Installation and configuration and training at operator level of a netw orked access control system consisting of f ifty one (51) common access cards reader units at Puerto Rico Army National Guard (PRARNG) facilities buildings B552, 545 and 540 located at Columbus Street and Borinquener Road, Fort Buchanan, PR 00934. This action is being solicited pursuant to FAR 13 as a Request for Quote (RFQ). This solicitation is a total 100% set aside for Small Business concerns eligible f irms in the District of PR. Performance w ill be in the geographical area of Guaynabo, Puerto Rico. The North American Industry Classif ication (NAICS) Code is 561621 and the Size Standard for Small Business is $20.5M average annual revenue for the past three years. Project magnitude is betw een $300K and $400K. Persons intending on submitting an offer should attend the Pre-Bid Conference and Site Visit. Failure to submit a bid on all items shall result in rejection of the bid. Solicitation and all information, notices and amendments w ill be posted at w w w .febdbid.com. NOTES

1. All questions and requests for information regarding this Request for Quote (RFQ) must be received NOT

LATER THAN close of business of 31 August 2018 in order to minimize the need to extend the bid closing date. Questions shall be sent and answered through the Seller Questions module within www.Fedbid.com , others will not be considered.

2. Offeror’s attention is invited to the insurance requirement contained in this solicitation (Contract Clause FAR 52.228-5). Certification of the required coverage for the prime contractor shall be furnished prior to beginning work on this contract, and the Contracting Officer may request evidence of the required insurance at any time during the life the contract.

3. Reference Contract Clause 252.236-7008, CONTRACT PRICES – BIDDING SCHEDULES (DEC 1991).

The prices shown in the Bidding Schedule must reflect ALL costs involved in performing the work, as described in the plans and specifications.

4. The term “Bidding Schedule” shall also be construed to mean “Offer Schedule” or “Schedule”. The terms “bid” and “offer”, and “bidder” and “offeror” shall be construed as having the same meaning in this solicitation and resulting contract.

7. Government reserves the right to include additive bid items taken at time of award in the Base CLIN to facilitate and simplify schedule and payment processing.

(e) When completing the “Offeror” portion of the SF 1442 (Blocks 14 – 20), an official having the authority to contractually bind the company must sign the SF 1442 in accordance with FAR 4.102.

One copy of the SF1442 is required to have an original signature.

Section 00100 - Bidding Schedule/Instructions to Bidders

SECTION 00100

SECTION 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

1. SCOPE:

1.1. You are invited to submit a quote in response to our Request for Quote (RFQ) entitled) W912LR-18-R-

0038 entitled Access Control System Installation, at Fort Buchanan, Puerto Rico 00934.

1.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose quote, conforming to the Request for Quote, will be most advantageous to the Government, considering only price.

1.3. This solicitation is a 100% Total set-aside for Small Businesses concerns qualified contractors. In accordance with FAR Clause 19.1505 set aside procedures.

2. NOTICE OF PRE-BID CONFERENCE AND SITE VISIT:

2.1. A pre-bid conference will be conducted on August 27, 2018 at 09:30 AM for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. This conference will be held at Building 540 Main Conference Room in Fort Buchanan, PR 00934. Interested Contractors are highly encouraged to attend the pre-bid conference. The site visit will be held following the conference.

2.2. Due to security conditions, all offerors must register to attend this conference and site visit before close of business (4:00PM) EST (local time) August 24th 2018. Email the following information for all attendees to SFC Angel F. Solis, Contract Specicialist at the following addresses:

2.3. This information must be provided in advance, before close of business (4:00PM EST/local time)

August 24, 2018 in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base you must register to ensure adequate seating. The furnishing of the above information is voluntary; however, your failure to furnish all or part of the requested information may result in the Government’s denial of your access to the pre-proposal conference. This information will be provided to the Base Security Forces who will authorize your entrance to the site.

2.4. Visitors must pick up their passes at the Installation’s Main Entry Gate1 prior to arrival. You will be required to present the following information upon arrival: (1) Vehicle Registration, (2) Valid Drivers License, (3) Proof of Insurance for Vehicle, (4) Safety Inspection and Car Rental agreement if applicable. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such.

2.5. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

2.6. A record of the conference shall be made and furnished to all prospective bidders via posting at www.fedbid.com. The record will include minutes of the meeting, including questions (on a non-attribution basis) and answers.

3. FORMAL COMMUNICATION, OFFEROR EXPLANATIONS:

3.1. Submit all questions utilizing the seller questions module menu only within www.Fedbid.com and they will responded accordingly. All questions must come through the Contracting Office, others will not be considered. All feedback will be recorded in the archieves of the RFQ notice in www.Fedbid.com for every participant perusal.

1.1. Any explanation desired by an offeror regarding the meaning or interpretation of the solicitation, or quotes, drawings, specifications, etc. must be requested in writing and with sufficient time allowed for a reply to reach offereors before the submission of their quote.

1.2. All questions and requests for information (RFI) must be received NOT LATER THAN close of business (4:00PM EST/local time) August 31, 2018. OFFERORS ARE STRONGLY ENCOURAGED TO

2. 4. OFFER PREPARATION EXPENSES AND PRE-CONTRACT COSTS: This IFB does not commit the Government to pay costs incurred in preparation and submission of bids or for other costs incurred prior to award of a formal contract.

