STATEMENT OF WORK 2

PART 1 – GENERAL 4

1.1 PROJECT DESCIPTION 6

The Project consists of Construct MAC II Pad, PROJECT NO. LUXC172685, SOUTH 7 DAKOTA AIR NATIONAL GUARD, SIOUX FALLS, SOUTH DAKOTA, as indicated 8 on Contract Documents. 9 The Work includes, but is not limited to the following (Contractor to furnish all materials, 11 equipment, and labor, except for where specifically noted): 12

1. Plan Sheet 1: 13 A. Demolish existing topsoil to a one foot average depth. 14 B. Demolish existing asphalt fillet. 15 C. Provide, install, and compact 6” of granular base course in 16 compliance with the specifications. 17 D. Provide and install 6” concrete pavement in compliance with the 18 specifications. Pavement elevation to match adjacent asphalt 19 pavement. 20

I. Joint pattern to include bulk head construction joint at 21 concrete trough and two full depth expansion joints. All 22 other joints shall be saw cut contraction joints while 23 concrete is “green”. 24

II. See detail drawings for joint specifics. 25 E. Provide and install concrete trough and (8”x1/4”xL – in 3’ 26 sections) steel or cast iron cover plates in compliance with the 27 detail and specifications. 28

F. Fill space between existing asphalt and new concrete pad 29 (approximately 4 ½ ft.) with gravel, level with adjacent pavements. 30

G. (Bid Option 1) Provide and install four static ground rods. 31 I. Ground rods will be a 10 foot rod with a closed eye. The 32

10 foot rod will have a diameter of not less than 0.75 33 inches, and the top will be bent with a closed eye (often 34 referred to as a shepherd’s crook bend), having an inside 35 diameter of not less than 1.5 inches. The rod will be 36 copper, copper-clad steel, galvanized steel, or copper-zinc-37 silicone alloy. 38

II. Maximum resistance measured IAW ANSI/IEEE Standard 39 142 should not exceed 10,000 ohms under dry conditions. 40

H. (Bid Option 1) Provide and install two new light poles (Lithonia 41 SSA-16-4C or approved equal), weather proof pole mounted 42 outlets, light switches, and post top mounted light fixtures 43 (Lithonia KASR2-250S-PE1/LU250, or approved equal) in 44 compliance with the details and specifications. 45

I. Lights to be fed from Panel EC4 in Building #86. All 1 required boxes, conduit, connections, breakers, and wiring 2 to be provided and installed by the Contractor in 3 compliance with NEC and the specifications. 4

2. Plan Sheet 2: 6 A. Saw cut and remove existing 6½” asphalt pavement and geotextile 7 fabric. 8 B. Provide and install 1½” of new granular base course and compact 9 in compliance with the specifications. 10 C. Provide and install 5” of new asphalt pavement in compliance with 11

South Dakota DOT Standard Specifications for Roads and Bridges, 12 Current Edition. 13

I. Install pavement markings to match existing. 14 D. Provide and maintain traffic signage to restrict and direct traffic as 15 needed throughout this phase of the project. 16 E. Maintain vehicle thoroughfare through construction zone by 17 completing demolition and construction of half of the roadway at a 18 time. 19

F. Coordinate demolition and construction with Base Fire Department 20 and Security Forces. 21

3. Plan Sheet 3: 22 A. Remove existing asphalt pavement. 23 B. Recompact existing base course in compliance with the 24 specifications. 25 C. Provide and install 5” of new asphalt pavement in compliance with 26

South Dakota DOT Standard Specifications for Roads and Bridges, 27 Current Edition. . 28

D. Provide and maintain traffic signage to restrict and direct traffic as 29 needed throughout this phase of the project. 30

E. Coordinate demolition and construction with Base Fire Department 31 and Security Forces. 32

4. Plan Sheet 4 33 A. Demolish one evergreen tree as shown on the attached site plan 34 B. Remove and salvage to the Government existing traffic arm. 35

I. Disconnect existing power supply, and pull back to existing 36 handhole H1. 37

C. Demolish existing topsoil to an 8” average depth. 38 D. Provide, install, and compact 4” of engineered fill in compliance 39 with the drawings and specifications. 40 E. Provide and install 4” concrete sidewalk in compliance with the 41 site plan, details, and specifications. 42 F. Provide and install new vehicle barrier gate with electric operator 43

(TYMVS gate operator, or approved equal) in compliance with the 44 site plan, details, and specifications. 45

I. Gate shall include new support posts with concrete footings 46 independent of the existing fence. 47

II. Gate shall align with post on the opposite side of the 48 roadway. 49

III. Provide and install new magnetic vehicle sensors in the 1 existing asphalt roadway. 2

IV. Gate operator to be powered from the existing handhole E3. 3 V. Gate operator to be controlled by existing keypad, new 4 magnetic vehicle sensors, and remote operation tied into 5 the existing Fire Station alarm system. 6

G. Provide and install four 1400 ~ 1600 lb rock boulders. Space 7 boulders approximately 10’ apart as shown on the attached site 8 plan. 9

