observed on the following Monday.
1.2.3 Work Outside Regular Hours
Work outside regular working hours requires Contracting Officer approval.
Make application 15 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work must be lighted in a manner approved by the Contracting Officer.
1.2.4 Occupied Buildings
The Contractor shall be working in an existing building around existing buildings which are occupied. Do not enter the buildings without prior approval of the Contracting Officer.
The existing buildings and their contents must be kept secure at all times. Provide temporary closures as required to maintain security as directed by the Contracting Officer.
Provide dust covers or protective enclosures to protect existing work that remains and Government material located in the area during the construction period.
Relocate movable furniture as required to perform the work, protect the furniture, and replace the furniture in its original location upon completion of the work. Leave attached equipment in place, and protect it against damage, or temporarily disconnect, relocate, protect, and reinstall it at the completion of the work.
The Government will remove and relocate other Government property in the areas of the building scheduled to receive work.

1.2.5 Utility Cutovers and Interruptions
a. Make utility cutovers and interruptions after normal working hours or on Saturdays, Sundays, and Government holidays. Conform to procedures required in paragraph WORK OUTSIDE REGULAR HOURS.
b. Ensure that new utility lines are complete, except for the connection, before interrupting existing service.
c. Interruption to water, sanitary sewer, storm sewer, telephone service, electric service, air conditioning, heating, fire alarm, compressed air, and are considered utility cutovers pursuant to the paragraph
WORK OUTSIDE REGULAR HOURS.
1.2.6 Contractor Office and Storage
Parking of contractor vehicles shall be restricted to the contractor's designed on-site area or the work area. The company name shall be prominently displayed on all construction vehicles parked on the job site.
Security of material storage areas on the job site shall be the responsibility of the contractor. The area shall be kept neat and orderly and free of debris.
1.3 SECURITY REQUIREMENTS
Contract Clause FAR 52.204-2 Security Requirements and Alternate II, "FAC 5252.236-9301, Special Working Conditions and Entry to Work Area," and the following apply:
The contractor shall comply with all security regulations imposed by the base/post commander and/or agency occupying the space where work is to be performed. Any necessary security clearances shall be obtained prior to commencement of work.
It is expected that new security requirements to satisfy contractor personal identification requirements in Homeland Security Presidential Directive (HSPD-12), ''Policy for a Common Identification Standard for Federal Employees and Contractors,'' and Federal Information Processing Standards Publication (FIPS PUB) Number 201, ''Personal Identity Verification (PIV) of Federal Employees and Contractors" are incorporated in the life of this contract. Contractor shall comply with all requirements, at no additional cost to the Government.
The contractor shall ensure that all parts of the facility where work is being performed are adequately protected against vandalism and theft.
Contractors shall follow instructions provided by the Security Forces for access to the 101th Fighter Wing. If a gate pass is not granted to a contractor allowing the delivery of goods, execution of warranty support, or performance of services please contact the contracting officer. Be sure that all of your employees have the proper ID (driver's license, state ID, immigration card, U.S. Passport, etc.). If they do not have the proper ID, they will be turned away.
The Prime Contractor and all of its subcontractors will be required to wear orange or lime colored safety vests while performing work on the installation.

