QUESTIONS AND ANSWERS
Q1. The contract refers to a price "schedule" and "optional" items. It there really a price schedule pdf file that I should have?
A1. There are no optional items in this Contract. The bid schedule is now included in the posting on fbo.gov
Q2. Are any of the jobs listed "optional"? Or is this bid just one lump sum price for all work listed in the SOW?
A2. There is more than one bid item. Refer to answer A1.
Q3. What is the total length of the anchor chain? Contract calls out to use 75% of that length to calculate the required depth of water to do the retrieval test.
A3. The total length of anchor chain is 360 ft. However, the text of Paragraph C900 D has been revised to require testing in a minimum of 80 ft of water, and gives one approximate location where that water depth can be found.
Q4a. It is understood that a bidder is allowed to propose performing the work at his/her own facility.
We would like to propose that be the case. Due to the efficiency of performing the work at our facility
vs. the Tug's Berth, we would be able to, I feel, offer a much more competitive price.
Q4b. (In reference to SP-12) If we were to price this work at the USACE site, we would have to rent a crane, a man lift and a work platform. We would also charge off site rates to include per diems and mobilization costs. These costs will be much higher than the costs of potable water, electrical hook ups and garbage disposal. Can this section of the spec be excluded or would you like me to price accordingly?
A4. Neither SP-12 nor any other provisions preclude bidders from submitting proposals based on performing the work at a location other than the USACE dock. However, bidders must indicate where they propose to perform the work, and transportation costs will be factored into the evaluation of bids in accordance with SP-15.
Q5. The aforementioned statement brings me to the following; I think hauling the vessel would further increase productivity. Based on the amount of welding and fabricating on the external hull, along with the extent of fendering modifications, there would be a significant cost advantage to be able to perform the work from the ground. It would be a major feat I feel to accomplish all of this work from a float at berth. Furthermore, the lower fender that is requiring to be modified is currently under the waterline.
A5. Hauling the vessel out of the water to perform the work would be at the discretion of the Contractor. No separate payment provision is made for this in the solicitation, so the costs of such work should be included in the other bid costs as appropriate.
Q6. It is understood all work must be completed NLT May 22nd 2017, but do you have a projected date of award?
A6. Award is anticipated by 24 MAR 2017.
Q7: What is the manufacturer of the existing chain locker manhole:
A7: Unknown
Q8: Will power tooling and touch up for paint be acceptable for the relocation of the fenders?
A8: Yes, if acceptable to the paint manufacturer. All components of the paint system must be provided in accordance with the specifications.
Q9: I do not see any mention of ABS inspections. If this is required, it will be on the owners account.
A9: Any required ABS inspections will be paid separately by the government.

Q10. The SOW is unclear as to what to do to overhaul the capstan. I am currently working Markey Machinery to get a quote but I'm finding it is impossible to get a competitive firm fixed price on the overhaul at this point just because we are not able to predict the extent of the repairs necessary until it is first disassemble and inspected.
A10. Additional language has been added to clarify the extent of the work for the capstan overhaul to be included in the bid. It is recognized that the full extent of required repairs may not be known until it is inspected. The cost and schedule for any additional work identified during the inspection will be addressed by a negotiated contract modification.

C000 GENERAL
C001 PROJECT DESCRIPTION
The Buffalo District (LRB) of the U.S. Army Corps of Engineers (USACE) has issued this solicitation for the procurement and installation of a new anchor, the construction of a hull recess to store the anchor, and the refurbishment of the existing capstan on the tug CHERAW.
The Contractor assumes complete responsibility for the construction of the hull recess according to this specification to meet the requirements of this contract. The Contractor also assumes complete responsibility for the procurement of the anchor and the procurement of the services of a competent deck machinery repair company to refurbish the capstan according to this specification.
C002 VESSEL INSPECTION
Potential bidders may contact the vessel owners in regard to inspecting the vessel before submitting a bid package. C003 DESIGN STANDARDS
The hull recess, anchor, capstan, and associated equipment shall be designed and constructed in accordance with the latest edition and interpretations of the rules, regulations, requirements and standards of the Legislation, Regulatory Agencies and technical organizations listed below. The Contractor is required to incorporate into the vessel any revisions to the rules and regulations listed below as well as those stipulated in the respective specification clauses.

