- IMPORTANT BID NOTES
1. BID CONDITIONS:
(5) With respect to Amendment No. 0001, as relating to CLINs 0018AB and 00018AE, quantity adjustments will be subject to the FAR Changes Clause giving the contractor an opportunity to submit a request for equitable adjustment. By no means would the quantity adjustment/increase exceed a volume requiring a new contract; however, if deemed appropriate, the government may proceed with a Competition in Contracting Act modification.
5. BID OPENING ROOM:
(1) The designated Bid Opening Room is located on the 15th floor at 231 South LaSalle Street, Suite
1500, Chicago, Illinois 60604.
E. USACE RESPONSE TO QUESTIONS: By way of this Amendment, the USACE responds to Contractors Questions as follows:
Question 1. Specifications mention that options may be awarded within 1,460 calendar days (4 years). With some of the options having 5 years of invasive species control, does this mean the project could potentially be 9 years?
Response: No, the project’s period of performance is 1825 calendar days (5 years). By way of this Amendment, Specification Section 01 22 00.00 10, Para 1.1.5.1, was clarified to state that Option CLINs 0018AB and 0018AE assumes 5 years of invasive species control and may be adjusted after the options are exercised to account for the remainder of years left in the contract. Any quantity adjustments will be subject to the FAR Changes Clause giving the contractor an opportunity to submit a request for equitable adjustment.
By no means would the quantity adjustment/increase exceed a volume requiring a new contract; however, if deemed appropriate, the government may proceed with a Competition in Contracting Act modification.
Question 2. Drain Tile Disablement is part of the base bid but will be happening throughout Prairie Bluff which is broken out into options. How will this work out if some of the Prairie Bluff options are not awarded?
What would be the requirements for restoration of these areas?
Response: The base contract CLINs as shown on Section 00 10 00 of the Solicitation includes drain tile disablement. The contractor will be required to disable the drain tiles at Prairie Bluff under the base contract to restore the site hydrology as described in the Specification Section 33 46 17.10, paragraph 1.1. Other restoration activities at each area of the prairie bluff will be completed upon award of the Option CLINS related to the bluff.
Question 3. There appears to be a possible mistake for item 0013AE. Is that supposed to be a bid quantity of 1 Job like the other Invasive Species Control Years 1-4 quantities?
Response: The unit of measure for Option CLIN 0013AE should be “Job”. By way of this Amendment, the Bid Schedule is corrected to change the unit of measure to Job. – see the enclosed revised Bid Schedule.
Question 4. There appears to be a mistake for item 0014AG. Is that supposed to be 69 acres to match the quantities given on plan sheet CE103 and to match the bid quantity for prescribed burning for that unit?
Response: The quantity for Option CLIN 0014AG is corrected by way of this Amendment to “69.” - see the enclosed revised Bid Schedule.
Question 5. Can you please clarify what Item 0004-Protection of Listed Species is supposed to include?
Response: This line item should include any labor necessary for maintaining flagging of endangered species protection areas as well as any costs incurred from special precautions to avoid impacting listed species on site as stated in paragraph 3.8 of Specification Section 01 57 20.01 03.
Question 6. The wage rates sheets provided in the specs are for Cook County, IL although project is in Will County, IL.
Response: By this Amendment, the government hereby replaces the Wage Determination included in the Solicitation package with the appropriate Wage Determination. Accordingly, General Decision Number IL170020, dated 09/22/2017 is hereby incorporated into the Solicitation and is attached hereto, wherein providing Cook County wages.
Question 7. Dry Mesic Prairie and Wet Prairie have oak species listed in the plugs/acre. Are these intended to be bare roots? Please clarify.
Response: By this Amendment, a paragraph was added to Specification Section 32 92 19.10 03, paragraph
2.4.1 to clarify the tree size requirements for the project. The revised Section is enclosed herewith this Amendment.
Question 8. Prescribed burning specifications mention that approximately 50% of Lockport Prairie Preserve will be burned each year of the contract. Item 0007 has a bid quantity of 248 acres which appears to be the whole base bid area for Lockport Prairie. Burning 50% for each year of the contract (5 years) would go over that bid quantity. Please clarify.
Response: Since the project areas will be burned multiple times throughout the contract duration, the unit of measure for the Prescription Burning CLINs have been revised by this Amendment from “AC” to “Job”. The project areas in acreage that will be burned are provided in para 1.9 of Specification Section 31 31 19.16.03.
- See enclosed Revised Bid Schedule
Question 9. Are the Priority 1-5 Additional plugs intended to be propagated plugs?
Response: Priority 1-4 Additional plugs (Option Items CLIN 0012AE – 0012AH) are not propagated plugs.