All work shall be completed in compliance with the attached drawings and 11 specifications. 12

1.2 CONTRACT DRAWINGS 14

Accompanying these Specifications are the Drawings, which are complementary to these 15 Specifications and intended to coordinate the work of this Contract. Any work included 16 in one and not the other shall be fully executed as those included in both. 17

1.02 SCHEDULE OF VALUES 28

A. Schedule of Values: The Construction Contractor must furnish the U.S. Government with a 29

“Schedule of Values” at the pre-performance (preconstruction) conference. This schedule shall 30 provide a detailed breakdown of contract price, listing all expenses/costs with a line item value 31 of $5,000.00 or more. As a minimum, this schedule shall be a listing of each section of the 32 specifications, with subcategory prices listed thereunder. Bonds and insurance shall not be 33 included in the above-mentioned prices, but shall be listed separately as Items 1 and 2 of said 34 schedule. The U.S. Government will announce the format of this schedule at the pre-35 construction conference. The schedule will be utilized by the U.S. Government, in conjunction 36 with the Construction Contractor's progress schedule, as a basis for reviewing applications for 37 payment. 38

1.03 PROJECT COORDINATION 2

A. At the pre-performance conference the Construction Contractor shall coordinate with the U.S. 3 Government's Contracting Officer's Representative to establish AF Form 3064 Contract 4 Progress Schedule (Section 00 6000, Exhibit A). If the performance period is greater than 59 5 days, AF Form 3065 Contract Progress Reports (Section 00 6000, Exhibit B) are mandatory (if 6 less than 59 days, Contract Progress Reports may also be required IAW Construction 7 Solicitation/Contract). The Construction Contractor shall coordinate construction activities with 8 all subcontractors and other entities involved to ensure efficient and orderly installation of each 9 part of the work. 10

1.04 PROJECT SUBMITTALS 11

A. The CES Form 66 Schedule of Material Submittals (Section 00 6000, Exhibit C) lists the 12 required material submittals and the quantity of each document to be submitted by the 13 Construction Contractor. Upon contract award the Construction Contractor and the U.S. 14 Government's Contracting Officer's Representative shall review the CES Form 66 and establish 15 submittal dates for each line item. The Construction Contractor is to complete a Material 16 Approval Submittal AF Form 3000 (Section 00 6000, Exhibit D) to be used as a transmittal for 17 the material submittal documents. The AF Form 3000 data shall include the line item number 18 and description that correlates with the CES Form 66 data. Blank AF 3000 Forms will be 19 provided to the Construction Contractor by the U.S. Government's Contracting Officer. The 20 Construction Contractor shall provide the completed (signed and dated) AF Form 3000 with 21 applicable attachments, in the quantities listed on the CES Form 66 and forward to the 22 appropriate party as identified at the preconstruction conference. The AF Form 3000 and 23 supporting documents are to be electronically transmitted by the Construction Contractor 24 (exception being drawings). The U.S. Government's Contracting Officer's Representative shall 25 review and forward to the U.S. Government's Contracting Officer for approval/disapproval. The 26 U.S. Government's Contracting Officer will make distribution to the appropriate parties. 27 Disapproved material submittals shall be re-submitted in accordance with the contract 28 document. Submittals received by sources other than the Construction Contractor will be 29 returned without action. 30

1.05 CONSTRUCTION STAKING 31

A. The Construction Contractor shall coordinate with the U.S. Government's Contracting Officer's 32

Representative in advance when sitework staking is to be accomplished in order to allow a 33 U.S. Government representative to be present on the work site. 34

1.06 LOCATING EXISTING UTILITIES 35

A. The Construction Contractor shall hire an independent company specializing in locating 36 existing utilities for the purpose of locating all utilities within the construction limits. This 37 includes, but is not limited to, public and privately owned utilities, including those owned and 38 maintained by the South Dakota Air National Guard. The Government is not responsible for 39 errors or omissions on drawings used for locating existing utilities. 40

1.07 CERTIFIED INDEPENDENT TESTING COMPANY 41

A. The Construction Contractor shall select and pay a Certified Independent Testing Agency to 42 perform all specified quality control services/tests. 43

1.08 REFERENCES TO MANUFACTURER’S PRODUCTS 1

A. When the Specifications or Drawings refer to a product of one or more manufacturers or a 2 product listing is provided indicating an equal or equivalent product; it shall be regarded as 3 establishing a desired standard of performance and quality only. This information shall not be 4 construed as limiting competition and the U.S. Government is making no warranty of 5 availability or fitness of these products for use. The contract will be governed by the “Materials 6 and Workmanship” clause (FAR 52.236-5) in the construction contract. 7