C006 SCOPE OF WORK
A. CONTRACTOR’S RESPONSIBILITY
The Contractor assumes complete responsibility for refurbishing and testing the existing capstan and constructing the hull recess to meet the requirements of the contract.
Should the Contractor determine at any time that he is unable to fulfill those responsibilities, he shall notify the COR immediately of the problem experienced and his proposed manner of correction.
The Contractor is not responsible for any design work or engineering to develop the hull recess details, the Government will provide a design for the recess to include all structural and weld details (see Section C410).
B. CONTRACT INTENT
It is the intent of this contract to have the Contractor furnish a new anchor, fabricate and install one anchor recess, and refurbish the existing capstan in order for these components to meet the performance requirements, operational requirements, and objectives of the U.S. Army Corps of Engineers.
C010 DEFINITIONS
The following definitions are applicable to phrases and acronyms used throughout this contract:
• COR - Contracting Officer’s Representative - a member of the contract management and quality assurance team authorized by the Contracting Officer to perform certain administrative and managerial duties. A copy of the COR’s authority letter is furnished to the Contractor.

• K.O. - Contracting Officer - A person with the authority to enter into, administer and/or terminate contracts and make related determinations and findings.
• MDC – Acronym for the Marine Design Center.
• QC - Quality Control - Quality Control is a function of the Contractor.
Quality Assurance (QA) is a function of the Government.
• USACE – Acronym for United States Army Corps of Engineers.
C025 CONTRACTOR QUALITY STANDARDS
The Contractor shall be responsible for the fabrication of a hull recess on the vessel and the refurbishment of an existing capstan. Inspection by USACE personnel is for the purpose of verifying the proper function of the Contractor’s quality control measures and is not to be used as a substitute for control of quality by the Contractor.
A. STRUCTURAL MATERIALS
Unless otherwise specified or noted on the contract drawings, all structural hull material shall be in accordance with the following specifications:
• American Bureau of Shipping (ABS), “Rules for Building and Classing Steel Vessels Under 90 Meters”
• Welding Materials - ABS “Approved Welding Electrodes, Wire-Flux and Wire Gas Combination.”
B. STANDARD PARTS & MATERIALS
All articles, fittings, equipment, machinery, supplies, and materials used in the construction and outfitting of the hull recess shall be the highest grade, free from defects and imperfections, unused, and be the standard product of reputable manufacturers, to the maximum extent practicable. Any material not specified shall be the best of their kind for the purpose intended.
Materials specified herein to meet the requirements of standard specifications published by national authorities shall conform to the respective editions, including amendments, specified. No salvage materials shall be used in the work.
C. WORKMANSHIP

All labor shall be especially skilled for each kind of work and under competent direction.
In engaging one kind of work with another, marring or damage of previously acceptable construction shall be cause for rejection. All parts of the vessel intended to join or bear upon other parts shall have complete and solid contact and shall fit together without excessive cold work during erection. Shims or liners shall not be used for the purpose of overcoming a bad fit. Lightening holes may be punched or flame-cut and all edges shall have burrs removed. Holes in members having sharp curvature shall be avoided.
D. WELDERS
All welding under this contract shall be done only by welders who have successfully passed qualification tests accepted by the American Bureau of Shipping or other regulatory bodies acceptable to ABS.
The Contractor shall bear the expense of conducting these tests and shall certify, by name to the Contracting Officer, welders who have successfully passed the prescribed tests and hold current, valid certifications.
The Contractor shall require any welder to repeat these tests when in the opinion of the Contracting Officer, the work of the welder indicates a reasonable doubt of his proficiency. In such cases the welder shall be re-certified as above if he successfully passed the retest; otherwise, he shall be disqualified until he has successfully passed the retest.
The Contractor shall maintain records of each welder’s certification during the course of the contract. The records are to be available for examination upon request of the Contracting Officer.
E. WELDING
All welding shall be in accordance with the current rules and Quality Standards of the American Bureau of Shipping and ANSI/AWS D3.5-85. All welding equipment used on the work shall be of a modern type subject to close control. The electrodes used throughout the work shall be suitable for use with the parent metal at each weld, and be approved by ABS.
Welding procedures, as to direction, length, numbers, and sequence of beads, shall be carefully planned to minimize lock-up stresses. Care shall be exercised to produce smooth even beads, especially on all exposed plating and fittings. Beads shall be chipped and ground where directed by the COR.
The Contractor shall employ appropriate welding procedures and grounding connections.

