ITEM(S) 0005 - PERFORMANCE WORK STATEMENT
Section SF 1449 - CONTINUATION SHEET
PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT
Tennessee National Guard
Statewide Food Supply Contract
1. The contractor will provide all personnel, labor, transportation, manifesting, and packaging of unprepared subsistence items for units in the Tennessee National Guard at various locations throughout Tennessee. The TNNG may add/remove locations for delivery with 30 days notice to the Contractor.
2. Abbreviations used in this Performance Work Statement:
Tennessee Army National Guard -- TNARNG United States Property and Fiscal Office -- USPFO Contracting Officer’s Representative -- COR Point of Contact -- POC Annual Training -- AT Inactive Duty Training --IDT United States Department of Agriculture -- USDA
United States Department of Commerce -- USDC Code of Federal Regulations -- CFR Technical Bulletin – Medical -- TB Med Performance Work Statement – PWS Army Food Management Information System - AFMIS
3. Contractor is to provide and deliver subsistence items, per the 15 Day Menu (Appendix A), to various units in the TNARNG (Appendix C). Condiments will be ordered for each unit as needed. The items, required quantities, required delivery date and delivery location will be listed in each delivery order.
4. IDT deliveries will usually be monthly to each unit location. A schedule of IDT menus for each month is in the IDT Ration Schedule FY12 (Appendix B). Units are given the option to order either a lunch menu or a dinner menu from either of the two days designated on the fifteen
(15) day menu. Units may select a sack lunch or commercially prepared sack lunch to replace the scheduled meal for the month (i.e., a sack lunch may be utilized in place of a lunch meal). Each unit is authorized one Holiday meal for either November or December and one short order meal per quarter.
5. Each unit may have up to 15 AT days per year, 3 meals per day. AT deliveries may be to the unit location or to a Training Site identified in the delivery order (Units typically conduct annual training in sites such as Ft. Chaffee, AR, Ft. Stewart, GA, Ft. Knox, KY, Ft. Campbell, KY and Camp Shelby, MS.).
6. Contractor shall appoint, in writing, a single Point of Contact (and alternate) for administration and problem resolution on the contract and will provide copies of the appointment to the Contracting Officer. The Contracting Officer will appoint the COR and the USPFO Ordering Official (and alternate) in writing and will provide copies of those appointments to the Contractor. Both parties will provide copies of new appointments within ten (10) calendar days of any changes.
7. The USPFO Ordering Official (or alternate) is the only person authorized to approve an order with the Contractor. Orders will be placed using the ordering program via the Internet. Each unit will create and submit its order via the internet; the USPFO Ordering Official (or alternate) will then review and approve the order prior to the contractor shipping the order. Contractor will provide alternate ordering systems via facsimile, e-mail, mail or telephone, in case Internet access is disrupted. In the case of such disruptions, the ordering activity shall not be without an on-line order entry system for more than forty-eight (48) hours. In addition, the contractor shall permit the contractor operating the full-time dining facility in Smyrna, TN to order under this contract at the same prices offered to the Government. The Government will not be billed for purchases made by the dining facility contractor.
8. Contractor shall provide an acceptable ordering software program to place orders via the Internet (must be compatible with Windows 7), any special equipment required, other than standard equipment required for Internet access, and training on using the ordering program for the USPFO Ordering Official and alternate. The contractor shall also coordinate with the
Government to schedule and provide at least two (2) training classes in each region of Tennessee, East, Middle and West for users at the unit level and a customer service number to address any technical questions thereafter. The program shall contain all items in the menus on the attached 15 Day Menu (Appendix A). The program must allow the person ordering at the unit to enter the number of soldiers and automatically compute the quantity of each item to feed that number of soldiers for that meal. The program must allow multiple meals per delivery, and compute total price for each delivery.
9. The TNARNG has transitioned to the Army Food Management Information System (AFMIS), which is the U. S Army’s food management and ordering system. At this point the TNARNG is ordering rations from the current prime vendor, and tracking headcount and expenditures within AFMIS; two parallel but separate systems. Upon award of contract, the contractor will immediately begin coordination with AFMIS program developers at Ft. Lee, VA. to integrate their ordering system into the AFMIS system, so that units of the TNARNG will be able to use one system only for both ordering rations and tracking data. Contractor will conform to AFMIS system requirements and standards in regard to establishing this interface, and AFMIS program managers, Ft. Lee, will be the controlling authority as to the format and content of any files/data/etc. AFMIS currently uses the STORES interface model. Establishing this system will be a joint project between contractor, AFMIS Program Managers and the TNNG. Timetable for actual transition will be determined by AFMIS Program Managers.
10. Contractor shall provide an emergency order request procedure in the event that food supply support is required for unscheduled feeding requirements. The procedure must include a 24 hour point of contact, delivery procedures and additional costs to the TNNG, if applicable. All standards stated in this PWS are applicable to emergency orders.
11. Subsistence items and products ordered and shipped in accordance with the 15 Day Menu (Appendix A) will be the same item as in initial proposal, to include brand name of product.
Any shortages identified upon delivery shall be corrected within twenty four (24) hours.
Substitutions are authorized when meeting the following criteria:
a. Substitutions must be of equal or better quality than the original item ordered, at no additional cost to the TNARNG.
b. Contractor must get approval of substitute items from the USPFO Ordering Official at least 24 hours prior to the required delivery date/time.
12. Pricing will be the same as the lowest price the Contractor charges their most valued customers and will comply with the gross margin schedule in the Contractor’s proposal. The contractor who receives the award shall also agree to sell subsistence to the vendor contracted to prepare meals in the Army National Guard’s dining facility in Smyrna, TN at the same price it provides subsistence to the units of the Tennessee Army National Guard.
13. Delivery will usually be monthly at each activity for IDT requirements and as required for AT requirements. Contractor will send a delivery schedule to the unit no later than 9:00 a.m. on the scheduled delivery day. This schedule will provide the estimated delivery times for all destinations concerned.
14. Acceptable Delivery Times:
a. IDT: Thursday, 7:00 a.m. to 3:00 p.m.
b. AT: Monday-Friday, 7:00 a.m. to 3:00 p.m. (usually Mon-Wed-Fri)
c. Discrepancies will be delivered between 7:00 a.m. to 3:00 p.m., no later than 24 hours from the original delivery date/time.
d. Emergency orders will be delivered at a mutually agreeable day/time, established when the order is placed.
e. Changes or deviations to the above delivery schedule must be approved by the USPFO Ordering Official at least 24 hours prior to the requested change in schedule.
15. The subsistence item to be delivered will meet health/sanitation standards required by the USDA and the Tennessee Department of Health. If items are delivered which are contaminated, spoiled, outdated, damaged, or discrepant, they will not be accepted. Items not accepted must be replaced by the contractor within 24 hours from the time of the original delivery, at no additional cost to the TNARNG. The delivery person will be considered the contractor’s representative and must adhere to all requirements in the contract.
16. Fluid dairy products and other dairy products. Dairy products shall have sufficient remaining shelf life commensurate with industry standard, and at a minimum, milk must have seven (7) days prior to expiration date indicated on manufacturer’s packaging.
17. All produce and produce items must meet all Federal, State, and Local industry standards, regulations, grading and guidelines governing growth, manufacturing, storage, packaging, distribution and transport and must meet specifications outlined on the 15 Day Menu (Appendix A). Produce must be free from decay, rotting and/or deterioration such as to make it unfit for consumption. Produce must be free from defects with the exception of very slight superficial defects provided these defects do not affect the general appearance, quality and presentation in the packaging. Produce will be clean and practically free of any visible foreign matter and free from pests and pest damage. Produce must be free of abnormal external moisture, foreign smell and/or taste.
18. All meat, poultry, fish and seafood items must meet all USDA, Federal, State, and Local industry standards, regulations, grading and guidelines governing growth, manufacturing, storage, packaging, distribution and transport. All items must also meet the specifications outlined in the 15 Day Menu (Appendix A).
19. Contractor shall develop and maintain a sanitation program to comply, at a minimum, with 21 CFR § 110; TB Med 530; USDA, Federal, State, and Local industry standards, regulations and guidelines to ensure temperature standards, sanitation, storage and warehousing practices for food are monitored and evaluated in accordance with accepted industry standards. All food items must be inspected and approved by the receiving facility’s authorized receiving official before final acceptance will be made.
22. Sanitary Inspection Requirement: Applicable food products ordered will originate either in an approved establishment listed in the directory of sanitary approved food establishments for Armed Forces Procurement or which has been inspected under the guidance of the USDC or the

25. Anti-Terrorism Security Measures General Information:
25.1 The contractor shall be aware that Anti-Terrorism Force Protection Measures are applicable to this contract. The Department of Defense Force Protection Condition (FPCON) System describes the progressive level of protective measures that are implemented by the Tennessee Army National Guard in anticipation of or in response to a terrorist threat or attack. The FPCON System is the principal means through which commanders apply an operational decision on how to best guard against the terrorist threat. The protective measures identified in the FPCON System assist commanders in reducing the risks of terrorist attacks and other security threats to Tennessee Army National Guard personnel, units and activities."
25.1.1 The contractor shall be required to obtain an installation vehicle pass that will require a current driver’s license, vehicle registration, and automobile insurance. Delivery trucks entering any installation of the TNARNG (specifically Volunteer Training Site, Smyrna, and Joint Force Headquarters, Houston Barracks, Nashville) will always be subject to search on entering/departing the site. Search includes the vehicle interior and exterior, backpacks and any other containers and bags.
a. Delivery personnel may require an escort while on government property, as determined by the Security Officer.
c. Any installation or armory location of the TNARNG may be closed without notice due to an elevated Force Protection Condition (FPCON) as determined by the Security Officer. Elevated Force Protection Condition is defined as a “Terrorist Event” or “Emergency” that may have life threatening effects. Under these conditions access to the location will be extremely limited and would not allow for commercial deliveries. In this case scheduled deliveries would be turned away, with no government liability
25.2 On request from the contracting officer, the contractor shall be required to complete
National Agency Check (NAC) SF85P. Obtain a Secret Clearance which is required to conduct inventories on ARNG installations.
25.3 COMSEC. All communications with DOD organizations are subject to communications security (COMSEC) review. The Contractor will be aware telephone communications networks are continually subject to intercept by unfriendly intelligence organizations.
DOD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from, or terminating at, DOD organizations.
Therefore, the contractor is advised that any time they place a call or receive a call they are subject to COMSEC procedures. The contractor shall assume the responsibility for ensuring wide and frequent dissemination of the above information to all employees dealing with DOD information. The contractor shall be aware of and abide by all Government regulations concerning the authorized use of the Government’s computer network, including the restriction against using the network to recruit Government personnel or advertise job openings.
25.4 During the performance of their contract, contractor employees may have access to or may generate unclassified information of a sensitive nature that is inappropriate for release to the public. Contractor shall implement information control procedures that require Government approval prior to the release of any information derived from the performance on the contract by the contractor or its employees, regardless of forum.

Contract employees who require access to the LAN shall register through the Contractor Verification System (CVS).
25.6 Contractor Verification System. The CVS program was implemented under Homeland Security Presidential Directive-12 (HSPD-12): Policy for Common Identification Standard for Federal Employees and Contractors. CVS was developed as a web-based tool designed to automate the application, validation and approval process for issuance for the Common Access Card (CAC) to eligible Department of Defense contractor personnel. The Contractor shall obtain the necessary clearance(s) and comply with all regulatory guidance. The Contractor shall be in compliance with HSPD-12 at all times and is subject to any future requirements to this directive.
http://www.whitehouse.gov/omb/memoranda/fy2005/m05‐24.pdf
Requirements vary from State to State but the Tennessee Army National Guard requires contractor application for a Common Access Card (CAC) to be processed through the Contractor Verification System (CVS). Within 10 working days of an awarded contract, the contractor shall submit a list of employees to the Contracting Officer who will be supporting the effort for input into the CVS. The list (on company letterhead) shall include the employee’s full name, address, date of birth, social security number, valid/current email address, security clearance, the contract number and end date. Once the Trusted Agent (TA) inputs their data into the CVS they will receive a system generated email to visit the CVS website and verify and update/add their information.
Within a few days after they complete the application (unless there are issues with their registration/NAC, etc.), they will be approved and will receive a second system generated email stating that their registration is complete. At that point they should visit the nearest CAC/DEERS office for issuance of a CAC card. Failure to respond to the first system generated email within five working days will remove them from the system. They will need to resubmit their contact details (any hard copy or electronic documentation will be shredded/deleted once they are input into the CVS). Subsequent listings of additions or deletions will be submitted to the Contracting Officer as employees are hired or released.
The Contracting Officer shall ensure that the Trusted Agent Security Manager (TASM) receives this information and the TASM will provide it to the appropriate TA. The Contractor shall comply with installation requirements for obtaining a CAC as defined in the contract instructions
25.7 The Government reserves the right to include the requirement of services during a crisis after award of the contract if deemed in the Government’s best interest. In the event of a declared National Emergency, the Contracting Officer may be required to stop work on this contract for security reasons. The contractor shall ensure the Contracting Officer has a current “Off Duty” contact name and telephone number at all times to facilitate notification.
