SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET
QUESTION AND ANSWER:
Ansbach ACS Admin
Questions for Solicitation W912PB-16-T-3223
1. Reference PWS paragraph 1.6.1 - What are the start and end dates of the 30 day Phase in/Phase Out Period? The PWS states it is 30 days prior to contract award however with a contract start date of 26 Sep, Phase In would have to start on 27 Aug which is in the past.
1A: 1A The 30-day phase in/out period has been deleted from the PWS as written in v.3.3.
2. Reference PWS paragraph 1.6.12.1 - Can personnel perform work prior to the completion of the local background check and NACI?
2A. Yes. Personnel performing services under this contract are to initiate appropriate background ch ecks, as discussed next, within 5 days of first performing services under this contract. The completion of a correctly submitted request for background check is out of the control of ACS and the Contractor; therefore, employees of the Contractor may perform services prior to the results of the check coming back. In the event of a negative adjudication with respect to an employee of the Contractor, the Contractor would need to provide a qualified employee in order to successfully service the contract requirements.
3. Reference PWS paragraph 1.6.12.1 - What is the time frame in which a subsequent employee performing work on the contract is required to complete the local background check and NACI?
If the replacement employee starts in Option Year 1, it won't be possible to "initiate within 5 days post-award."
3A. The solicitation, PWS paragraph 1.6.12.1, has been amended to add the following language:
“In the case of an employee of the Contractor who is retained after the initial award of the contract, such employee must initiate the applicable background check within 5 days of first performing services under the contract.”
4. Reference PWS paragraph 1.6.12.1.1 - What is the time frame in which a subsequent employee performing work on the contract is required to complete AT Level I awareness training? If the replacement employee starts in Option Year 1, it won't be possible to complete "within 30 calendar days after the contract-start date."
4A. The solicitation, PWS paragraph 1.6.12.1.1, has been amended to add the following language:
“In the case of an employee of the Contractor who is retained after the initial award of the contract, such employee must complete the applicable training within 30 days of first performing services under the contract.”
5. Reference PWS paragraph 5.3 - What is the time frame in which a subsequent employee performing work on the contract is required to complete DOD Cyber Security Awareness Training? If the replacement employee starts in Option Year 1, it won't be possible to compete "within 30 days of the start of the contract."
5A. The solicitation, PWS paragraph 5.3, has been amended to add the following language:
“in the case of an employee of the Contractor who is retained subsequent to the start of the Contract, within 30 days of first performing services under this Contract.”
6. Reference PWS Technical Exhibit 3 - The estimated workload is 2,000 hours. Does this mean the person performing work can't take any sick leave or personal time?
6A. Sick Leave, Vacation, and personnel are the internal policies of the Contractor. The Requiring Agency, Army Community Service, can not grant leave, sick time or any personal time.
A successful Contractor will initiate a Staffing Plan to ensure that sufficient employees are available to provide coverage during scheduled and unscheduled absences. In the event the Contractor can not provide qualified personnel due to unanticipated absences, the contractor should bill at the unit of issue, with the quantity being the proportion of full hours worked divided by the total number of hours required during the month. The solicitation, PWS paragraph 1.6.8, has been amended to add the following language: “Contractor shall invoice only for services actually provided; therefore, invoices for periods in which less than full service was provided shall be prorated, by applying a fraction to the Quantity invoiced. The numerator of the fraction will be the number of whole hours of service actually provided, and the denominator shall be the number of whole hours for the period required under section 1.6.5 of this Performance Work Statement. “
7. Reference SF 1449 Continuation Sheet - The CLINs are FFP, what will we be allowed to invoice for the month if our employee becomes ill one hour after starting work at 0800, leaves at 0900, and doesn't return for the rest of the day?
7A: As with 6A, sick leave policies are internal to the Contractor. The Contractor’s Staffing Plan should provide for scheduled and unscheduled absences of the normally assigned employee. In this case, where coverage can not be reasonably provided, Contractor will pro-rate the amount invoiced for the month in question.
8. Reference SF 1449 Continuation Sheet - The CLINs are FFP, what will we be allowed to invoice for the month if our employee becomes ill and is out sick for two days?
8A: As with 6A, PWS has been modified to specify proration of Quantity as needed.
9. Reference SF 1449 Continuation Sheet - If we are required to invoice for only hours worked when our employee is out for sick leave or personal time, what do we use for an hourly rate given the "Unit" of Measure is "Months?"
9A. It is anticipated that the service provided will be invoiced properly for the full amount determined for the unit of measure, the Month. Where an adjustment must be made, adjust the quantity invoiced, 1, by applying a fraction, with the numerator being the actual hours worked, and the denominator being the total number of hours for the period in question. Ref PWS 1.6.8 as amended.
10. Are we required to submit employee time reports for the month with the invoice for that month?
10A: Yes. An employee time report will be uploaded with IRAPT invoices, in order to properly reflect the portion of the unit of issue (month) worked.
11. Will the government consider making this a Time & Materials (T&M) contract? If we are required to deduct hours from our invoice our employee wasn't able to provide support do to sick leave or personal time. It would seem to be more of a T&M contract than FFP.
11A: The requirements of this solicitation are full time performance with no interruption or reduction, so this contract will be awarded as FFP. Invoices may be submitted pro rata, where services provided have been reduced.
12. Will our primary employee be required to obtain a CAC? If so will they be allowed to provide support prior to receiving a CAC? It can take several weeks to obtain a CAC.
12A: Employees of the contractor who regularly provide service will have the capability to provide service before the Common Access Card is received; however, key functions of the requirement require a Common Access Card, and Army Community Service will provide all necessary sponsorship and administrative support in getting each person performing services under this contract a valid Common Access Card.
13. Are we allowed to provide a substitute employee while our primary employee on the contract is out for sick leave or personal time?
13A: Substitute employees are authorized, provided the basic qualifications of the PWS are met.
14. If we allowed to provide a substitute employee, will our substitute employee be required to obtain a CAC? If so will they be allowed to provide support prior to receiving a CAC? It can take several weeks to obtain a CAC.
14A: Substitute employees identified in the Contractor’s Staffing Plan will have the capability to provide service for limited periods, without a CAC card. Dedicated substitute employees of the Contractor who will provide services for longer than a single day will be provided the needed support to obtain a CAC card.
15. Is this a new or existing requirement? If it is an existing contract, who is the incumbent contractor currently performing the work and what is the annual contract amount or total contract amount?
15A: This solicitation reflects expanded requirements above any prior contract, and there is no contract in force for this requirement.