F. INSTALLATION
Materials and equipment shall be installed in accordance with the approved recommendations of the manufacturer, and in compliance with the contract documents.
The installation shall be accomplished by workmen skilled in this type of work.
G. CONSTRUCTION STANDARDS
All material, machinery and equipment shall be new, of current manufacture and suitable for the marine service intended. Spare parts and service shall be readily obtainable.
All material, unless otherwise specified in these specifications or in the drawings, shall be of commercial quality to ASTM, ANSI, or SAE specifications.
During installation and before completion, the Contractor shall be responsible for protection of all material, equipment, etc., located on the vessel.
All materials shall be free of imperfections due to manufacturing processes and from defects which adversely affect appearance or serviceability.
All sharp edges or projections which constitute a personnel hazard shall be removed or ground smooth. All notches shall have a radius to prevent stress concentrations.
C400 OUTFIT
C406 COATING SYSTEM
A. CONTRACT DRAWING

B. GENERAL
The Contractor shall provide all labor, equipment, material, and services to paint all areas of the vessel affected by shipyard work and all new steel work.
Detailed requirements for surface preparation and coatings of these areas are included in Paragraph C. of this clause and on the Contract Drawing.

Paint shall be delivered in sealed containers with labels to indicate manufacturer, contents, manufacturing date, and any special instructions. Paints and painting materials shall be stored under cover and protected from extreme temperatures.
Paints shall not be used if they have exceeded the closed shelf life or pot life recommended by the manufacturer. Additionally, paints shall not be applied in weather or humidity conditions not recommended by the manufacturer.
2. Application of Coatings
Paint application shall be in strict compliance with the coating manufacturer’s recommendations. The Contractor shall take particular care to ensure that the coating system requirements are met in all areas, especially those difficult to coat, such as flange undersides. All painting on both the interior and exterior surfaces below the main deck shall be accomplished prior to undocking of the vessel. See Paragraph B-7 for more information on final inspection.
3. Coating System
The coating system for the vessel is identified on Contract Drawing No. 3180- E406-01. Specific details for surface preparation and coatings are also included in paragraph C below.
4. Number of Coats
For all areas that require sandblasting, the number of coats is not specified. The Contractor is required to provide the number of coats necessary to attain the DFT (Dry Film Thickness) thickness required in the schedule identified. Thickness applied per coat may not exceed the manufacturer’s recommended maximum thickness.
For areas where sandblasting is not required, the number of coats is identified in the specific sections for those areas and the average dry film thickness for each coat shall be consistent with the values identified in the manufacturer’s recommendations.
The "under coats" of all multiple coat applications (except the hull exterior) may be "contrast tinted" to ensure complete coverage of successive coats, however the final coat shall be consistent with the color schedule identified on the Contract Drawing.
5. Coating Color Schedule
Colors shall conform to Federal Standard No. 595B COLOR BOOK. The book as well as individual paint chips (3” x 5”) may be procured from the Naval Publications and Forms Center, 5801 Tabor Road, Philadelphia, PA 19120 (215-697-2000).
The coloring schedule shall be in accordance with the Contract Drawing.

