SPECIAL CONTRACT REQUIREMENTS, STANDARD

AMENDMENT 0001

PART 1 GENERAL

1.1 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) (FAR

52.211-10)

The Contractor shall be required to:

(a) Commence work under this contract within 10 calendar days after the date the Contractor receives the Notice to Proceed;

(b) Prosecute the work diligently, and

(c) Complete the entire work ready for use not later than (AM#1) 48 calendar days after the date the Contractor receives the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

1.2 LIQUIDATED DAMAGES - CONSTRUCTION (SEPT 2000) (FAR 52.211-12)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $3,108.00 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

1.3 PHYSICAL DATA (APR 1984) (FAR 52.236-4)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys.

(b) Weather Conditions. Under ordinary conditions, the mean tidal range is about 1.0 foot. The height of tide is largely dependent on the force, direction, and duration of the wind. Strong northerly winds may depress the water surface as much as, and in some instances more than 1.0 foot below Mean Lower Low Water (MLLW), while southerly winds may raise the water surface as much as, and in some instances more than 3.0 feet above MLLW.

(c) Transportation Facilities. The immediate vicinity is served by railroad, highway, and deep and shallow draft channels. The Brownsville Ship Channel is accessible by water via the Gulf Intracoastal Waterway and the Gulf of Mexico. The Port of Brownsville

DOCUMENT 00 73 00.01 45 Page 3 and Port Isabel have public port facilities and are served by all-weather highways. The Port of Brownsville is also served by the Missouri-Pacific Railroad and Southern Pacific Railroad Lines.

Dredging and attendant plant may be brought to the work site via the Gulf Intracoastal Waterway.

(d)Condition of Channel. The general shape of the existing section of channel to be dredged is shown by cross sections on the Contract drawings.

(e) Channel Traffic. Channel traffic consists of deep draft ocean going vessels, small boats of various sizes, fishing vessels, recreational boats, ferries, tugs, tows consisting of a tug and one or more barges. Traffic will interfere with dredging operations to some extent.

1.4 QUANTITY SURVEYS (APR 1984) (FAR 52.236-16)

(a) Quantity surveys shall be conducted, and the data derived from these surveys shall be used in computing the quantities of work performed and the actual construction completed and in place.

(b) The Government shall conduct the original and final surveys and make the computations based on them. The Contractor shall conduct the surveys for any periods for which progress payments are requested and make the computations based on these surveys. All surveys conducted by the Contractor shall be conducted under the direction of the Contracting Officer, unless the Contracting Officer waives this requirement in a specific instance.

(c) Promptly upon completing a survey, the Contractor shall furnish the originals of all field notes and all other records relating to the survey or to the layout of the work to the Contracting Officer, who shall use them as necessary to determine the amount of progress payments. The Contractor shall retain copies of all such material furnished to the Contracting Officer.

1.5 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE(MAR 1995)

(a) This special contract requirement does not apply to terminations.

See 52.249-5000, Basis for Settlement of Proposals, and FAR Part 49.

(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the con-tractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP

DOCUMENT 00 73 00.01 45 Page 4

1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region VI. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the contracting officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

NOTE: A copy of EP 1110-1-8, "CONSTRUCTION EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE," is available at the following website:

http://www.publications.usace.army.mil/USACEPublications/EngineerPamphlets.aspx.

1.6 (SCR-S-102) CONTRACTOR SUPPLY AND USE OF ELECTRONIC SOFTWARE FOR

PROCESSING DAVIS-BACON ACT CERTIFIED LABOR PAYROLLS (April 2011)

The contractor is encouraged to use a commercially-available electronic system to process and submit certified payrolls electronically to the Government. The requirements for preparing, processing and providing certified labor payrolls are established by the Davis-Bacon Act as stated in FAR 52.222-8, PAYROLLS AND BASIC RECORDS and FAR 52.222-13, COMPLIANCE

WITH DAVIS-BACON AND RELATED ACT REGULATIONS.

If the contractor elects to use an electronic Davis-Bacon payroll processing system, then the contractor shall be responsible for obtaining and providing for all access, licenses, and other services required to provide for receipt, processing, certifying, electronically transmitting to the Government, and storing weekly payrolls and other data required for the contractor to comply with Davis-Bacon and related Act regulations.

When the contractor uses an electronic Davis-Bacon payroll system, the electronic payroll service shall be used by the contractor to prepare, process, and maintain the relevant payrolls and basic records during all work under this construction contract and the electronic payroll service shall be capable of preserving these payrolls and related basic records for the required 3 years after contract completion. If the contractor chooses to use an electronic Davis-Bacon payroll system, then the contractor shall obtain and provide electronic system access to the Government, as required to comply with the Davis-Bacon and related Act regulations over the duration of this construction contract. The access shall include electronic review access by the Government contract administration office to the electronic payroll processing system used by the contractor.