U.S. Government will not be held liable for any delays or breach of contract caused by refusal of the Security Forces to allow entry.
All prospective contractors MUST be U.S. citizens or MUST have established and maintain legal residence in the U.S., and are authorized by the US government to work in the United States (i.e. Green card, worker authorization, etc.). All prospective contractors MUST have at least one form of U.S. government issued photo identification (drivers license, U.S.
passport, U.S. work visa, etc.) for entry to the installation. Security Forces will review any questionable identification documents for determination as to whether or not said identification is authorized for access to the installation.
All prospective contractors/contractor employees, once it has been established that they maintain the appropriate credential as described in one above, are subject to a Criminal History Check.
For the purposes of Contracting services, it is implied that, that any and all parties agree to a Criminal History Background Check once entered into any contract. Any documents that are provided and found fraudulent to include, but not limited to driver's licenses, contracting licenses, etc., will result in an arrest and potential termination for default from the contract. All contractors are subject to search in order to obtain entry onto the installation and while working on the installation. Any refusal to submit to a search of their person or vehicle will be deemed as a violent act of aggression against the installation and will be cause for dismissal from the installation and revocation of future privileges and installation access.
AT Level I Training. This provision/contract text is for contractor employees with an area of performance within a National Guard controlled installation, facility or area. All contractor employees, to include subcontractor employees, requiring access to National Guard installations, facilities and controlled access shall complete AT Level I awareness training. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the Contracting Officer's Representative (COR). 1.4 UNAUTHORIZED PERSONNEL
The contractor shall inform all personnel working under his jurisdiction (including subcontractor and visiting supplier personnel) that access to areas outside of the immediate work area; excluding direct haul and access routes, contracting and Civil Engineering offices, and points of supply and storage; is prohibited. Circulation of said personnel will be limited to official business only. Persons in violation of the above will be apprehended and appropriately disciplined.

PRICE AND PAYMENT PROCEDURES

PART 1 GENERAL
1.1 REFERENCES
The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

1.2 SUBMITTALS

1.3 SCHEDULE OF PRICES
1.3.1 Data Required
Within 15 calendar days of notice of award, prepare and deliver to the Contracting Officer a Schedule of Prices (construction contract) as directed by the Contracting Officer. Provide a detailed breakdown of the contract price, giving quantities for each of the various kinds of work, unit prices, and extended prices. Costs shall be summarized and totals provided for each construction category.
1.3.2 Schedule Instructions
Payments will not be made until the Schedule of Prices has been submitted to and accepted by the Contracting Officer. Identify the cost for site work, and include incidental work to the 5 ft line. Identify costs for the building(s), and include work out to the 5 ft line. Work out to the 5 ft line shall include construction encompassed within a theoretical line 5 ft from the face of exterior walls and shall include attendant construction, such as pad mounted HVAC cooling equipment, cooling towers, and transformers placed beyond the 5 ft line.
1.3.3 Real Property Assets
The Government will provide the Draft DD Form 1354, Transfer and Acceptance of Military Real Property filled in with the appropriate Real Property Unique Identifiers (RPUID) and related construction Category Codes to summarize the designed real property assets that apply to this contract.

The Contractor shall meet with the Contracting Officer and the Real Property Accounting Officer during the Pre Construction Meeting and the Project Closeout Meetings to modify and include any necessary changes to the DD Form 1354. The Contractor shall provide the Interim DD Form 1354 that uses the appropriate division of the RPUIDs/ Category Codes to represent the final constructed facility and include all associated cost.
Coordinate the Contractor's Price and Payment structure with the structure of the RPUIDs/ Category Codes.
Divide detailed asset breakdown into the RPUIDs and related construction Category Codes and populate associated costs which represent all aspects of the work. Where assets diverge into multiple RPUID/ Category Codes, divide the asset and provide the proportion of the assets in each RPUID/ Category Code. Assets and related RPUID/ Category Codes may be modified by the Contracting Officer as necessary during course of the work. Coordinate identification and proportion of these assets with the Government Real Property Accounting Officer.
Cost data accumulated under this section are required in the preparation of DD Form 1354.
1.4 CONTRACT MODIFICATIONS
In conjunction with the Contract Clause DFARS 252.236-7000 Modification Proposals-Price Breakdown, and where actual ownership and operating costs of construction equipment cannot be determined from Contractor accounting records, equipment use rates shall be based upon the applicable provisions of the EP-1110-1-8.
1.5 CONTRACTOR'S INVOICE AND CONTRACT PERFORMANCE STATEMENT
1.5.1 Content of Invoice
Requests for payment will be processed in accordance with the Contract Clause FAR 52.232-27 Prompt Payment for Construction Contracts and FAR 52.232-5 Payments Under Fixed-Price Construction Contracts. The requests for payment shall include the documents listed below.
a. The Contractor's invoice, showing in summary form, the basis for arriving at the amount of the invoice. Form 7300/30 shall include certification by Contractor and Quality Control (QC) Manager.
b. The Contractor's Invoice, showing in detail: the estimated cost, percentage of completion, and value of completed performance for each of the construction categories stated in this contract. Use NAVFAC Form 43300/54 on NAVFAC contracts when a Monthly Estimate for Voucher is required.
c. Updated Project Schedule and reports required by the contract.
d. Contractor Safety Self Evaluation Checklist.
e. Other supporting documents as requested.
f. Updated copy of submittal register.
g. Invoices not completed in accordance with contract requirements will be returned to the Contractor for correction of the deficiencies.