They are additional plugs to be purchased and installed in accordance with Specification Section 32 92 19.10
03 NATIVE PLANTS.
Question 10. Notes on plan sheets GC002 and GC003 state that work limits are approximately 50 feet inside property lines however the selective clearing specifications Objective # 3 says to remove all trees within 50 feet of Division Street east of the railroad tracks. Please clarify.
Response: The drawings have been revised by this Amendment to extend the work limits to the property line at Lockport Prairie Nature Preserve. - See the enclosed revised relevant drawing sheets
Question 11. If any or all of the option items for Native Planting are exercised, can the USACE provide a rough timeline for the overall planting schedule? Would the plantings be spread out evenly or would all of the plantings need to be completed in year two for example?
Response: In accordance to Section 32 92 19.10 03, paragraph 1.5, the Contractor is required to submit a yearly planting plan. The plan will include the timing of planting for approval. If and when the government awards the option items for Native Planting, we expect the seeds/plugs installed at the next growing season.
Question 12. For the Selective Clearing items, it was mentioned at the pre-bid meeting that all cut material would need to be hauled offsite, and burn piles would only be considered if there was a way to utilize them without impacting vegetation. It would appear at the time of the site visit that much of the area to be selectively cleared was poorly vegetated with invasive grasses. Would the USACE provide a firm answer on whether burn piles will be allowed in these areas? The amount of labor to haul offsite versus burning onsite will likely be vastly different.
Response: Refer to Specification Section 31 11 00, paragraph 1.5.2. Upon written approval from the COR, we will allow for onsite burn in such a way as to protect nearby woody and herbaceous species from heat damage. A statement will be added to paragraph 1.5.2 of the above Section to allow for Platform Style burn with locations approved by the COR for onsite burning and resulting ashes removed offsite.
Question 13. There are several questions regarding the CLINS for Invasive Species Control:
QUESTION 13A: Item Number 0005 – Which area(s) does this item refer to?
Response to 13A: CLIN 0005 includes invasive species control for the entire project area under the base contract except for project areas 2 north and south. CLIN 0006 includes invasive species control for project areas 2 north and south. This statement is added by this Amendment to Specification Section 01 22 00.00 10, para. 1.1.5.1 for clarification. – See the enclosed revised relevant Specification Section
QUESTION 13B: Item Number 0013AE – The unit price is in acres for this item, while the previous 4 years unit price is “job.” Is this correct?
Response to 13B: The unit of measure for Option CLIN 0013AE should be “Job” and is corrected by this Amendment – see the enclosed Revised Bid Schedule.
QUESTION 13C: Item Number 0018AB - The unit price for this is “job”, but there are no years associated with the line. Is this item for 1 year, 3 years, or 5 years?
Response to 13 C: By this Amendment, Specification Section 01 22 00.00 10, Para 1.1.5.1, was REVISED to state that OPTION CLINs 0018AB and 0018AE assumes 5 years of invasive species control and may be adjusted after the options are exercised to account for the remainder of years left in the contract.
QUESTION 13D: Item Number 0018AE- The unit price for this is “job”, but there are no years associated with the line. Is this item for 1 year, 3 years, or 5 years?
Response to 13D: By this Amendment, Specification Section 01 22 00.00 10, Para 1.1.5.1, was REVISED to state that OPTION CLINs 0018AB and 0018AE assumes 5 years of invasive species control and may be adjusted after the options are exercised to account for the remainder of years left in the contract.
Question 14. Under the Price and Payment Procedures, section 1.1.5.1 Payment says “….Under the base contract and optional contract line item numbers (CLINS) 001BAA and 0019AE, the Contractor will be paid 20 percent of the job price for years 1,2,3,4, and 5. It doesn’t appear that either of those numbers are CLINS for this project; which CLINS are they referring to?
Response: These CLINs are shown in error and are corrected via this Amendment – see the enclosed Revised Bid Schedule.
Question 15. Site Access - Will ATVs or trucks be allowed to access the site along the existing two-track path on the south side of Division Street?
Response: Trucks and other vehicles are only allowed on Division Street at Lockport Prairie. ATVs/UTVs are allowed only on access routes shown on plan sheets GC002 and GC003 at Lockport Prairie. Trucks, tractors, ATVs, and other equipment is allowed on site at Prairie Bluff Preserve throughout the project area, provided that rutting and other damage to the site is avoided.
Question 16. The legend on sheet CE104 outlines the planting area as 4 acres while Bid Item 0010 is only for 2 acres. Which acreage should we use?