The contractor's provision and use of an electronic payroll processing

DOCUMENT 00 73 00.01 45 Page 5 system shall meet the following basic functional criteria: commercially available; compliant with appropriate Davis Bacon Act payroll provisions in the FAR; able to accommodate the required numbers of employees and subcontractors planned to be employed under the contract; capable of producing an Excel spreadsheet-compatible electronic output of weekly payroll records (format at http://rms.usace.army.mil/) for export in an Excel spreadsheet to be imported into the contractor's Quality Control System (QCS) version of Resident Management System (RMS), that in turn shall export payroll data to the Government's Resident Management System (RMS); demonstrated security of data and data entry rights; ability to produce contractor-certified electronic versions of weekly payroll data;

ability to identify erroneous entries and track the data/time of all versions of the certified Davis Bacon payrolls submitted to the government over the life of the contract; capable of generating a durable record copy, that is, a CD or DVD and PDF file record of data from the system database at end of the contract closeout. This durable record copy of data from the electronic Davis-Bacon payroll processing system shall be provided to the Government during contract closeout.

All contractor-incurred costs related to the contractor's provision and use of an electronic payroll processing service shall be included in the contractor's price for the overall work under the contract. The costs for Davis-Bacon Act compliance using electronic payroll processing services shall not be a separately bid/proposed or reimbursed item under this contract.

1.7 PERFORMANCE OF WORK BY THE CONTRACTOR (APR 1984) (52.236-1)

The Contractor shall perform on the site, and with its own organization, work equivalent to at least 65 percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

PART 2 PRODUCTS (Not Used)

PART 3 EXECUTION

3.1 PROTECTION OF SEA TURTLES

Observe the surrounding waters in the vicinity of its operations for the presence of sea turtles during dredging, placement, or travel between the Channel and ODMDS. If the Contractor encounters or observes sea turtles during its operations, the Contracting Officer shall be notified by the fastest available method. After investigation by the Contracting Officer, the Contractor will be instructed on further actions necessary.

3.1.1 Endangered Species Protection

Instruct personnel associated with this project of the potential presence of sea turtles in the area and the need to avoid collisions with these animals. Construction personnel shall be advised that there are civil and criminal penalties for harming, harassing or killing sea turtles which are protected by the Endangered Species Act of 1973. The Contractor will be held responsible for turtles harmed, harassed or killed as a result of dredging activities that are not conducted in accordance with these specifications.

3.1.2 Dredge Inspection

Prior to commencement of work or as soon as possible after work has begun, SECTION 35 20 23.14 45 Page 4 a hopper dredge inspection shall be performed using the Appendix A - COE SEA TURTLE INSPECTION CHECKLIST FOR HOPPER DREDGES, attached at the end of this Section. Documented deficiencies shall be corrected prior to proceeding with dredging. This type of inspection shall also be conducted as soon as possible following a turtle take by the dredge.

3.2 SEA TURTLE TRAWLING AND RELOCATION

Trawling shall be conducted to remove turtles from the Channel during dredging to help prevent entrainment by the dredge. Trawling shall be conducted for a period of 24 hours each day.

3.2.1 Initiation Of Trawling

Initiate trawling and relocation activity in the dredging area within 48 hours of being notified. Trawling shall continue until suspended by the Contracting Officer.

3.2.2 Trawling Requirements

Relocation trawling shall be conducted to remove turtles from the Channel during dredging to help prevent entrainment by the dredge. Trawling shall be conducted for a period of 24 hours each day. If two separate trawlers are required, they shall operate side-by-side as much as practicable. If multiple dredges are utilized, the trawler(s) shall be used for each dredge actively performing dredging operations. If the dredging operations are coordinated so that only one dredge is actively dredging, trawler(s) shall be required for only that dredge. If dredging operations cease for a period of 12 hours or more, relocation trawling shall be conducted a minimum of 4 hours prior to resuming of dredging operations. The trawler(s) shall be positioned ahead of the hopper dredge and as close to the hopper dredge as safely possible to give maximum coverage ahead of the dredging cut. The dredge and trawler(s) shall work closely together to implement techniques and procedures that will minimize the opportunity for turtles to enter the dredging path between the trawler(s) and dredge.