1.5.2 Submission of Invoices
If DFARS Clause 5252.232-7006 is included in the contract, provide the documents listed in paragraph CONTENT OF INVOICE in their entirety as attachments in Wide Area Work Flow (WAWF) for each invoice submitted. The maximum size of each WAWF attachment is two megabytes, but there are no limits on the number of attachments.
Properly prepared invoices, bearing the contract number, shall be submitted in duplicate to the Contracting Office, 104th Fighter Wing, on designated invoice forms provided at the pre-construction meeting PRIOR to uploading in Wide Area Workflow (WAWF) the DFAS paying system. This submission will be for review prior to submitting an electronic invoice through Wide Area Workflow (WAWF). Payment will be made by in accordance with FAR Clause 52.232-5 Fixed-Price Construction Contracts and FAR Clause 52.232-27, Prompt Payment for Construction Contracts. All payments will be made by electronic transfer of funds (EFT).
To meet compliance with DFARS 252.232-7003, Electronic Submission of Payment Requests, you shall submit your request for payment (invoice) through WAWF. For more information on the WAWF system, including how to register, visit https://wawf.eb.mil. Payment will be made by paying office specified in the contract award in accordance with the clauses Payments under Fixed-Price Construction Contracts, FAR 52.232-5, and Prompt Payment for Construction Contracts, FAR 52.232-27.
The Government will make payment through WAWF upon satisfactory completion of work AND receipt of a proper certification for payment. Do not input invoice into WAWF until the pre-approval of invoice is received from the contracting officer. This will lessen the need for rejections in WAWF Payment may be withheld unless all contractual requirements including but not limited to: RECEIPT OF PROPER WEEKLY PAYROLLS IAW DAVIS BACON REQUIREMENTS, Small Business Subcontracting Reports, have been timely received.
All requests for payments through WAWF must include a Subcontractor Payment Register pursuant to FAR Clause 52.232-5 and a contractor's certification that reads as follows:
I hereby certify, to the best of my knowledge and belief that - The amounts requested are only for performance in accordance with the specifications, terms and conditions of the contract; All payments due to subcontractors and suppliers from previous payments received under the contract have been made, and timely payments will be made from the proceeds of the payment covered by this certification, in accordance with subcontract agreements and requirements of Chapter 39 of Title 31, United States Code; this request for progress payments does not include any amounts which the prime contractor intends to withhold or retain from subcontractor or supplier in accordance with the terms and conditions of the subcontract; and this certification is not to be construed as final acceptance of a subcontractor's performance.
The Government will make payment upon satisfactory completion of work AND receipt of a proper certification for payment. Payment may be withheld unless all contractual requirements, including but not limited to: RECEIPT
OF PROPER WEEKLY PAYROLLS IAW CONSTRUCTION WAGE REQUIREMENTS FAR 52.222-6,
have been timely received. Payrolls shall indicate CLIN to which they are applicable.