1.09 PRODUCT SELECTION 8

A. Product selection is governed by the Contract Documents and governing regulations, not by 9 previous project experience. Procedures governing product selection include the following: 10 Where labeling by a standards organization such as Underwriters Laboratories, Inc. is required 11 in the technical sections of the specification; the Construction Contractor shall submit proof 12 that the item that he proposes to furnish under this specification conforms to the standard listed. 13 The label of the listed organization shall be accepted as conforming to this requirement. In lieu 14 of the label, the Construction Contractor may submit a written certification from any nationally 15 recognized testing agency, adequately equipped and competent to perform such services, that 16 the item has been tested and conforms to the listed standards, including method of test, of the 17 listed organizations. 18

1.10 COMPLIANCE WITH STANDARDS 19

A. Compliance with Standards, Codes and Regulations: Where the specifications only require 20 compliance with an imposed code, standard or regulation; select a product that complies with 21 the standards, codes or regulations specified. 22

1.11 SOLE-SOURCE SERVICE VENDORS 23

A. The U.S. Government has service contracts with several vendors, such as direct digital controls 24 and security alarm systems. The Construction Contractor shall coordinate with the U.S. 25 Government's vendors. 26

1.12 WORK CLEARANCE REQUEST 27

A. Work Clearance Request: The Construction Contractor shall complete CES Form 18 Base Civil 28

Engineering Work Clearance Request (Section 00 6000, Exhibit E) to the U.S. Government's 29 Contracting Officer's Representative prior to start of Work. Construction Contractor shall 30 complete the form in its entirety and submit it to the U.S. Government's Contracting Officer's 31 Representative for approval and signature before any digging or excavation is started. The U.S. 32 Government's Contracting Officer’s Representative will complete Parts 1 and 2. The 33 Construction Contractor shall complete parts 4 through 8. Parts 9A through 9Q shall be 34 accomplished by the Construction Contractor by securing the review and sign-off by the 35 representative utilities/organizations. 36

1.13 HAZARDOUS MATERIAL CONTROL FORMS 37

A. Hazardous Material Control Form: The Construction Contractor shall provide a listing of all 38 hazardous materials that shall be used on the project utilizing the Hazardous Material Control 39 Form (Section 00 6000, Exhibit F). The Construction Contractor shall provide a completed 40 Hazardous Material Control Form to the U.S. Government's representative prior to beginning 41 any construction activities on the 1st day of each month for the duration of the construction 42 performance period and on the last day Construction Contractor is at the project site. 43

B. The Construction Contractor will establish hazardous material (HM) storage and distribution 1 system when HM is to be used. All HM required to support the contract will be reported to 2 Hazardous Material Pharmacy (HMP) using the Contractor HM Identification Form. Additional 3 HM needed by the Construction Contractor will be identified to the U.S. Government's 4 Contracting Officer’s Representative and approved by the HMP. 5

C. The Construction Contractor and all subcontractors that will use HM for their work must 6 register with the U.S. Government's Base HMP prior to start of work to support the 7 installation's compliance with Executive Order 12856 (requires Federal Facilities to comply 8 with the Emergency Community Right to Know Act). 9

1.14 EQUIPMENT/WARRANTY SUMMARY 10

A. The Construction Contractor shall furnish the U.S. Government with the equipment data and 11 warranties itemized on CES Form 2 Equipment/Warranty Summary. The CES Form 2 shall be 12 attached at the end of this section (Section 00 6000, Exhibit G). It shall be completed in its 13 entirety and submitted to the U.S. Government's Contracting Officer’s Representative prior to 14 Beneficial Occupancy (Final Inspection) and request for final payment. The Construction 15 Contractor shall attach to the summary all warranties, properly executed with the manufacturer 16 by the supplier, installer or subcontractor and equipment/material schedule for each of the 17 mechanical items provided. 18

1.15 CONSTRUCTION INFORMATION, REAL PROPERTY 19

A. The Construction Contractor shall complete and submit the Construction Information, Real 20

Property (Section 00 6000, Exhibit H) for use by the U.S. Government at project completion 21 and prior to final payment. The report data on Pages 2 through 8 must be in sufficient detail (by 22 breakdown of contract price to various elements of the contract work) to allow the U.S. 23 Government to apply such costs/values to its real property records. 24

1.16 AS-BUILT DOCUMENT SUBMITTALS 25

A. Maintain a clean undamaged set of blue/black line white prints of contract and shop drawings. 26

In RED, mark the set to show the actual installation where installation varies from the work as 27 originally shown. Mark or record all changes, modifications or revisions which occur during 28 construction. Mark whichever drawing is most capable of showing the conditions fully and 29 accurately. Where shop drawings are used record a cross reference at the corresponding 30 location on the contract drawings. Give special attention to elements that would be difficult to 31 measure at a later date. Mark new information that is important to the U.S. Government's 32 Contracting Officer's Representative that is not shown on the drawings. These drawings shall be 33 marked and certified As-Builts. These documents shall be turned over to the U.S. Government's 34 Contracting Officer's Representative with the Record Drawings. 35

