Justification and Approval for Other Than Full and
Open Competition
1. Contracting Activity: The responsible contracting activity is the U.S. Army Corps of Engineers, Los Angeles District, Contracting Division, and 915 Wilshire Blvd., Suite 1440, Los Angeles, CA 90017.
2. Description of Action: This action is for a new firm-fixed price construction contract which includes a “brand name only” component. The contract will be awarded using Army - Minor Military Construction funding.
3. Description of Supplies/Services: The contract action is for the construction of an 8,000 SF General Purpose Administration Facility at Fort Irwin, CA. The facility will include command group and staff administrative space, latrines, conference areas, a brigade ops center (BOC), and open space to provide the flexible and adaptable space for regimental staff. The contract includes a requirement for a Monaco Fire Alarm Transmitter. The estimated value of the brand name component is $ ; the estimate for the competitive construction contract is $ .
The Government requires this specific brand name system in order to remotely monitor and communicate effectively with the reporting systems currently in use at Fort Irwin and determine the facility and location when a fire alarm is tripped. Fort Irwin uses Monaco Fire Alarm Transmitters and has incorporated them into its design standards.
Additionally, the Monaco Fire Alarm Transmitter brand is used by the following services to meet their life-safety requirements for fire protection: US Coast Guard, Air National Guard, US Army, US Navy, US Marine Corps and US Air Force.
4. Authority Cited: Other than Full and Open Competition is authorized pursuant to 10 U. S. C. 2304(c)(1) as implemented by Federal Acquisition Regulations, (FAR) subparts 6.302-1(c) and 11.105 when only one responsible source and no other supplies or services will satisfy the agency’s requirement.
5. Reason for Authority Cited: The purpose of this J&A is to obtain approval for procurement of non-competitive/specific equipment subject to the FAR. Fort Irwin has established an intelligent network of addressable fire alarm systems using the Monaco brand and established Monaco as the base standard for its fire alarm systems. The individual building(s) fire alarm reporting and control systems consist of many interconnected components and systems within the facility. The components include:
smoke detectors; pull stations; central panels; remote panels; smoke detectors in air ducts; HVAC system isolation dampers; water vale controllers; battery backup; and, the central transmitter that reports problems to the fire station(s).
Using other manufacturer’s products would create an assemblage of parts within the network that have not been tested to determine satisfactory performance and fit, and increase cost in additional man-hours and modifying existing units. Future software or firmware upgrades may reduce or eliminate any current compatibility, incurring additional cost to replace the incompatible equipment. Using another manufacturer’s products would also see duplication costs from additional training for operators and maintainers, and a new spare parts inventory. Finally, competition for the fire alarm system is not reduced by the Monaco brand requirement as Monaco equipment is available from multiple suppliers/distributors within the continental United States.
6. Efforts to Obtain Competition: Publication in FedBizOps of a notice of intent to use a brand name specification is not required. Reference FAR subpart 5.202(a)(13) which states, “The proposed contract action –
(i) Is for an amount not expected to exceed the simplified acquisition threshold;
(ii) Will be made through a means that provides access to the notice of proposed contract action thorough the GPE; and
(iii) Permits the public to respond to the solicitation electronically”
Furthermore, as required by FAR subpart 6.302-1(c)(1)(ii)(C) the justification shall be posted with the solicitation and FAR subpart 5.102(a)(6) When an acquisition contains brand name specification, the contracting officer shall include with the solicitation the justification or documentation required by 6.302-1(c), redacted as necessary.
7. Actions to Increase Competition. Research has found multiple distributors for Monaco fire alarm transmitters and competition is expected between distributors within the continental United States.
8. Market Research: An internet search indicated that there are multiple distributors of the Monaco fire alarm transmitters. See paragraphs 5 and 7 above.
9. Interested Sources: Any sources that indicate an interest as a result of this solicitation will be evaluated. If the interested parties demonstrate that their product can meet the performance criteria specified in the solicitation their product will be included in the design/technical specification.
To date, no other sources have written to express an interest.
10. Other Facts:
a. Fort Irwin uses Monaco brand name fire alarm transmitters in its facilities; it has an inventory of service and repair parts to help reduce long term maintenance costs vs. installation of generic brands.
b. The Monaco brand is used by the following services to meet their life-safety requirements for fire protection: US Coast Guard, Air National Guard, US Army, US Navy, US Marine Corps and US Air Force.

13. Fair and Reasonable Cost Determination:
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Award of the contract will be through the competitive seal bidding process. Competition is expected between distributors within the continental United States. No Government discount is anticipated. Certified cost or pricing data will not be required as it is anticipated that the prices agreed upon will be fair and reasonable based on adequate price competition reference FAR 15.403-1(b)(1).
In accordance with FAR subpart 15.404-1(a) and (b), when certified cost or pricing data are not required, price analysis will be used to ensure that the final agreed to price is fair and reasonable. The estimated value of the brand name component is $ .
The threshold for obtaining certified cost or pricing data is $2,000,000.00.