1.5.3 Partial Payments
The following is provided to assist in the submission of WAWF invoices:
Partial payments are authorized for this contract.
IAW 252.232-7003, all invoices must be submitted via WAWF. It is mandatory that you use this E-Invoicing system to ensure timely payment of your invoice.The web site for this system is https://wawf.eb.mil. There are no charges to use WAWF. All questions relating to system setup and vendor training can be directed to the help desk at Ogden. Their number is 1-866-618-5988.
See the clause at DFARS 252.232-7006 for instruction for completion of the required Fields in WAWF.
The paying office DoDAAC and mailing address can be located on the front of your award. You can easily track your payment information on the DFAS website at http://myinvoice.csd.disa.mil/index.html. Your purchase order/contract number or invoice number will be required to inquire status of your payment.
1.5.4 Final Invoice
a. A final invoice shall be accompanied by the certification required by DFARS 252.247.7023 Transportation of Supplies by Sea, and the Contractor's Final Release. If the Contractor is incorporated, the Final Release shall contain the corporate seal. An officer of the corporation shall sign and the corporate secretary shall certify the Final Release.
b. For final invoices being submitted via WAWF, the original Contractor's Final Release Form and required certification of Transportation of Supplies by Sea must be provided directly to the respective Contracting Officer prior to submission of the final invoice. Once receipt of the original Final Release Form and required certification of Transportation of Supplies by Sea has been confirmed by the Contracting Officer, the Contractor shall then submit final invoice and attach a copy of the Final Release Form and required certification of Transportation of Supplies by Sea in WAWF.
c. Final invoices not accompanied by the Contractor's Final Release and required certification of Transportation of Supplies by Sea will be considered incomplete and will be returned to the Contractor.
1.6 PAYMENTS TO THE CONTRACTOR
Payments will be made on submission of itemized requests by the Contractor which comply with the requirements of this section, and will be subject to reduction for overpayments or increase for underpayments made on previous payments to the Contractor.
1.6.1 Obligation of Government Payments
The obligation of the Government to make payments required under the provisions of this contract will, at the discretion of the Contracting Officer, be subject to reductions and suspensions permitted under the FAR
SECTION 01 20 00.00 20 Page 4 and agency regulations including the following in accordance with FAR 32.503-6 Suspension or Reduction of Payments:
a. Reasonable deductions due to defects in material or workmanship;
b. Claims which the Government may have against the Contractor under or in connection with this contract;
c. Unless otherwise adjusted, repayment to the Government upon demand for overpayments made to the Contractor; and
d. Failure to provide up to date record drawings not current as stated in Contract Clause "FAC 5252.236-9310, Record Drawings."
1.6.2 Payment for Onsite and Offsite Materials
Progress payments may be made to the contractor for materials delivered on the site, for materials stored off construction sites, or materials that are in transit to the construction sites under the following conditions:
a. FAR 52.232-5(b) Payments Under Fixed Price Construction Contracts.
b. Materials delivered on the site but not installed, including completed preparatory work, and off-site materials to be considered for progress payment shall be major high cost, long lead, special order, or specialty items, not susceptible to deterioration or physical damage in storage or in transit to the construction site. Examples of materials acceptable for payment consideration include, but are not limited to, structural steel, non-magnetic steel, non-magnetic aggregate, equipment, machinery, large pipe and fittings,precast/prestressed concrete products, plastic lumber (e.g., fender piles/curbs), and high-voltage electrical cable. Materials not acceptable for payment include consumable materials such as nails, fasteners, conduits, gypsum board, glass, insulation, and wall coverings.
c. Materials to be considered for progress payment prior to installation shall be specifically and separately identified in the Contractor's estimates of work submitted for the Contracting Officer's approval in accordance with Schedule of Prices requirement of this contract.
Requests for progress payment consideration for such items shall be supported by documents establishing their value and that the title requirements of the clause at FAR 52.232-5 Payments Under Fixed-Price Construction Contracts have been met.
d. Materials are adequately insured and protected from theft and exposure.
e. Provide a written consent from the surety company with each payment request for offsite materials.
f. Materials to be considered for progress payments prior to installation shall be stored either in Hawaii, Guam, Puerto Rico, or the Continental United States. Other locations are subject to written approval by the Contracting Officer.

