SUMMARY OF CHANGES
SECTION 00700 - CONTRACT CLAUSES
The following have been modified:
52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $10,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor -
(1) Any order for a single item in excess of $28,000,000.00;
(2) Any order for a combination of items in excess of $28,000.000.00; or
(3) A series of orders from the same ordering office within twelve (12) months that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within ten (10) days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
(End of clause)
52.216-22 INDEFINITE QUANTITY. (OCT 1995)
a. This is an indefinite quantity contract for miscellaneous construction and repairs, and effective for a one-year period from the date of award. The quantities of supplies and services specified in the schedule are estimates only and are not purchased by this contract.
b. Delivery or performance shall be made only as authorized by Task Orders issued in accordance with the Section 00700 Contract Clause entitled “ORDERING” (FAR 52.216-18). The Contractor shall furnish to the Government, when and if ordered, work for the items specified.
c. Except for any limitations on quantities in the Section 00700 Contract Clause entitled "ORDER LIMITATIONS" (FAR 52.216-19), there is no limit on the number of Task Orders that may be issued. The Government may issue Task Orders requiring delivery to multiple locations.
W912P817B0041
d. Any Task Order issued during the effective contract period and not completed within that effective contract period shall be completed by the Contractor within the time specified in the Task Order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that Task Order to the same extent as if the Task Order were completed during the contract's effective period.
e. The Contractor shall provide written telecommunication notice (e-mail or facsimile) to the Contracting Officer's Representative of the need to place any quantity for an item of a Task Order above the estimated quantity included for that item in the Task Order. The notice shall be provided at least five (5) calendar days prior to the anticipated need for the additional quantity. The Contractor will be responsible for any impact on the completion of the work resulting from an untimely notice. Upon approval by the Contracting Officer for any additional quantity of an item, the time specified in the Task Order shall be modified accordingly.
(End of clause)
SECTION SF 30 - SF 30 CONTINUATION
The following have been added by full text:
AMD 0003
Question 1: I see the contract will be for 1 year but I do not see where time will be calculated for the individual task orders that will be issued. Is it the intent to just have all task orders completed in 1 years time?
Answer 1: See Blocks 10 & 11 of the SF 1442; 52.216-22 & DFARS 252.216-7006. The SF1442, block 10 states, “Each task order will have an individual period of performance which could, potentially, extend beyond the contract ordering period duration listed in DFARS 252.216-7006. DFARS 252.216-7006, Ordering, the ordering period will be established upon any resultant award from this solicitation. The duration of the base contract will be for 365 days, at which any time a task order can be awarded.
Question 2: Would you please consider pushing the bid date back 1 week so we can do a better site inspection?
The weather this week has been terrible down there and we can’t get out to the head of the jetties. Also please clarify where the anticipated jetty stone will be placed on the East side. I ask this because I went out and from the Pilot station approx., mile 18 to approx., mile 19.5 there is only about 3 to 4 feet of water next to the jetty. This will not allow us to get in with a placement rig and definitely not a material barge. Flotation excavation is also not economical due to the sandy material and the constant wave action we cant keep a flotation channel open. Can you supply surveys that show the areas next to the jetties?
Answer 2: Placement areas will be determined after contract award. Attached are the requested surveys. The surveys are also available on the internet at http://www.mvn.usace.army.mil/Missions/Navigation/Channel- Surveys/.

*** High frequency (200 kHz) survey data represents the first signal return at a sounding location and will include suspended solids, known as "fluff", if present. Low frequency (24 kHz) survey data normally penetrates through this "fluff" layer to depict elevations of consoldiated bottom material. Low frequency accuracies may vary depending on channel conditions and fathometer settings.