All top coatings shall be thick enough to provide complete opaque color coverage.
Thickness increased over the DFT minimums required above shall be provided if required for opaque color coverage.
All newly-installed machinery and equipment shall be painted with the individual manufacturer’s standard colors and coating systems.
6. Final Inspection of Painting
The Contractor is responsible for delivering the vessel with all painted surfaces in sound condition, and in accordance with this specification.
Prior to undocking of the vessel, all interior and exterior painting shall be thoroughly inspected. The vessel shall not be undocked until:
• The painting warranty and documentation as required in paragraph B-7 below has been provided to the COR. The warranty and documentation must show compliance with this specification in all areas, and all readings taken.
• The painting has been inspected to the satisfaction of the COR. Contractor must provide warranty and documentation prior to COR inspection.
If there are any defects or damage in the vessel coatings, the Contractor shall repair the coatings to restore the integrity of the paint system, and to meet the requirements of this specification. All damage shall be repaired by the Contractor in accordance with the surface preparation and coating system requirements included in this Clause and on the Contract Drawing for the specific damaged area.
Painted surfaces damaged by the Contractor in handling or installation of new or existing equipment shall be repainted. Any overspray from the contractor’s painting operations shall be removed and the original coatings for those areas shall be restored in accordance with the Contract Drawing.
The Contractor is responsible for all costs associated with correcting deficient areas noted during the Final Inspection.
7. Documentation & Warranty
a. Documentation
The Contractor shall provide a written signed statement from the paint manufacturer certifying that all surface preparation and coating application have been performed in accordance with the coating system manufacturer’s requirements, and that the coating application meets all requirements in this specification.

The Contractor shall provide documentation logs for each coating applied. The logs shall include the following parameters:
i) Coating (per specification) type.
ii) Coating manufacturer’s requirements for preparation, environmental conditions and application.
iii) Date and time of preparation and application.
iv) Extent and location of area coated.
v) Surface: preparation, condition at time of coating, temperature at time of coating, dew point at time of coating.
vi) DFT measurements for each applied coating type.
Measurements shall be taken as follows:
• All flat surfaces, one reading per every 200 square feet, uniformly distributed.
• Undersides of all flanges, one reading per every 50 linear feet of flange, uniformly distributed.
• Wet film measurements may be taken and converted to DFT as an alternative to direct DFT. In areas where multiple coating types are required, the above DFT requirements are applied to each coating type.
• Note – As mentioned in Paragraph B-5, for areas where sandblasting is not required, the number of coats is identified in the specific sections for those areas. For these areas, the documentation shall only note that a full coat was applied since DFT measurements are not required.
vii) Services provided by paint manufacturer’s representative (i.e.
DFT readings, dew point, etc.), if present during application.
viii) Signature of paint manufacturer’s representative on site, if present.
b. Warranty

The Contractor shall warranty the coating system for one calendar year, commencing at Final Acceptance. The Contractor shall repair any coating failures during this time period at his cost.
8. Safety & Health Standards
The U.S. Occupational Safety and Health Administration Regulations (OSHA) require the Contractor to designate a "competent person" to test compartment atmosphere quality (29 CFR 1915.7).
On 24-hours notice of any Government inspection, and before any representative of the U.S. Government boards the vessel for inspection, each enclosed or confined space to be inspected shall be labeled “Safe for Workers” in accordance with the OSHA regulations stated in 29 CFR 1915.31-36.
This means that in all spaces so designated:
• The oxygen content of the atmosphere is at least 19.5 percent and below 22 percent by volume;
• The concentration of flammable vapors is below 10 percent of the lower explosive limit (LEL);
• Any toxic materials in the atmosphere are within permissible concentrations;
• Any residues or materials associated with any work in the space will not produce uncontrolled release of toxic materials under existing atmospheric conditions while maintained as directed.
Entry shall not be permitted to any enclosed or confined space, which does not have a current "Safe for Workers" designation.
The Contractor shall provide all labor, equipment, material, and services to ventilate and test all spaces to demonstrate compliance with the OSHA requirements. Each compartment inspection and test shall be logged on OSHA Form 74, with instructions on how to maintain a safe atmosphere in these spaces until the completion of the contract.