1.1 REFERENCES

1.2 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.3 VIEW LOCATION MAP
Submit, prior to or with the first digital photograph submittals, a sketch or drawing indicating the required photographic locations. Update as required if the locations are moved.
1.4 PROGRESS AND COMPLETION PICTURES
Photographically document site conditions prior to start of construction operations. Provide monthly, and within one month of the completion of work, digital photographs, 1600x1200x24 bit true color minimum resolution in file format showing the sequence and progress of work. Take a minimum of 20 digital photographs each week throughout the entire project from a minimum of ten views from points located by the Contracting Officer.
Submit with the monthly invoice two sets of digital photographs, each set on a separate compact disc (CD) or data versatile disc (DVD), cumulative of all photos to date. Indicate photographs demonstrating environmental procedures. Provide photographs for each month in a separate monthly directory and name each file to indicate its location on the view location sketch. Also provide the view location sketch on the CD or DVD as a digital file. Include a date designator in file names. Cross reference submittals in the appropriate daily report. Photographs provided are for unrestricted use by the Government.

1.5 MINIMUM INSURANCE REQUIREMENTS
Provide the minimum insurance coverage required by FAR 28.307-2 Liability, during the entire period of performance under this contract. Provide other insurance coverage as required by law.
Reference Contract Clause titled, "Insurance -Work on a Government Installation (FAR 52.228-5). Kinds and minimum amounts are as follows:

NOTE: Before commencing work under this contract, the Contractor shall certify to the Contracting Officer, in writing, that the required insurance has been obtained. The policies referenced in the certification (s) shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective
(1) for such period as the laws of the state in which this contract is to be performed prescribe or (2) until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer. The Contractor shall maintain a copy of proofs of required insurance, and shall make copies available to the Contracting Officer upon request. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request.
1.6 FIRST TIER CONTRACTOR REQUIREMENTS FOR ASBESTOS CONTAINING MATERIALS
Accomplish all contract requirements of Section assigned to the directly with a first tier subcontractor.
1.7 SUPERVISION
1.7.1 Contractor Staff and Employees
1.7.1.1 Contact Information
Prior to commencing on-site construction, the contractor shall provide the Contracting Officer with a telephone number and FAX number at which the contractor or his representative may be contacted at any time during regular working hours and an emergency number at which the contractor may be contacted in situations requiring immediate attention.
1.7.1.2 Government Supervision
The Government shall not exercise any supervision or control over the contractor employees performing services under this contract; such employees shall be accountable not to the Government, but solely to the
SECTION 01 30 00 Page 2 contractor, who in turn is responsible to the Government.
1.7.2 Contractor Employees
All work under this contract shall be performed in a skillful and workmanlike manner. The Contracting Officer may, in writing, require the contractor to remove from the job site, any employee the Contracting Officer deems incompetent, careless or otherwise objectionable.
1.7.3 Minimum Communication Requirements
Have at least one qualified superintendent, or competent alternate, capable of reading, writing, and conversing fluently in the English language, on the job-site at all times during the performance of contract work. In addition, if a Quality Control (QC) representative is required on the contract, then that individual must also have fluent English communication skills.
1.7.4 Superintendent Qualifications
The project superintendent must have a minimum of 10 years experience in construction with at least 5 of those years as a superintendent on projects similar in size and complexity. The individual must be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance. The individual must be capable of interpreting a critical path schedule and construction drawings. The qualification requirements for the alternate superintendent are the same as for the project superintendent. The Contracting Officer may request proof of the superintendent's qualifications at any point in the project if the performance of the superintendent is in question.
For routine projects where the superintendent is permitted to also serve as the Quality Control (QC) Manager as established in Section 01 45 00.00 40 QUALITY CONTROL, the superintendent must have qualifications in accordance with that section.
1.7.4.1 Duties
The project superintendent is primarily responsible for managing and coordinating day-to-day production and schedule adherence on the project.
The superintendent is required to attend partnering meetings, and quality control meetings. The superintendent or qualified alternative must be on-site at all times during the performance of this contract until the work is completed and accepted.
1.7.5 Non-Compliance Actions
The Project Superintendent is subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion. Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to such stop orders is acceptable as the subject of claim for extension of time for excess costs or damages by the Contractor.
1.8 PRECONSTRUCTION
After award of the contract but prior to commencement of any work at the site, meet with the Contracting Officer to discuss and develop a mutual
SECTION 01 30 00 Page 3 understanding relative to the administration of the value engineering and safety program, preparation of the schedule of prices or earned value report, shop drawings, and other submittals, scheduling programming, prosecution of the work, and clear expectations of the "Interim DD Form 1354" Submittal. Major subcontractors who will engage in the work must also attend.
1.9 PARTNERING
To most effectively accomplish this contract, the Government requires the formation of a cohesive partnership within the Project Team whose members are from the Government, the Contractor and their Subcontractors. Key personnel from the Supported Command, the End User (who will occupy the facility), the Government Design and Construction team and Subject Matter Experts, the Installation, the Contractor and Subcontractors, and the Designer of Record will be invited to participate in the Partnering process. The Partnership will draw on the strength of each organization in an effort to achieve a project that is without any safety mishaps, conforms to the Contract, and stays within budget and on schedule.
The Contracting Officer will provide Information on the Partnering Process and a list of key and optional personnel who should attend the Partnering meeting.
1.10 CONTRACT ADMINISTRATION
The contracting office of the 104th Fighter Wing is the office having administrative jurisdiction over this contract for all matters. A list of the names and telephone numbers of the Government team comprising the contract administrator, Contracting Officer's Representative (COR), consultant, and point of contact at the project site will be provided at the post-award/pre-construction conference.
All correspondence shall be addressed to the Contracting Officer. A copy of all correspondence shall be furnished to the contracting officer's representative. Enclosures attached to or transmitted with the correspondence shall also be furnished with an original and one copy. Each letter shall make reference to the contract name, contract number, project number, and project title, and shall have only one subject. For tracking purposes, a sequential numbering system should be used for all correspondence
1.10.1 Paperless Contracting
The National Guard is fully committed to the Federal Government's electronic commerce and paperless contracting initiatives. As such, it is anticipated that to the maximum extent possible to include but not limited to correspondence, modification distribution, etc., to include specifications and drawings, will be issued using electronic methods, i.e., electronic mail (e-mail). Contractors shall have and maintain capability to receive documents in this manner.
Additionally, it is anticipated that within the life of this contract, other electronic processes will be enacted. These include, but are not limited to, electronic bidding/offers, change order proposals, and electronic invoicing. When implemented by the Contracting Officer, contractors shall participate fully in any of these new requirements at no additional cost to the Government.

1.10.2 E-Mail Communication
Establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments as text files, pdf files, and other similar formats. Within 10 days after contract award, provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence. The Contracting Officer may also use email to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes or terrorist threats.
Multiple email addresses are not allowed.
It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). Promptly notify the Contracting Officer, in writing, of any changes to this email address
1.10.3 Telephone Communications Security Monitoring
All communications with DOD organizations are subject to communications security (COMSEC) review. Contractor personnel must be aware that telephone communications networks are continually subject to intercept by unfriendly intelligence organizations. The DOD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from, or terminating at, DOD organizations. Therefore, civilian contractor personnel are advised that any time they place a call to, or receive a call from, a DOD organization, they are subject to COMSEC procedures. The contractor shall assume the responsibility for ensuring wide and frequent dissemination of the above information to all employees dealing with DOD information.
1.10.4 Transportation, Handling and Storage
The contractor shall coordinate with suppliers and shippers to ensure that incoming materials are properly identified with the contractor's name, contract number and project title. The contractor shall designate an authorized individual to be available to receive shipment. The Government will not provide storage other than that available at the project site.
Storage of supplies, materials and equipment on the project site shall be accomplished in such a manner so as to prevent mechanical and climatic damage and loss due to vandalism or theft. Equipment temporarily removed in the performance of work and stored on the job site shall be stored and protected in accordance with previous paragraphs, and shall be replaced in a condition compatible with its original state. Security for equipment and material removed from the job site for temporary storage until reuse shall be the responsibility of the contractor.
1.10.5 Reporting Executive Compensation and First-Tier Subcontract Awards