1. Maintain on-site one set of the following documents; record actual revisions to the Work: 36

a. Drawings. 37

b. Specifications. 38

c. Addenda. 39

d. Change Orders and other modifications to the Contract. 40

e. Reviewed shop drawings, product data, and samples. 41

f. Field changes. 42

2. Ensure entries are complete and accurate, enabling future reference by the U.S. 43 Government. 44

3. Store redline/as-built documents separate from documents used for construction. 45

4. Record information concurrent with construction progress; maintain up-to-date 1 documentation. 2

B. As-Built Drawings and Shop Drawings: Legibly mark each item to record actual construction 3 including: 4

1. Measured depths of foundations in relation to finish first floor datum. 5

2. Measured horizontal and vertical locations of underground utilities and appurtenances, 6 referenced to permanent surface improvements. 7

3. Measured locations of internal utilities and appurtenances concealed in construction, 8 referenced to visible and accessible features of the Work. 9

4. Field changes of dimension and detail. 10

5. Details not on original Contract drawings. 11

C. Specifications: Legibly mark and record at each product section description of actual products 12 installed, including the following: 13

1. Manufacturer's name and product model and number. 14

2. Product substitutions or alternates utilized. 15

3. Changes made by Addenda and modifications. 16

1.17 RECORD DRAWINGS 17

A. Obtain a copy of the electronic construction drawings in AutoCAD format. Prepare record 18 drawings reflecting the redline/as-builts. 19

1. Ensure entries are complete and accurate, enabling future reference by the U.S. 20

Government. 21

2. Submit Record Drawings at project closeout prior to submitting application for final 22 payment. 23

1.18 TEMPORARY FACILITIES 24

A. The Construction Contractor shall provide its own utilities and billable meters for construction 25 of the project. The Construction Contractor is responsible for the cost of all utilities used on the 26 project, including but not limited to, water, sanitary sewer, electricity, and gas charges by the 27 utility companies or the U.S. Government for the duration of the project. The Construction 28 Contractor shall also be responsible for the costs of propane and heaters for temporary heating. 29

B. If the Construction Contractor receives permission from the U.S. Government to modify or 30 alter any existing utilities, the Construction Contractor is responsible for furnishing and paying 31 for any such modifications and all additional temporary utility services other than those already 32 identified above. This includes arranging with utility companies for these additional services. 33 Any expense incurred to gain access to utilities (temporary tap-ins, temporary meters, etc.) shall 34 be the responsibility of the Construction Contractor in accordance with the clause entitled 35 “Availability and Use of Utility Services” (FAR Clause 52.236-14). Any utilities modified by 36 the Construction Contractor will be returned to their original or final configurations before the 37 end of the contract. 38

C. The Construction Contractor is responsible for all costs of other temporary facilities such as 39 those described in this Section, Section 01 5000 - TEMPORARY FACILITIES AND 40 CONTROLS, Section 01 5713 - TEMPORARY EROSION AND SEDIMENT CONTROL, 41 SECTION 01 5813 - TEMPORARY PROJECT SIGNAGE, and SECTION 01 5950 - SAFETY 42

AND HEALTH. 43

1.19 WEATHER PROTECTION AND TEMPORARY HEATING 1

A. The Construction Contractor shall furnish, install and maintain temperature and weather 2 protection to include, but not necessarily limited to, temporary shelters, insulated mats and heat 3 as may be required to properly protect all parts of construction to include, but not necessarily be 4 limited to, underground utilities, footings, foundations, masonry and all above- and below-5 ground parts of the structure. The temporary shelters, insulated mats and heat will be provided 6 to ensure continuous progress is made on the project. The Construction Contractor shall pay for 7 all utility costs associated with the temperature and weather protection. The Construction 8 Contractor shall be responsible for repairs and maintenance to the temporary heating system or 9 units and protection during the period of building construction or remodeling. Where existing 10 or new air ducts are used; the Construction Contractor, at termination of such use, shall deliver 11 them to the U.S. Government in as-new condition by cleanout out the ducts and replacing all 12 filters. 13

1.20 TEMPORARY TOILET 14

A. The Construction Contractor shall provide appropriate temporary toilets for use by construction 15 personnel use. The toilets shall be kept in clean conditions and shall be serviced at appropriate 16 intervals. 17

1.21 TRASH 18

A. The Construction Contractor shall provide appropriate dumpsters for trash and ensure that 19 debris will not litter the project site or neighborhood. The Construction Contractor shall pay for 20 all trash services required for use on the project. 21

B. Recycling is required for this project. Refer to Section 01 7419 - CONSTRUCTION WASTE 22 MANAGEMENT AND DISPOSAL and Section 01 3329 - SUSTAINABLE DESIGN AND 23 REPORTING for additional requirements. 24

1.22 RECYCLED MATERIALS 25

A. Products with Recycled/Recovered Content shall be used as required by the Comprehensive 26

Procurement Guideline (CPG), published by the Environmental Protection Agency (EPA). 27 B. Overall Project Requirement: Provide products with recycled content such that the sum of post-28 consumer recycled content plus one-half of the post-industrial recycled content constitutes at 29 least 10 percent of the total value of all products installed, except mechanical and electrical 30 components. 31