The Contractor shall furnish all labor and material to install an anchor handling system comprised of a hull recess, hawse pipe, and chain roller. The recess in the hull of the tug CHERAW shall be in accordance with contract drawing 3180-E410-01. The Contractor shall provide all materials required for this construction. This clause includes the removal of fendering in way of the hull recess, removal of fendering in way of anchor deployment, installation of a roller pin, installation of a hawse pipe, one anchor, and installation of a hull recess. These tasks are outlined in the sections below.
C. ANCHOR CHAIN REMOVAL AND INSPECTION
The anchor chain currently located in the chain locker of the vessel shall be removed and inspected for defects. If none are found, it shall then be stored until the hull work has been completed, when it will be reinstalled.
D. FENDERING MODIFICATION
The Contractor is responsible for the removal of fendering in way of the hull recess and in way of anchor deployment per Contract Drawing 3180-E410-01. This includes removing the existing fendering, cutting it to the dimensions in the contract drawing, and removing and reinstalling brackets at the aft end of the fendering.
E. HULL RECESS INSTALLATION
The Contractor shall provide all labor and material to remove shell plating and members in way of the hull recess in Contract Drawing 3180-E410-01. The Contractor shall also fabricate and install the hull recess as shown on the contract drawing.
F. COMPARTMENT ACCESS INSTALLATION
The Contractor shall provide all labor and material to install a new watertight access hatch into the chain locker on the port side of the vessel as shown in Contract Drawing 3180-E410-01. The access hole shall be covered by a bolted plate, similar to the existing access holes on the starboard side of the vessel.
G. ROLLER PIN AND HAWSE PIPE INSTALLATION
The Contractor shall install a hawse pipe and roller pin as shown on Contract Drawing 3180-E410-01. The roller pin is to be five inches in diameter and located as shown on the drawing. The hawse pipe shall be ten (10) inch diameter schedule 80 pipe. It shall be located as shown on the contract drawing and will not penetrate the bulkhead at frame 5.

A. GENERAL
The Contractor shall retain the services of a deck machinery repair company in order to refurbish the forward combination capstan and windlass. The capstan windlass is manufactured by Markey Machinery and dates from 1968.
The Contractor shall provide all necessary labor and material to remove and then reinstall the entire forward capstan/windlass. The Contractor is responsible for shipping the capstan/windlass to and from the repair facility, where the work will be completed in a shop. The opening left by the removal of the capstan/windlass shall be covered until the machinery is reinstalled.
The recommended company for this work is Markey Machinery, the original manufacturer of the capstan. They can be reached through the contact below. The capstan/windlass has the below serial and model numbers.

Alternative sources for the capstan repair shall demonstrate actual experience in repair of this capstan, or comparable sized capstans of similar age.
Rehabilitation of the Capstan Windlass shall include the following work:
• Disassembly and inspection of winch
• Preparation and submission of a Condition Found Report (CFR) detailing the inspection findings
• Sand blast winch base and case
• Replace all fasteners, bearings, bushings, and seals with new
• Lubrication of components
• Reassembly of the winch
• Repaint with 3-layer marine coating system
• Functional testing
It is recognized that the inspection and CFR may identify the need for additional work to repair and/or replace damaged or worn components of the capstan windlass. If that is the case, the CFR shall be accompanied by a detailed scope, cost, and schedule proposal for the additional work, which will be addressed by a negotiated Contract modification if approved by the government.
In addition, work on the capstan hydraulic control system is required. The Contractor shall replace four lengths of existing capstan windlass hydraulic hoses, couplings, piping, and elbows from the points of connection to the control manifold (above mailto:CGoss@markeymachinery.com
Section C Description and Specifications Rev 15 MAR 2017 - Page 12 of 14 deck), through the deck, and connect to horizontal sections of sound existing piping below the deck, a minimum of 4 inches beyond the locations of the existing elbows. The Contractor shall provide new couplings for the piping at the deck penetrations to carry the hydraulic system through the deck, and those couplings shall be welded to the deck. A small area of deck plate may need to be replaced as part of this work. All new hydraulic piping, couplings, and hoses shall be rated for the system pressure and compatible with the hydraulic fluid used in the system. Hose size shall match existing. Pipe and fitting size and material shall match existing. All connections of piping and fittings shall be accomplished using silver solder for brass or bronze pipe, or welding for steel pipe. As part of this work, the contractor shall drain and dispose of any hydraulic fluid existing in the capstan windlass portion of the tug hydraulic system, and clean the capstan hydraulic sump. Hydraulic oil levels shall be marked and recorded at the beginning and ending of the project, and the Contractor shall be responsible for refilling the system as needed to restore any hydraulic fluid lost during the work. The hydraulic fluid used in the system is Medallion Plus AW-32. Annotated photos of this work are included as an Attachment to the Scope of Work.
C457 NEW ANCHOR
The Contractor shall also provide an anchor, stockless type, with a weight of 750
lb. The anchor shall be certificated by ABS. The anchor shall be shackled to the existing chain.
C800 SPARE PARTS
The Contractor shall provide a recommended list of spare parts for the capstan.
The Government may purchase spares from this list by issuing a contract modification.
C900 TESTING
The Contractor shall perform tests on all equipment, machinery, and systems installed or modified as part of this contract. The tests shall demonstrate satisfactory compliance with the specification requirement. The Contractor shall furnish all labor, material, tools, and test equipment to perform the testing. Within 30 days after notice to proceed, the Contractor shall submit a comprehensive test plan for all equipment, machinery, and systems to demonstrate proper operation and to verify that the components were installed correctly.