Response: The CLIN 0010 of the bid schedule and Sheet CE104 both shows 4 Acres. However, both areas will be revised to 5 AC due to the changes in the work limits. By way of this amendment CLIN 0010 quantity will be changed to 5 AC and planting area on CE104 will be changed to 5 AC.
Question 17. What CLIN would any PRE-seeding/ planting work fall under?
Response: Pre-planting work will be cover under Native Planting CLINs as specified in Specification Section 01 22 00.00 10, paragraph 1.2.2. Payment for native plants include appropriate component to complete the work as described in Specification Section 01 22 00.00 10, which covers work for pre-planting.
Question 18. How many acres is CLIN 0005 and 0006?
Response: By way of this amendment, the acres for CLINs 0005 and 0006 will be provided in Specification Section 01 22 00.00 10, Para 1.1.5.1.
Question 19. What is the duration of invasive species control for CLIN 0005 and 0006?
Response: Specification Section 31 31 19.13, paragraph 1.1 states that invasive species control will be completed over the span of the contract to satisfy the yearly performance criteria contained in paragraph 3.10.
Question 20. Section 01 57 20.01 Paragraph 3.8.3 states “any herbicide application occurring within a 65 foot buffer of HED larval habitat shall be applied via hand wicking and using a USFWS aquatic approved herbicide and surfactant.” Are ALL of the HED larval habitat areas outlined on Sheets GC002 and GC0003?
Response: Yes, the HED habitat areas are shown on sheets GC002 and GC0003. As stated on note 2 of these sheets, the HED areas will be updated by others prior to construction.
Question 21. For initial tree clearing are we following the spec section 31 11 00 1.1.2 objectives 1-6 to guide the removal of large trees to be cut and removed and then during establishment treating/girdling any other species encountered that are on table 1 section 31 31 19.13? The alternative would be to remove any tree of any size on table 1 in section 31 31 19.13 during the initial clearing. What is the intent?
Example: black cherry is not mentioned in the tree clearing section but it is on the table. If we find a 10 inch cherry should it be removed from site during the initial clearing?
Response: The contract requires all targeted trees to be treated initially to meet the performance criteria stated in Specification Section 31 11 00, paragraph 3.2. Follow-up treatments will be made of resprouts over the course of the contract to meet the performance criteria in Section 31 31 19.13 paragraph 3.10.
Black cherry (Prunus serotina) is mentioned in Specification Section 31 11 00, paragraph 1.1.2 and Table 1 of Specification Section 31 31 19.13.
Question 22. In the option for plugs, is it on the contractor to collect the seed for the “Propogated Plugs”?
Also, for the “Additional Plugs”, are these plugs to be from the same seed source as the “Propogated Plugs” or will any seed source of local genotype (200 mi radius of project site) be acceptable?
Response: Refer to section 32 93 01.00 03, paragraph 1. The project scopes states that propagated plugs will be collected from onsite sources. The paragraph was revised by this Amendment to clarify that the contractor will collect these seeds, grow them into plugs, and installation of the plugs at the project site. – see the enclosed revised relevant Specification Section
Additional plugs will be readily available plugs purchased through commercial source and similar type of plugs listed in Specification Section 32 92 19.10 03. Additional clarification has been provided via this Amendment in Specification Section 01 22 00.00 10. – see the enclosed revised relevant Specification Section Question 23. Our question refers to Section 32 92 19.10 03 - Native Plants and Section 32 93 01.00 03 - Propagated Plug Production & Planting.
The native plants specification contains a table with various species of plant plugs with a number / acre to be planted in the various locations throughout the project. Is it the owners intention that the contractor obtain these various species commercially? In other words, the only plant material that will be propagated from on-site sources will be for the CLINs that specifically call out propagated material and these species will be determined by the owner and contractor during the course of the project, correct?
Response: Plant material for installation for this project may be procured from commercial sources provided that the appropriate plant origin specifications are met as referenced in Specification Section 32 92 19.10 03, paragraph
2.4.2. Plant material from within the prescribed ranges will be accepted, and any commercially sourced plant material from outside the prescribed ranges will be considered on a case by case basis. Seed collected from on site or other very local sources is required for any plants provided under section 32 93 01.00 03.
Question 24. We have a question about the plug species listed in the native restoration specification. Some of the species listed are trees but we don’t see a specification for tree planting or even a specified size for the plant material. Please clarify.
Response: By this Amendment, a paragraph was added to Specification Section 32 92 19.10 03, paragraph 2.4.1 to clarify the tree size requirements for the project. The revised Section is enclosed herewith this Amendment. Refer to Specification Section 32 92 19.10 03 for additional information for tree planting.