1. The Construction Contractor to provide a summary of recycled/recovered product used at 32 project completion. 33

2. Specific Product Categories: Provide recycled content as specified elsewhere. 34

3. Sustainable Design Submittals: State unit cost, post-consumer and post-industrial content 35 percentages, quantity installed, total material cost, and total recycled content value; attach 36 evidence of contents from either manufacturer or an independent agency. 37

4. If the required materials are cost prohibitive or not available in this location, a justification 38 must be prepared and submitted to the U.S. Government's Contracting Officer's 39 Representative . The product listing is available on the EPA website, or by request from 40 the U.S. Government's Contracting Officer's Representative. 41

1.23 HISTORICAL AND ARCHAEOLOGICAL 42

A. If during the course of construction, evidence of deposits of historical or archaeological interest 43 is found, the Contractor shall cease operations affecting the find and shall notify the 44 Contracting Officer. Compensation to the Contractor, if any, for lost time or changes in 45

1.24 BURN PERMIT 3

A. One business day prior to any work requiring welding, soldering, or other work requiring an 4 open flame, the Contractor shall obtain a burn permit from the Base Fire Department. 5

PART 3 EXECUTION 7

3.01 SECURITY PROCEDURES 8

A. Provide security and facilities to protect the work, and the U.S. Government's operations from 9 unauthorized entry, vandalism, or theft. 10

B. Provide secure storage for materials for which the U.S. Government has made payment and 11 which are stored on site. 12

C. Limit access to the site to persons involved in the work. 13 D. Provide temporary fencing to secure access to the flight line and as required to secure the work. 14

1. Flight Line Temporary Security Fencing: 15

a. Utilize existing permanent security fencing and controlled gates to the extent 16 possible. 17

b. Other temporary security fencing shall be 6-foot tall, 2-inch chain-link fencing with 18 terminal posts at terminations and corners and line posts evenly spaced b no more 19 than ten feet apart. Bury posts no less than 30 inches deep encased in concrete. 20

c. Remove temporary security fencing, and posts; fill and compact holes after the 21 permanent security fencing is installed and gates are operational. 22

2. Temporary Construction Fencing: 23

a. Provide temporary construction fencing to secure stored materials and construction 24 equipment and to protect workers, Base personnel, consultants, and visitors. 25 E. Coordinate with the U.S. Government's security program. 26

1. All employees of Contractors, Subcontractors, and Suppliers that need access to the job 27 site will be required to submit a Consent for Background Check at least two business day prior 28 to arrival. This requirement extends, but is not limited to all labor, equipment operators, 29 delivery personnel, job foremen, inspectors, inclusive of anyone who requires site access. 30

3.02 CONTRACT DRAWINGS AND PROJECT MANUAL 31

A. Accompanying this Project Manual are the Drawings, which are complementary to this Project 32

Manual and intended to coordinate the work of this Project. Any work included in one and not 33 the other shall be fully executed as though included in both. 34

B. The Drawings and Project Manual for this Project are developed only for use as Contract 35 Documents and are not intended for any other use. Some documents and data may be released 36 to others only with written permission from the U.S. Government and with limitations on its 37 use and with certain conditions. Any supplemental electronic data or information obtained from 38 the U.S. Government for use by the Construction Contractor or its subcontractors and suppliers 39 is provided without warranty. Neither the U.S. Government nor its consultants shall be held 40 liable for the use of this information. 41

C. The Project Manual is divided into various divisions and sections for the convenience of the 42 Construction Contractor. Each division is not necessarily all-inclusive, and related items may 43

SUMMARY 01 1000 - Page 8 appear in various divisions. The Construction Contractor shall be solely responsible to furnish 1 and install all items shown on the Drawings, and/or included in the Project Manual regardless 2 of where they appear. 3

3.03 PROJECT STAFFING 4

A. The Construction Contractor shall provide a full time non-labor project superintendent who 5 must be approved by the U.S. Government's Contracting Officer's Representative. For the 6 duration of the project, the superintendent shall not be withdrawn, become part-time or replaced 7 without the written permission of the U.S. Government's Contracting Officer's Representative. 8

B. Security Checklist: The Construction Contractor shall fill out and submit the Consent for 9 Background Check (Section 00 6000, Exhibit I) for each employee that is to work within the 10 South Dakota Air National Guard facility including but not limited to the Construction 11 Contractor's administrative staff and workforce, delivery drivers, and subcontractors. Security 12 checklist must be received by the U.S. Government a minimum of seven (7) days prior to base 13 admittance. All construction personnel shall coordinate with the U.S. Government for the 14 procurement of Defense Biometric Identification System (DBIDS) access cards. 15

3.04 HOURS OF WORK 16

A. The Construction Contractor shall furnish sufficient forces to ensure the execution of the work 17 within the time stated. 18 B. Construction Contractor's Working Hours: The Construction Contractor working hours shall be 19 established to occur during weekdays, Tuesday through Friday, from 7:00am to 5:30pm except 20 on U.S. Government Holidays. 21