Steel work, including the hull recess and hawse pipe, shall be inspected using hydrostatic testing to check both for leakage and for structural integrity with a test head equivalent to the height of the main deck above baseline. The new access manhole and hydraulic piping deck penetrations shall be hose tested for water tightness.
C. CAPSTAN FACTORY ACCEPTANCE TESTING:
The Contractor shall perform factory acceptance tests for the capstan/windlass at the repair facility. The manufacturer shall test the equipment, including no load test, test at rated capacity and line speed, and a brake test to demonstrate operation of the brake systems. The Contracting Officer shall have the option of witnessing the shop test. The COR shall be notified at least ten (10) working days prior to the scheduled test date.
D. ANCHOR SYSTEM INSTALLATION & ACCEPTANCE TESTING:
Capstan Testing after Installation
Upon completion of installation, the capstan system shall be thoroughly tested and operated in the presence of the COR, to such extent as necessary to demonstrate satisfactory operation as designed and specified. The Contractor shall make all arrangements with the equipment manufacturer(s) to provide a qualified factory representative(s) on site for the acceptance test.
Demonstrate the free running operation of the capstan in forward, reverse and stop.
Perform pull tests to demonstrate rated load capability for the capstan with the chain and anchor. Demonstrate that the capstan will operate at the rated speed and line pull.
Demonstrate the free movement of the chain around the roller pin.
Capstan and Anchor System Functional Testing
All capstan and anchor deployment system tests shall be performed in accordance with the manufacturer’s recommended factory procedure for the equipment.
Demonstrate anchor launch and retrieval in a water depth of at least 80 ft. NOAA
Charts indicate this depth of water can be found in the vicinity of Latitude 41.96°, Longitude -81.67°, approximately 27.5 NM NNE of Cleveland Harbor. Verify free fall of the anchor upon release of the chain stopper and the winch brake. Verify the proper tripping and rotation of the anchor for entry into the hull recess.

The costs of all work described in this specification under paragraph C456 CAPSTAN shall be included and paid under Bid Item 2 Removal, Rehabilitation, and Reinstallation of Anchor Capstan. The costs for all other work required to perform this contract and provide a complete, functional anchor and anchor handling system for the Tug Cheraw as described in this specification and shown on the drawings shall be included and paid under Bid Item 1 Anchor, Hawse Pipe, Hull Recess, and Other Miscellaneous Work.

