SUMMARY OF CHANGES
SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
SECTION L
A. PROPOSAL SUBMISSION GENERAL GUIDELINES
1. Offerors should be registered in the System for Award Management (http://www.sam.gov) upon submission of proposal. The System for Award Management (SAM) is a Federal Government owned and operated free web site that consolidates the capabilities in the Central Contractor Registration (CCR) FedReg, ORCA, and EPLS.
2. Joint Ventures or A.T.I. (Associazione Temporanea d'Imprese, Temporary Association of Firms) are not allowed.
B. GENERAL INSTRUCTIONS
1. Offerors shall strictly adhere to the requirements in this Section when preparing the proposal to be submitted in response to this Request for Proposal (RFP). All proposals shall be in English. The Government will not reimburse any Offeror any cost incurred in response to this RFP. Proposals that fail to comply with the proposal submittal requirements addressed in this section of the solicitation may be determined unacceptable. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein.
2. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) at or before the exact date and time specified. There will be no public opening of the proposals received as a result of this RFP. Failure to meet a requirement may result in a proposal being ineligible for award.
3. All RFP documents will be posted to the Federal Business Opportunities (FedBizOpps) website (https://www.fbo.gov) and made available for viewing. All amendments will be posted to FedBizOpps and made available for viewing. It shall be the Offeror’s responsibility to check the website for any amendments and updates to the solicitation.
4. The Government will award one contract for all line items to the responsible offeror whose proposal represents the best value to the Government. Awards will be based on the best value – utilizing the Lowest Price Technically Acceptable approach. This process permits no tradeoffs among cost or price and non-cost factors. Award will be made to the offeror whose offer is evaluated as “acceptable” for all technical factors and whose proposal has the lowest price.
5. Proposals received by the Government after the date and time set for receipt of proposals will be handled in accordance with FAR 15.208.
C. PROPOSAL SUBMISSION INSTRUCTIONS:
1. Proposals may be submitted by firms formally organized as design-build entities, or by construction contractors and designers/design firms that have associated specifically for this contract. For the purpose of this solicitation, no distinction is made between formally organized design-build entities and contract-specific design-build associations.
Both are referred to as the design-build offeror (or simply “Offeror”), or the design/build contractor, (or simply, “Contractor”), after award of the contract.
2. General Requirements: The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the requirements. Offerors shall assume that the Government has no prior knowledge of their facilities or experience, and will base its evaluation only on the information presented in the Offeror’s proposal.
3. Offeror(s) shall provide proposals in English in accordance with the instructions below.
4. Proposals shall consist of two (2) electronic copies (documents PDF format) with the bid guarantee provided as an original. The electronic copy (PDF format on a CD or DVD) will be delivered to the following address: 414th CSB, Regional Contracting Officer (RCO), Caserma Ederle, Building 3, Room 104, Viale della Pace 193, 36100 Vicenza, Attn.: Ms. Elisa Marchetti, telephone 0444 617412 or Ms. Dee Cavanaugh, telephone 0444 617448, in an envelope clearly marked with the solicitation number. Government personnel may not be available to pick up proposals at the gate. It is the contractor's responsibility to ensure delivery to the location specified.
5. BID GUARANTEE: Offerors will provide a bid guarantee in the amount and format as required under this section of the solicitation (Euro 25,000.00). The offeror shall furnish a bid guarantee in the form of a firm commitment supported by a registered bank or by a primary credit union company recognized by a bank ("istituto bancario, azienda di credito autorizzata o assicurazione autorizzata a norma di legge"), using the format provided as enclosure # 3. The Contracting Officer will return bid guarantees, other than proposal bonds:
a. To unsuccessful offerors as soon as practicable after the award of the contract; and
b. To the successful offeror upon execution of all contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the proposal as accepted.
Failure to submit a valid Bid Guarantee will result in an incomplete proposal which will not be evaluated.
6. The submittals shall be formatted as follows, each tab confined under a Volume:
Volume Factor / Documents
1 Factor I: TECHNICAL -
Subfactor 1: Technical Specifications
Subfactor 2: Manufacturer Authorization for Installation

c. Each offeror shall acknowledge all Amendments by signing and returning them with the proposal.
SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
SECTION M
A. BASIS OF AWARD / EVALUATION
1. The Government plans to award one contract to the responsible offeror whose proposal represents the best value to the Government. Awards will be based on the best value – Lowest Price Technically Acceptable approach. This process permits no tradeoffs among cost or price and non-cost factors. Award will be made to the offeror whose proposal meets all “acceptable” technical factors and whose proposal has the lowest price.
2. Numerical scores and other point-scoring techniques will not be used in the evaluation process. Each factor will receive an acceptable or unacceptable rating. The Government will evaluate proposal in accordance with the evaluation factors described in this section.
3. The Government reserves the right to discuss aspects of proposals with Offerors in the competitive range. Offerors are advised that the Government may make award without discussions, clarifications, or any contact concerning the proposals received. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.
4. Proposals received by the Government after the date and time set for receipt of proposals will be handled in accordance with FAR 15.208.
B. EVALUATION FACTORS AND RATINGS
1. Proposals will be evaluated using the evaluation factors listed below:
FACTOR I – TECHNICAL
Subfactor 1 – Technical Specifications Subfactor 2 – Manufacturer Authorization for Installation Subfactor 3 – Monitor and Decoder Technical Information Subfactor 4 – SOA Certification
FACTOR II – Past Performance
FACTOR III – Price
All evaluation factors other than cost or price, when combined, are approximately equal to cost or price.