1. The Construction Contractor will not be allowed to work during weekends or outside of 22 the listed hours. 23

3.05 QUALITY CONTROL SERVICES 24

A. Where called for in specifications, and in the event that any material is questionable, the 25 Construction Contractor shall furnish acceptable proof as to its quality or equality to the 26 standards specified, including laboratory tests as may be requested by the U.S. Government to 27 establish such proof. 28

B. Duties of the Testing Agency: The Certified Independent Testing Agency, engaged to perform 29 inspections, sampling and testing of materials and construction specified in individual 30 Specification Sections, shall cooperate with the U.S. Government's Contracting Officer and the 31 Construction Contractor in performance of its duties, and shall provide qualified personnel to 32 perform required inspections and tests. 33

1. The Agency shall notify the U.S. Government's Contracting Officer's Representative and 34 the Construction Contractor promptly of irregularities or deficiencies observed in the 35 Work during performance of its services. 36

2. The Agency is not authorized to release, revoke, alter or enlarge requirements of the 37 Contract Documents, or approve or accept any portion of the Work. 38

3. The Agency shall not perform any duties of the Construction Contractor. 39 C. The Construction Contractor is responsible for scheduling times for inspections, tests, taking 40 samples and similar activities. When initial tests indicate non-compliance with the contract 41 documents, all subsequent re-testing occasioned by the non-compliance shall be performed by 42 the same testing laboratory and the costs thereof shall be paid by the Construction Contractor. 43

3.06 SUBMITTALS 1

A. Refer to Section 01 3000 - ADMINISTRATIVE REQUIREMENTS. 2

3.07 EXAMINATION OF PREMISES 3

A. Each Offeror shall inform itself of conditions under which the work is to be performed 4 concerning the project, the obstacles that may be encountered, and all other relevant matters 5 concerning the work to be performed. 6

1. The Construction Contractor shall locate all utilities in proximity to the project site 7 including U.S. Government-owned utilities such as ramp light and barrier feeds and 8 communications. Preliminary location information can be provided, however the 9 responsibility rests solely on the Construction Contractor to obtain the final locations of all 10 existing utilities. 11

B. No extra compensation will be allowed for failure to secure information available prior to 12 Offer. 13

3.08 WORK SEQUENCE 14

A. Construct the Work in a single phase. 15 B. Continuation of site utilities feeding other U.S. Government building facilities and operations 16 that are intended to remain in service is critical during construction. The Construction 17 Contractor shall coordinate with and provide sufficient notice to the U.S. Government of any 18 shutdowns needed to transfer or relocate service. 19

C. Coordinate construction schedule and operations with the U.S. Government. The Construction 20 Contractor shall give adequate advance notice to the U.S. Government of near completion of 21 each stage and readiness to start the next. Coordination shall include the following Base 22 departments: Contracting, Civil Engineering, Safety, Security, Fire Department, Environmental, 23 Bio-Environmental, Communications, Intel, Operations, and Maintenance as applicable to the 24 project. 25

3.09 PERMITS, FEES AND NOTICES 26

A. There are no plan check review fees. 27 B. There are no building permit fees. 28 C. The Construction Contractor and its subcontractors are responsible for securing and paying for 29 other permits and governmental fees, licenses and inspections necessary for the proper 30 execution and completion of the Work which are customarily secured after execution of the 31 Contract and which are legally required at the time the bids are received or negotiations 32 concluded. This shall include, but not be limited to: 33

1. Inspections and certificates from the Base Fire Department. 34

2. The Construction Contractor shall comply with and give notices required by laws, 35 ordinances, rules, regulations and lawful orders of the public authority bearing on the 36 performance of the Work. 37

3.10 REGULATORY, CODE, AND TECHNICAL STANDARDS 38

A. The following regulations, codes, and standards are applicable to this project: 39

1. 2015 International Building Code (IBC). 40

2. 2015 International Fire Code (IFC). 41

3. 2015 International Plumbing Code (IPC). 42

3.11 MEASUREMENTS 18

A. Before ordering any materials or doing any work, the Construction Contractor shall verify all 19 measurements at the project site and building and shall be responsible for the correctness of 20 same. No extra compensation will be allowed on account of difference between actual 21 dimensions and the measurements indicated on the drawings. Any difference, which may be 22 found, shall be submitted to the U.S. Government for consideration before proceeding with the 23 work. 24

3.12 ERRORS, OMISSIONS AND DISCREPANCIES 25

A. In the event of any error, omission or discrepancy in or between plans and specifications that 26 exists or appears to exist, the Construction Contractor shall not take advantage of discrepancy, 27 but notify the U.S. Government before submitting its proposal. 28

3.13 PUBLISHED SPECIFICATIONS AND STANDARDS 29

A. Any material or operation specified by reference to the published specification of a 30 manufacturer or other institute or industry specifications or standards shall comply with the 31 requirements of the specifications and standards listed. 32