SPECIAL PROVISIONS – TUG CHERAW ANCHOR AND ANCHOR HANDLING SYSTEM
SP-1 SCOPE OF WORK- The work to be done under this Job Order consists of furnishing all labor, material, equipment, supplies, facilities, and services required, and performing the work described herein in strict accordance with these specifications and drawings, and the Master Agreement for Repair and Alteration of Vessels. All of work of this Contract is to be complete no later than 22 May 2017.
SP-2 QUANTITIES-
SP-2.1 When any item of work hereinafter described specifies a definite quantity of work to be done, it is contemplated that such quantity will be required; however, the right is reserved to increase or decrease the amount of work in accordance with the provisions set forth in Paragraph
SP-6.
SP-2.2 Quantities of work indicated for performance are not in all cases exact, being in such cases estimates only and are intended to indicate the approximate quantities. Such work will be pointed out and definitely designated as to location and quantities by the Contracting Officer and will be done on a unit price basis. The Contractor will be required to complete the work at the unit price or prices stated in the Contract, whether it involves quantities greater or less than those specified.
SP-3 OPTIONAL ITEMS OF WORK- Items of work designated in the specifications, price schedule, and in the schedule of quantities and prices in the Job Order as "Optional" are to be performed only to the extent required by the Government as determined by the Contracting Officer. The Contractor shall perform the work included in any or all of such items as directed and shall be paid therefore at the rates appearing in the schedule of quantities and prices as applicable to the amount of work performed. The Government is under no obligation to require the performance of any such items of work. The Contractor shall indicate on the proposal schedule the number of additional schedule days required to accomplish each optional item of work.

SP-5 LOCATION OF WORK / DELIVERY AND RETURN OF PLANT-
It is anticipated that the work of this Contract will be performed at the USACE government dock located at 1035 E 9th St, Cleveland, OH 44114. Offers that are contingent on performance of the work at other locations will be considered, but must specify the work location with the offer. The following provisions shall apply if the work is performed at a location other than the USAC government dock.
SP-5.1 Plant transported by the Government will be delivered to the Contractor in open water clear of and adjacent to the Contractor's yard. The plant will be delivered as close as is practical to the time agreed to by both parties to the contract.
SP-5.2 Upon completion of the work, the Government will accept return of the plant at the point where it was delivered to the Contractor. The date and hour of return of the plant to the Government shall be considered to be the time of the completion of the work, subject to the provisions of Paragraph SP-6.
SP-5.3 Any tug or pilot services required between open water and the drydock, slip, or berth at the Contractor's yard shall be promptly furnished by the Contractor at his expense. The government will deliver the plant to the drydock if conditions (water depth, etc) safely permit.
SP-6 COMMENCEMENT, PROSECUTION, AND COMPLETION- The Contractor will be required to commence work under the Job Order within one working day after delivery of the plant, to prosecute the work with faithfulness and diligence, and to complete it within the time specified, provided that, if the Contracting Officer orders any additional work to be done beyond that called for by these specifications and/or orders any work described and required in these specifications not be done, appropriate adjustments in the time and/or price shall be made in accordance with the Master Agreement for Repair and Alteration of Vessels. The time stated for completion is to include testing and final cleanup of the plant.