6. CLAUSES:

6.1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.

7. DISPOSITION OF UNSUCCESSFUL OFFERS:

In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful bids. The Government will destroy extra copies of unsuccessful bids. No destruction certificate will be provided.

8. OFFERORS QUALIFICATIONS:

To establish its responsibility, the apparent low offeror may be requested by the Government prior to award, to submit a statement regarding his previous experience in performing comparable work, his business and technical organization, financial and bonding resources and plant available to be used in performing the work. This action may be requested to determine if the contractor is responsible.

BASIS FOR CONTRACT AWARD:

This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2, as supplemented. This is a competitive LPTA best value source selection in which technical acceptability is considered the most important factor. By submission of its offer, the Offeror accepts all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. All technically acceptable offerors, with satisfactory past performance, shall be treated equally except for their prices.

Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation and conditions and provide complete accompanying rationale.

The Government intends to select ONE contractor for award of this effort.

For the purpose of award, the government shall evaluate offers based on the evaluation factors described below:

Factor 1 - Technical Acceptability:

Bidders must be qualified according to FAR 52.209-1, Qualification Requirements, and the attached Qualification Statement. All technically acceptable offerors (ability to deliver goods and/or services as required found compliant with the minimum salient characteristics of sought supplies or services) will be assessed solely on their capabilities to adhere to applicable performance work statements and or scope of work and their approaches on meeting final desired outcomes.

Factor 2 – Satisfactory Past Performance:

Have satisfactory past performance. Offerors shall not submit past performance information unless required as part of the response to Factor 3 – Price Evaluation. The government may seek relevant performance information on all responsive and otherwise Technically Acceptable Offerors through sources such as DCMA offices, CPARS or PPRS or other government data bases and other sources that are available. The government shall not be limited in its search for performance data. The offeror shall not submit performance data for this factor. When performance is evaluated, the outcome is either satisfactory or unsatisfactory. Unsatisfactory performance will disqualify an offeror from award.

Factor 3 - Price Evaluation.

The government shall conduct a price evaluation of all technically acceptable offers with satisfactory past performance including any option prices if applicable.

b. Rejection of Unrealistic Offers:

The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low in cost/price when compared to Government estimates, or are unbalanced, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.

c. Source Selection Decision:

The government shall select the source based upon a best value evaluation of the offeror’s technical acceptability, satisfactory past performance and price. The government shall choose the lowest realistically priced, responsive, with satisfactory performance, and technically acceptable offer for award.

First-tier subcontract means a subcontract awarded directly by the Contractor for the purpose of acquiring supplies or services (including construction) for performance of a prime contract. It does not include the Contractor's supplier agreements with vendors, such as long-term arrangements for materials or supplies that benefit multiple contracts and/or the costs of which are normally applied to a Contractor's general and administrative expenses or indirect costs.

Month of award means the month in which a contract is signed by the Contracting Officer or the month in which a first-tier subcontract is signed by the Contractor.

Total compensation means the cash and noncash dollar value earned by the executive during the Contractor's preceding fiscal year and includes the following (for more information see 17 CFR 229.402(c)(2)):

(1) Salary and bonus.

(2) Awards of stock, stock options, and stock appreciation rights. Use the dollar amount recognized for financial statement reporting purposes with respect to the fiscal year in accordance with the Financial Accounting Standards Board's Accounting Standards Codification (FASB ASC) 718, Compensation-Stock Compensation.

(3) Earnings for services under non-equity incentive plans. This does not include group life, health, hospitalization or medical reimbursement plans that do not discriminate in favor of executives, and are available generally to all salaried employees.

(4) Change in pension value. This is the change in present value of defined benefit and actuarial pension plans.

(5) Above-market earnings on deferred compensation which is not tax-qualified.

(6) Other compensation, if the aggregate value of all such other compensation (e.g., severance, termination payments, value of life insurance paid on behalf of the employee, perquisites or property) for the executive exceeds $10,000.

(b) Section 2(d)(2) of the Federal Funding Accountability and Transparency Act of 2006 (Pub. L. 109-282), as amended by section 6202 of the Government Funding Transparency Act of 2008 (Pub. L.

110-252), requires the Contractor to report information on subcontract awards. The law requires all reported information be made public, therefore, the Contractor is responsible for notifying its subcontractors that the required information will be made public.

(c) Nothing in this clause requires the disclosure of classified information.

(d)(1) Executive compensation of the prime contractor. As a part of its annual registration requirement in the System for Award Management (SAM) database (FAR provision 52.204-7), the Contractor shall report the names and total compensation of each of the five most highly compensated executives for its preceding completed fiscal year, if—

(i) In the Contractor's preceding fiscal year, the Contractor received—

(A) 80 percent or more of its annual gross revenues from Federal contracts (and subcontracts), loans, grants (and subgrants), cooperative agreements, and other forms of Federal financial assistance; and

(B) $25,000,000 or more in annual gross revenues from Federal contracts (and subcontracts), loans, grants (and subgrants), cooperative agreements, and other forms of Federal financial assistance; and
