Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.60 for calendar year 2019 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.60 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2019. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

END OF GENERAL DECISION"

W912P819B0046 SELA 72.1 Algiers Urban Flood Control Solicitation Questions & Answers

1) Do all trees that are indicated to be removed have to be removed by a licensed Arborist?

Answer: Horticulture Notes on Dwg. G5 require all tree removals to be performed by a Louisiana Licensed Arborist approved by the Dept. of Parks and Parkways.

2) Please provide COE estimated quantities.

Answer: Clause 52.236-4(e) in the Specifications indicates who to contact to obtain quantities for “JOB” items.

3) Is a drawing for the existing creosote bulkhead to be removed available? If so, please include it with the first Amendment.

Answer: There is no drawing available.

4) Does the creosote bulkhead need to be removed completely or just cut at the excavation elevation of the new canal?

Answer: The creosote bulkheads should not be removed but rather that they be cut at the required excavation line, except in areas where they would be located at final grade. Bulkheads should be cut 1 foot below grade if they will be located at final grade.

5) Can the COE include the cost for Entergy Transmission and Distribution Lines outages as an allowance in the bid? This was successfully implemented on many of the other projects that we performed over the last 10 years.

Answer: The Contractor shall coordinate with Entergy to determine the unit costs.

6) Can the deadline to submit questions be extended to August 26 so we can properly evaluate the bid package?

Answer: Amendment will include an extension to Friday, August 30th @ 4pm CST. No questions will be accepted after this deadline. Bid Opening will remain September 12, 2019.

7) In Section 01 00 00 – General Requirements “Wage Determination “, General Decision Number LA20190005 is applicable to this solicitation. On page 80 of this section, SULA2004-007 wage rates are used for most of the crafts that will be working on the project. These rates seem to be too low. Are these the correct wage rates for Orleans Parish for this type of construction?

Answer: Wage rate provided does apply but was updated on 8/2/19, it is as follows:

General Decision Number: LA20190005 08/02/2019 https://beta.sam.gov/wage-determination/LA20190005/2/document

SULA2004-007 05/13/2004 - SU indicates the rates are survey rates (as opposed to union agreement) based on a weighted average calculation of rates and are not majority rates. Note - Survey wage rates are not updated and remain in effect until a new survey is conducted. There has been no survey conducted since 2004 and these wage rates are still in effect.

8) Specification 33 34 00, 3.2.4 Drainage Structures references the S&WB Drawings for manhole and catch basin construction. These drawings show brick manholes but contain reference to precast manholes.

https://beta.sam.gov/wage-determination/LA20190005/2/document https://beta.sam.gov/wage-determination/LA20190005/2/document

Will precast concrete manholes and catch basins be acceptable on this project?

Answer: Precast concrete manholes in accordance with New Orleans Sewerage and Water Board standards will be acceptable with required submittal request.

9) Drawings C-5 to C-10 show a relocated UG/TR line and drawings V-5 to V22 show a new 4” TR Fiber Optic Line in the cross sections. The utility disposition drawings and utility disposition table on CU418 call for the contractor to relocate Traffic Manholes prior to construction, but this new fiber line does not show up on the utility dispositions drawings. The table on CU413 calls for AT&T to relocate some fiber optic lines crossing the canal prior to construction but does not mention the relocation of the underground line.

Can the scope that the contractor is responsible for be clarified with respect to the fiber optic conduit, cable, and traffic manholes? If the contractor is required to install or relocate fiber optic conduit, cable or manholes, provide additional details and specifications for this installation (material type, fiber type/quantity, connectors, termination details, etc.)

Answer: The fiber optic conduit, cable, and traffic manholes will be relocated by others.

10) Drawing G15 notes that an existing 16” Sewer Force Main crossing is to be relocated. Specification 02 41 00, 3.2.3 calls for portions of the existing 16” Sewer Force Main to be removed. However, drawing C6 notes that the 16” Sewer Force Main is to remain.

Confirm the scope of work required for the 16” Sewer Force Main. If new materials are to be provided, provide a specification and detailed requirements to install a Sewer Force Main.

Answer: Drawing C6 is correct; the existing 16” Sewer Force Main is to remain. It is located underground. An amendment will address this.

11) Section 01 53 00.02 12, Paragraph 1.6.3.5 states that vibratory hammers are not permitted for work platform support piles.

Will all temporary work platform piles be required to be cut off below the permanent cast-in-place flume?

Being that this feature of work is to be designed by the contractor and the temporary retaining structure sheet piling is permitted to utilize vibratory hammers for installation and removal, will vibratory hammers be allowed for work platform piles if the contractor’s design permits and includes a plan for void fill upon removal?

Answer: Vibratory hammers will not be permitted for the work platform support piles. The work platform piles shall be cut off below the permanent cast-in-place flume.

12) Section 01 53 00.02 12, Paragraph 3.1.5 states that bentonite slurry shall be used for void backfill.

Will controlled low strength material (excavatable flowable fill) be permitted for void backfill applications?

Answer: Bentonite slurry shall be used for void backfill.

13) Will the Government provide detailed quantity takeoffs for all unit price bid items?

Answer: No.

14) After speaking with our bonding company, they have informed us that they will not be able to bond this project due to the 6 year life of the contract. They assured us that it was not because we could not bond the project dollar amount but because of their underwriters would not allow them to wright a bond for more than 3 years for a small business. We have contacted other bonding agencies with the same question. I have attached their responses to this email for your review. After your review of the information provided from the previous email, being that this project is a small business set a side, would the government consider restructuring this project to tailor more to a small business bonding capabilities?

Answer: In accordance with FAR 28.102-2, bonds must equal (i) 100 percent of the original contract price; and (ii) If the contract price increases, an additional amount equal to 100 percent of the increase.

Original contract price does not include the price of any options, except those options exercised at the time of contract award. The information provided does not exclude small businesses but notes preferences of surety companies. There is reasonable expectation of obtaining offers from two or more responsible small business concerns that are competitive in terms of market prices, quality, and delivery which requires this to be set-aside for small business concerns. If the contracting officer receives no acceptable offers from responsible small business concerns, the set-aside shall be withdrawn and the requirement, if still valid, shall be re-solicited on an unrestricted basis.