Note: The contractor shall not rely solely on the drawings, and shall field verify any elements of construction of the vessels relied upon for proposal preparation and execution of the work.
SP-7.2 Electronic copies of the drawings are provided as attachments to this contract, in pdf format. Drawings are available at the Office of the District Engineer, Buffalo District, 1776 Niagara Street, Buffalo, NY 14207. Additional copies of the above listed drawings and of these specifications will be furnished to the successful Offeror without charge upon request.
SP-8 SHIFTING, ALTERATIONS, ETC.- Should the removal or shifting of any parts of the plant or its fittings, stores, fuel, water, etc., be necessary for carrying out the repairs specified, the same shall be done by the Contractor at his expense and all such removals shall be subsequently replaced and any damage or loss resulting from such removal or shifting or replacement shall be made good by the contractor at his expense. Should any portion of the plant's structure, housing, fixtures, or equipment require alteration in order to carry out the work, the Contractor shall make such alterations at his expense.
SP-9 DISPOSITION OF SCRAP AND SALVAGEABLE MATERIAL- Notwithstanding the requirements of the Master Agreement for Repair and Alteration of Vessels, all items designated as scrap resulting from the work shall become the property of the Contractor, and due consideration of the value of such scrap shall be reflected in the proposal price of the individual items concerned. This shall not apply to salvageable items ordered to remain property of the Government, which shall be loaded and returned to the Government on truck or on board the vessel as directed. The determination of whether or not an item is salvageable shall rest with the Contracting Officer's Representative if not stated in the specifications.
SP-10 REPAIRS TO BE MADE BY THE GOVERNMENT- Government personnel may work on the vessels while in the Contractor's yard, making repairs not covered in these specifications. Work done by Government personnel will be performed in such a manner as not to delay the work of the Contractor.
This work will not involve repairs to the underwater portion of the vessels.
SP-11 CLEANLINESS ABOARD PLANT- The Contractor shall keep working areas clean and shall clean up such working areas to a condition "as found prior to commencement of work." The Contractor shall at all times refrain from marring, marking, or defacing any portion of the interior of the vessel. Any such marring, marking, or defacing shall be restored to its original condition by and at the expense of the Contractor prior to acceptance of the plant by the Government as provided in Paragraph SP-5.
SP-12 SERVICES TO BE FURNISHED BY THE CONTRACTOR WITHOUT FURTHER COST- The Contractor shall furnish without further cost to the Government the services listed below.
SP-12.1 If work is performed at a location other than the USACE government dock, the Contractor shall furnish and connect a temporary auxiliary electric power supply to permit heating, lighting, and ventilation of quarters, the galley, and machinery spaces, and for the operation of necessary deck and auxiliary machinery. The Tug Cheraw will require 100 Amp, 440 VAC, 3 phase service. The Tug Cheraw will require up to 2000 gallons of potable water every 90 days to recharge the boiler.
SP-12.2 The Contractor shall make provisions to remove the garbage and trash from each vessel at least once daily.
SP-12.3 The Contractor shall furnish crane service to place stores and other Government equipment aboard the vessel and to remove supplies and equipment from the vessel as needed for the performance of the work. Crane services shall be provided at times mutually agreeable to the Contractor and the Contracting Officer.
SP-12.4 The Contractor shall ensure that the Tug Cheraw is kept heated and with electrical power at all times during the period that they have custody of the vessel, in order to ensure that vessel systems are not damaged by exposure to freezing conditions.
SP-13 FINAL EXAMINATION AND ACCEPTANCE- As soon as practical after the completion of the entire work as may be designated in the specifications a thorough examination thereof will be made by the Contracting Officer's Representative at the site of the work. If such work is found to comply fully with the requirements of the Contract Job Order it will be accepted, and final payment will be made in accordance with the Contract article entitled "Payment".
SP-14 LIQUIDATED DAMAGES- For each work day beyond the adjusted scheduled completion date that completion of the work is delayed, liquidated damages will be assessed at the following rates:
Administrative Costs $1025/work day
For the purposes of this paragraph work days consist of Monday through Friday inclusive with the exception of Federal holidays.
SP-15 PROPOSAL EVALUATION
The award decision will be made based upon the total sum of the Proposed Prices for all work on the Proposal Schedules (including any optional items as described below).
SP-15.1 For offers that are contingent on performance of the work at a location other than the USACE government dock, in evaluating the proposed price, an additional cost factor will be added to an offerors proposed prices for all work, to account for the government’s costs associated with round trip transport of the vessels between Cleveland OH and the Contractors facility. Travel cost shall be evaluated using the over-water distances between ports published in the latest version of Volume 6 of the US Coast Pilot:

These costs will be added for evaluation purposes only. The Cost factor will be $109/mile.
Travel distance will be two times the over-water distance based on a single round trip, for delivery and pickup.

SP-16.1 Safety Submittals
All safety and submittals shall be provided to the government within 14 calendar days after contract award. No work on the vessel will be permitted until the COE Safety Office has reviewed and found the submittals to be acceptable. The COE Safety Office will have 7 calendar days to review and respond to submittals.
SP-16.2 Schedule
In addition to the schedule information required with the proposal, the Contractor shall submit and maintain a detailed schedule showing the planned dates of starting and completing each item of work awarded.