1.11 PERFORMANCE EVALUATION OF CONTRACTOR
As a minimum, the contractor's performance will be evaluated upon final inspection. Any specific requirements for contract quality control and quality assurance by the Government personnel will be defined in the specifications. The contractor will be rated as outstanding, satisfactory or unsatisfactory in the areas of contract quality control, timely performance, effectiveness of management, compliance with labor standards, and compliance with safety standards. The contractor will be notified of any unsatisfactory rating, either in an individual element or in the overall rating, prior to completing the evaluation, and all contractor comments will be made a part of the official record. Performance evaluation reports will be available to all DoD Contracting Officers for their future use.
Past Performance evaluations will be posted via https://www.cpars.gov. It is the responsibility of the contractor to request access to this site.
1.12 CONTRACTOR MANPOWER REPORTING
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract. The contractor is required to completely fill in all required data fields using the following web ad-dress:

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year.

1.2 ACCEPTANCE
Prior to the start of work, prepare and submit to the Contracting Officer for acceptance a construction schedule in the form of a Bar Chart Schedule in accordance with the terms in Contract Clause FAR 52.236-15 Schedules for Construction Contracts, except as modified in this contract.
The acceptance of a Baseline Construction Schedule is a condition precedent to:
a. The Contractor starting work on the demolition or construction stage(s) of the contract.
b. Processing Contractor's invoice(s) for construction activities/items of work.
c. Review of any schedule updates.
Submittal of the Baseline Schedule, and subsequent schedule updates, is understood to be the Contractor's certification that the submitted schedule meets all of the requirements of the Contract Documents, represents the Contractor's plan on how the work will be accomplished, and accurately reflects the work that has been accomplished and how it was sequenced (as-built logic).
1.3 SCHEDULE FORMAT
1.3.1 Bar Chart Schedule
The Bar Chart must, as a minimum, show work activities, submittals, Government review periods, material/equipment delivery, utility outages, on-site construction, inspection, testing, and closeout activities. The Bar Chart must be time scaled and generated using an electronic spreadsheet program.

1.3.2 Schedule Submittals and Procedures
Submit Bar Chart Schedules and updates in hard copy and on electronic media that is acceptable to the Contracting Officer. Submit an electronic back-up of the project schedule in an import format compatible with the Government's scheduling program.
1.4 SCHEDULE MONTHLY UPDATES
Update the Construction Schedule at monthly intervals or when the schedule has been revised. The updated schedule must be kept current, reflecting actual activity progress and plan for completing the remaining work. Submit copies of purchase orders and confirmation of delivery dates as directed by the Contracting Officer.
a. Narrative Report: Provide with schedule updates. Identify and justify;
(1) Progress made in each area of the project
(2) Critical Path
(3) Date/time constraint(s), other than those required by the contract
(4) Changes in the following; added or deleted activities, original and remaining durations for activities that have not started, logic, milestones, planned sequence of operations, and critical path
(5) Status of Contract Completion Date and interim milestones;
(6) Current and anticipated delays (describe cause of delay and corrective actions(s) and mitigation measures to minimize);
(7) Description of current and future schedule problem areas.
Each entry in the narrative report must cite the respective Activity ID and Activity Description, the date and reason for the change, and description of the change.
1.5 3-WEEK LOOK AHEAD SCHEDULE
Prepare and issue a 3-Week Look Ahead schedule to provide a more detailed day-to-day plan of upcoming work identified on the Construction Schedule.
Key the work plans to activity numbers when a NAS is required and update each week to show the planned work for the current and following two-week period.