3.14 BARRICADES AND PROTECTION OF PUBLIC 33

A. The Construction Contractor shall erect and maintain in good condition, suitable barricades for 34 the protection of the public into the area of work. All barricades shall be erected immediately 35 upon starting the work and shall be maintained throughout the construction period. Protection 36 and barricades shall meet the approval of the U.S. Government and local ordinances. 37

3.15 DELIVERY AND PROTECTION OF MATERIALS 38

A. Deliver all materials in the original packages, containers, crates and bundles, bearing the name 39 of the manufacturer and the brand. Except as otherwise specified herein, the mixing, 40 installation, and application of materials shall be in strict accordance with the printed directions 41 of the manufacturer and supplier. 42

B. Store materials off the ground, under cover from dampness. Exercise care in handling units to 1 avoid chipping, abrasion and breakage. Locate storage piles, stacks, or bins to protect materials 2 from damage, rust, contamination and avoid being disturbed. 3

C. Materials stored on-site or materials installed that are absorptive shall be protected from 4 moisture damage. 5

D. Building construction materials that show visual evidence of biological growth due to the 6 presence of moisture shall not be installed on the building project. 7

3.16 CLEAN UP 8

A. The site shall be kept in a clean and tidy condition at all times during the work and all rubbish 9 removed from the premises. No final payment will be made until all rubbish and debris has 10 been removed. No burning will be permitted on the premises. 11

B. Traffic areas will be broomed and cleaned at regular intervals to reduce the potential for 12 Foreign Object Damage (FOD) to aircraft. 13

3.17 HVAC SYSTEM BALANCING 14

A. The Construction Contractor shall employ a test and balancing company to complete the system 15 balancing in accordance with the project specifications. Note that the balancing by the 16 Construction Contractor must be in the presence of, and the method be approved by, the U.S. 17 Government through the Base Bioenvironmental Technician. 18

B. Refer to Section 01 3329 - SUSTAINABLE DESIGN AND REPORTING. 19

3.18 RESPONSIBILITY 20

A. The U.S. Government's review, approval, acceptance of, or payment for shop drawings or work 21 required under this contract shall not be construed to relieve the Construction Contractor of 22 responsibility, or operate as a waiver of any rights, under this contract. The Construction 23 Contractor shall be and remain liable to the U.S. Government in accordance with applicable law 24 for all damages to the U.S. Government caused by the Construction Contractor's negligent 25 performance of any of the work furnished under this contract. 26

3.19 CONSTRUCTION CONTRACTOR'S USE OF PREMISES 27

A. General: During construction, adjacent structures and drives will be occupied by the U.S. 28

Government. The Construction Contractor shall take the necessary means to ensure continuous 29 access to these existing facilities. Arrange for the use of the site and premises to allow: 30

1. Occupancy. 31

2. Work by others. 32

3. Work by the U.S. Government. 33

4. Use of the site and premises by building users and the public. 34

B. Materials storage areas shall allow for adequate circulation and safety. 35 C. Construction Operations: Limited to areas noted on Drawings. 36 D. Provide access to and from the site as required by law and by the U.S. Government: 37

1. Emergency Building Exits During Construction: Keep all exits required by code open 38 during construction period; provide temporary exit signs if exit routes are temporarily 39 altered. 40

2. Do not obstruct roadways, sidewalks, or other public ways without permit. 41 E. Existing building spaces may not be used for construction materials or equipment storage. 42

F. Utility Outages and Shutdown: 1

1. Limit disruption of utility services to adjacent existing facilities affected by project 2 construction activities to hours that they are unoccupied. 3

2. Do not disrupt or shut down life safety systems, including, but not limited to, fire 4 sprinklers and fire alarm system, without 7 days notice to the U.S. Government and Base 5 Crash/Fire Rescue. 6

3. In such cases where life safety systems need to be shut down, coordinate a fire watch with 7 the U.S. Government. 8

4. Prevent accidental disruption of utility services to other facilities. 9

3.20 SUBSTANTIAL COMPLETION 10

A. Preliminary Procedures: Before requesting inspection for Substantial Completion, complete the 11 following. 12

1. Submit specific warranties, workmanship bonds, maintenance agreements, final 13 certifications and similar documents. 14

2. Obtain and submit releases enabling the U.S. Government unrestricted use of the Work 15 and access to services and utilities; including occupancy permits, operating certificates 16 and similar releases. 17

3. Deliver tools, spare parts, extra stock, and similar items. 18

4. Complete final clean up requirements, including touch-up painting. Touch-up and 19 otherwise repair and restore marred exposed finishes. 20

5. Submit As-Builts and Record Documents. 21

6. Provide copies of Construction Contractor's Punch Lists indicating completed work. 22

B. Inspection Procedures: When the Project is complete and ready to turn over to the U.S. 23 Government, the Construction Contractor will coordinate with the U.S. Government to 24 establish a final inspection date. 25

1. If the inspection discloses no deficiencies other than minor punchlist items or items of 26 delayed completion awaiting seasonal opportunity, the U.S. Government's Contracting 27 Officer's Representative will notify the Construction Contractor, and a Certificate of 28 Substantial Completion will be completed. 29

2. If the inspection reveals major work items, the Construction Contractor is required to 30 correct the work. After the work is completed, another inspection will be scheduled. 31

3. The Construction Contractor shall be responsible for the costs of the U.S. Government and 32 its consultants' services for Substantial Completion re-inspections. 33

C. List of Incomplete Items: 34

1. A record of incomplete or unsatisfactory items of contract work will be prepared for the 35

Construction Contractor's use; however, this list is not intended to be comprehensive, and 36 do not relieve the Construction Contractor from responsibility to provide a complete 37 project. 38

2. Copies will be distributed by the U.S. Government to the Construction Contractor. 39

3. The U.S. Government will determine the amount of retainage withheld for incomplete 40 work. 41

3.21 FINAL ACCEPTANCE 42

A. Preliminary Procedures: Before requesting final acceptance and final payment, complete the 43 following. 44

1. Submit the final payment request with releases and supporting documentation not 1 previously submitted and accepted. Include certificates of insurance for products and 2 completed operations where required. 3

2. Submit an updated final statement, accounting for final additional changes to the Contract 4 Sum. 5

3. Submit a certified copy of the final inspection list of items to be completed or corrected 6 stating that each item has been completed or otherwise resolved for acceptance and the list 7 has been endorsed and dated by the U.S. Government. 8

4. Submit a final liquidated damages settlement statement. 9

5. Submit evidence of final, continuing insurance coverage complying with insurance 10 requirements. 11

6. If the inspection discloses no deficiencies other than minor punchlist items or items of 12 delayed completion awaiting seasonal opportunity, the U.S. Government's Contracting 13 Officer's Representative will notify the Construction Contractor, and a certificate of final 14 acceptance will be prepared. 15

7. If the inspection reveals major work items, the Construction Contractor is required to 16 correct the work. After the work is completed, another inspection will be scheduled. 17

8. The Construction Contractor shall be responsible for the costs of the U.S. Government and 18 its consultants' services for final completion re-inspections. 19

B. Re-inspection Procedure: The Work will be re-inspected upon receipt of notice that the Work 20 including inspection list items from earlier inspections, has been completed, except items 21 whose completion has been delayed because of circumstances acceptable to the U.S. 22 Government's Contracting Officer’s Representative. 23

1. Upon completion of re-inspection, a certificate of final acceptance will be prepared, or the 24

Construction Contractor will be advised that the work is still incomplete or the obligations 25 have fulfilled but are required for final acceptance. 26

a. If necessary, re-inspection will be repeated, however, additional inspections will be 27 billed to the Construction Contractor. 28

3.22 OPERATION AND MAINTENANCE MANUALS 29

A. Refer to Section 01 7800 - CLOSEOUT SUBMITTALS for O&M manual requirements. 30

3.23 EQUIPMENT MAINTENANCE SCHEDULE 31

A. Prepare and submit an equipment maintenance schedule in accordance with Section 01 7800 - 32

CLOSEOUT SUBMITTALS. 33

3.24 SUBSTANTIAL AND FINAL COMPLETION 34

A. Substantial and Final Completion for the project shall be accomplished no later than the dates 35 established by the Contract Documents. 36

1.02 CONSTRUCTION CONTRACTOR USE OF PREMISES 7

A. The Construction Contractor shall limit use of the premises to the work within designated site 8 areas as indicated to allow for continued U.S. Government operations in adjacent facilities. 9 B. Keep driveways and entrances serving the premises clear and available at all times to the U.S. 10

Government, U.S. Government employees, and visitors. Do not use these areas for parking or 11 storage of materials. 12

C. Schedule deliveries to minimize space and time requirements for storage of material and 13 equipment on site. 14

D. Maintain adjacent existing buildings scheduled to remain in use in safe and weather-tight 15 conditions throughout the construction period. Repair damage caused by construction 16 operations. Take precautions to protect the buildings, its occupants and the public during the 17 construction period. 18

E. Keep public areas in new construction, such as hallways, lobbies and restrooms, free from 19 accumulation of waste material, rubbish, construction debris and construction materials. 20

F. Very limited space on the premises can be made available for the Construction Contractor's 21 storage and related activities, provided that its use will not interfere with operations of the U.S. 22 Government. Arrange and gain approval for use of this space through the U.S. Government. 23

G. Existing materials and equipment that are removed as part of the construction operations, and 24 that are not reused or designated to be salvaged as U.S. Government property, shall become the 25 property of the Construction Contractor and shall be removed from the site. Storage or sale of 26 excess salvageable materials and equipment is not permitted on site. 27

H. At its own expense, the Construction Contractor shall provide a gate guard for access to 28 uncontrolled and unsecured gates. 29

1.03 GOVERNMENT OCCUPANCY 30

A. The U.S. Government will occupy adjacent existing buildings and site during the entire period 31 of construction. Cooperate with the U.S. Government's representatives during construction 32 operations to minimize conflicts and facilitate U.S. Government usage. Perform the Work in a 33 manner that does not interfere with the U.S. Government's operations. 34