2. FACTOR I: TECHNICAL
a. Subfactor 1: Technical Specifications. The Government will evaluate this subfactor utilizing the technical specifications and the documentation provided with the solicitation to ensure that it includes:
(2) The name of the manufacturer of the barriers that will be installed (it shall be one of the manufacturers and models listed in the attachment to the Statement of Work entitled “DoD Anti-Ram Vehicle Barrier List” dated July 2018);
(2) Model number of the barriers that will be installed;
(3) Technical specifications of the barriers that will be installed.
b. Subfactor 2: Manufacturer Authorization for Installation. The Government will evaluate this subfactor to ensure that the Offeror has the required certification/documentation that demonstrates that the offeror or the proposed subcontractor has the manufacturer authorization to install the barriers proposed.
c. Subfactor 3: Monitor and Decoder Technical Information. The Government will evaluate this subfactor to determine if the offeror will provide the brand name or equal requested with Amendment 0001.
d. Subfactor 4: SOA Certification. The Government will evaluate this subfactor by ensuring the SOA provided is current (as of the date of this solicitation) for OG1 classification III or higher.
EVALUATION. Factor I: Technical. All offerors will receive one of the following Adjectival Ratings for each subfactor for Factor I.
Adjectival Rating Description
Acceptable Proposal meets the requirements of the solicitation
Unacceptable Proposal does not meet the requirements of the solicitation
When evaluating subfactor 1, the government evaluation team will review the barriers technical specifications submitted to ensure they meet all the requirements described in the SOW, in particular Part 3, paragraph E10. In order to be determined acceptable in this subfactor, the barrier brand and model must be on the “DOD ANTI-RAM VEHICLE BARRIER LIST” dated July 2018 which is attached to the Statement of work. It must also meet the the requirements of Part 3, paragraph E10 of the SOW.
When evaluating subfactor 2, the government evaluation team will review the documentation submitted to ensure the offeror or the proposed subcontractor has the manufacturer’s authorization to install the barriers proposed. In order to be determined acceptable for this subfactor, the offeror or proposed subcontractor must have written authorization from the manufacturer to install their barriers.
When evaluating subfactor 3, the government evaluation team will review the make and model of the monitor and decoder provided in the offeror’s proposal. In order to be determined acceptable for this subfactor, the offeror’s proposed make and model for the monitor and decoder shall be the exact make and model as the products in the enclosed brochures (Enclosure 1 and 2 to this Amendment) or shall meet or exceed the technical standards provided in these Enclosures.
When evaluating subfactor 4, the government evaluation team will review the offeror’s SOA category and classification to verify that the OG1 is current and classification III. In order to be determined acceptable in this subfactor, the SOA provided by the offeror must be category OG1 classification III or higher.
Subfactors 1, 2, 3 and 4 will combine for an overall rating for Factor I. If one or more of the subfactors are rated as unacceptable, the overall rating for Factor I will be unacceptable.
3. FACTOR II: PAST PERFORMANCE. The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance provided in the offeror’s Past Performance Questionnaires outlined in Section L.
a. The Government will evaluate each offeror’s past performance to determine how well it conforms to specifications and standards of good workmanship, adheres to contract schedules including administrative aspects of the performance, exhibits reasonable and cooperative behavior and a commitment to customer satisfaction and has a businesslike concern for the interests of the customer.
b. Recent past performance is defined as projects which have been completed within five (5) years from the date of this solicitation. Relevent past performance is defined as projects performed under a SOA of OG1 and for an amount of € 300,000 or greater.
c. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown (or neutral) past performance (see FAR 15.305 (a)(2)(iv)).
d. Evaluators may consider any data in the above in determining the performance rating in conjunction with the completed surveys provided by past customers. Government evaluators may contact your points of contact/references for the projects submitted to verify an Offeror’s past performance on these projects. In addition, the Government may use personal knowledge or information from other sources, such as agency performance databases and Government construction administration personnel, in its evaluation of an Offeror’s past performance.
The Government may use data provided by the Offeror and data obtained from other sources. While the Government may elect to consider data obtained from other sources, the burden of providing thorough and complete past performance information rests with the Offeror.
e. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.
f. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
EVALUATION. Factor II: Past Performance. All offerors will receive one of the following Adjectival Ratings for Factor II:
Adjectival Rating Description
Acceptable
Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort or the offeror's performance record is unknown. (See note below)
Unacceptable
Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
To receive an “ACCEPTABLE” rating for Factor II, the Government has must have a reasonable expectation that the offeror will successfully perform the required effort or the offeror's performance record is unknown. Offerors with unknown past performance will receive a neutral evaluation, resulting in an “ACCEPTABLE” rating.
4. FACTOR III – PRICE. Only offerors whose proposals are evaluated to be technically acceptable on all factors will be evaluated for price. The lowest price technically acceptable offer will be awarded the contract for this solicitation. Only a responsible offer in accordance with FAR 9.1 will be eligible for award.
a. The price proposal will be evaluated separately from the non-price factors. An assessment of the reasonableness of each proposed price will be made. In the evaluation of the price, various techniques and procedures may be used to ensure a fair and reasonable price. However, if the Contracting Officer determines that information on competitive proposed prices or previous contract prices is not available or is insufficient to determine that the price is fair and reasonable, the Contracting Officer may use technique as appropriate to the circumstances applicable to this acquisition.
b. Evaluation of pricing will be completed in accordance with FAR 52.217-5, Evaluation of Options, “the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.” Price evaluation will be conducted by calculating the total price of CLINs 0001, 0002 and 7500.
Evaluation of option CLIN 0002 will not obligate the Government to exercise the option. The award will be made on an all-or-none basis.
c. Unrealistic, unbalanced, or unreasonable pricing may cause a proposal to be determined unacceptable.
Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.
(End of Summary of Changes)
The following items are applicable to this modification:
