DEPARTMENT OF THE AIR FORCE

184TH MISSION SUPPORT GROUP

MCCONNELL AIR FORCE BASE KANSAS

22 August 2016

MEMORANDUM FOR 184 MSG/MSC

FROM: 184th Mission Support Group 52960 Jayhawk Drive McConnell AFB KS 67221-9000

SUBJECT: Justification for an Exception to Fair Opportunity – Programmable Logic Controls

1. The 184th Civil Engineer Squadron (CES) has a mission requirement to repair the PLC

(Programmable Logic Controls) for the generator located in Bldg. 16. This document constitutes justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-1. It is executed on behalf of 184th Civil Engineer Squadron.

2. The 184th Contracting Office proposes to procure by means of other than full and open competition, a firm fixed price open market contract.

3. The work to be performed is to replace and program building 16’s Generator PLC/number 11, bring the system back on line/fully functional at an estimated cost of $5,560.61.

4. The 184th Contracting Office intends to negotiate directly with Western Diesel Services, Inc. DBA:

CK Power Products for all the trouble shooting and repair of the PLC as outlined in the Statement of Work provided by the 184 CES.

a. FAR 13.501, only one responsible source and no other supplies or services will satisfy agency requirements.

b. 10 USC 2304(C)(1).

5. The Electrical Power Plant housed in building 16 is the sole source for sustained back up power to all 184th Intelligence Wing critical buildings/missions. This power plant/generators and switching gear provide the 184th Intelligence Wing its ability to power critical missions in the event of commercial power interruption. This PLC malfunction is putting the 184th in a vulnerable situation every minute it is down. The system, when working correctly, will automatically power up and seamlessly transition from commercial power to generator power. Currently, we are operating with two of the three generators. Our current load demands are supported by the two but in the event we exceed 400Kw we will not be able to support the demand in the event of a power outage. This generator/PLC issue causes the Wing’s critical missions to be susceptible to a power failure, which affects the Wing’s ability to perform real-time worldwide intelligence missions as well as the operation of the Air National Guard’s NOSC. This must be repaired immediately to ensure the missions maintain their integrity and comply with the directives to provide redundant power to these missions.

6. Due to only one responsible source being available, the contracting office intends to post our J&A within 14 days after award as required in FAR 13.501(a)(1)(iii).

7. Price to be determined fair and reasonable based upon government’s Independent Government Estimate (IGE) developed by the Civil Engineer Squadron. We will require a detailed breakdown of costs and enter into negotiations if prices seem unreasonable for the action being requested. Once troubleshooting is complete, we will require another breakdown of the estimated repairs to include travel/labor/engineering/programming hours. The experience of our CES electrical team gives us the ability to assess Western Diesel Services, Inc. DBA: C K Power Products proposal and make a determination of a fair and reasonable price.

8. The Generator (PLC) Programmable Logic Controls is a proprietary system that is designed by and installed exclusively by Kohler. Only Kohler certified dealers/contractors are authorized to work on their equipment. There are no other alternative companies to conduct the troubleshooting and repair.

Kohler/certified contractor are the only individuals certified to work on the PLC program and controls.

Past experience indicates that only the proposed contractor can provide the service, thus no in-depth market survey/research required.

9. As the 184th Civil Engineer Squadron Commander, I certify that the justification is accurate and complete to the best of my knowledge and belief as indicated by my signature block below.

10. As the contracting officer, I certify that this is true and accurate information and this procurement action has not been discussed with any potential contractor.