NOTE: TRAWLING ACTIVITIES, VESSELS, AND EQUIPMENT SHALL COMPLY

WITH THE CONTRACTOR'S ACCIDENT PREVENTION PLAN AND THE

REQUIREMENTS OF THE U.S. ARMY CORPS OF ENGINEERS SAFETY AND HEALTH

At least one crew member, who possesses the required permits for handling endangered species, experienced in sea turtle capture or is a National Oceanic and Atmospheric Administration (NOAA) Fisheries-approved observer, shall be on board the trawler during the trawl and act as the sea turtle trawling and relocation supervisor. Only a NOAA Fisheries-approved observer or observer candidate in training under the direct supervision of a NOAA Fisheries-approved observer shall conduct the sampling operations of tagging, measuring, and weighing tissue. Each turtle that is captured shall be identified, scanned for Passive Integrated Transponder (PIT) tags, measured, tagged, and released and the data recorded in Appendix C - SEA TURTLE TAGGING REPORT attached at the end of this Section. External tags shall also be noted and data recorded into the observer's log. Turtles shall be released at locations at least 3 nautical miles (nmi) south of the Channel centerline, at time intervals designated by the Sea Turtle Trawling and Relocation Supervisor who is proficient in the viable handling and relocating of sea turtles.

3.2.4.1 Weight and Size Measurements

Turtles shall be measured, tagged, and weighed when safely possible, prior to release. Turtle measurements shall be recorded and shall include, at a minimum, weight when possible, straight-line length, straight-line width, body depth, and tail length. Turtles shall be tagged with NMFS No. 681 Inconel tags in each of the front flippers according to National Marine Fisheries Service (NMFS) protocol. Aseptic conditions shall be maintained for tags and tag attachment. The Contractor shall be responsible for obtaining permits related to trawling from the appropriate State and Federal agencies. Aspects of trawling shall be coordinated with the U.S.

Army Corps of Engineers, Galveston District and contact Ms. Lisa Finn, phone (409) 766-3949 or e-mail lisa.m.finn@usace.army.mil.

3.2.4.2 Passive Integrated Transponder Tag Scanning

Sea turtles captured by relocation trawling or dredges shall be thoroughly scanned for the presence of Passive Integrated Transponder (PIT) tags prior to release using a scanner powerful enough to read dual frequencies, including but not limited to 125 and 134 kHz and read tags deeply embedded in muscle tissue, for example: those manufactured by Biomark or Avid.

Turtles that have been previously PIT-tagged shall never-the-less be externally flipper tagged. The data collected which includes PIT tag scan data and external tagging data, shall be submitted to NOAA, National Marine Fisheries Service, Southeast Fisheries Science Center, Attn: Ms. Lisa Belskis, 75 Virginia Beach Drive, Miami, Florida 33149. Data collected shall be submitted in electronic format within 60 working days to Lisa.Belskis@noaa.gov. 3.2.4.3 Passive Integrated Transponder Tagging

All live captured sea turtles shall receive PIT tags (in addition to the standard external tagging) prior to release; but only if the NMFS-approved protected species observer has received prior training in PIT tagging

SECTION 35 20 23.14 45 Page 6 procedures. PIT tagging of sea turtles is not required, if the observer does not have prior training or experience in these procedures.

(1) Sea turtle PIT tagging shall be performed in accordance with the protocol detailed at NMFS' Southeast Fisheries Science Center's Web page: https://www.galvestonlab.sefsc.noaa.gov/forms/observer/ (on SEFSC's "Fisheries Observers" Web page.)

(2) Passive Integrated Transponder tags used shall be sterile, individually-wrapped tags to prevent disease transmission. PIT tags shall be 125-kHz, glass-encapsulated tags-the smallest ones made. If scanning reveals a PIT tag and it was not difficult to find, then do not insert another PIT tag; simply record the tag number and location, and frequency, if known. If for some reason the tag is difficult to detect, for example: tag is embedded deep in muscle, or is a 400-kHz tag, then insert one in the other shoulder.

3.2.4.4 Tissue Sampling for Genetic Analyses

Live or dead sea turtles captured by relocation trawling and hopper dredging shall be tissue-sampled by NMFS-approved protected species observers prior to release. Sea turtle tissue samples shall be taken in accordance with NMFS' Southeast Fisheries Science Center's (SEFSC) procedures for sea turtle genetic analyses. The tissue samples taken shall be collected and stored properly and mailed within 60 days of the completion of the dredging project to: NOAA, National Marine Fisheries Service, Southeast Fisheries Science Center, Attn: Ms. Lisa Belskis, 75 Virginia Beach Drive, Miami, Florida 33149. Guidance can be found at NMFS' Southeast Fisheries Science Center's Web page:

3.2.4.5 Handling During Trawling

Sea turtles captured during relocation trawling shall be kept moist and shaded when possible, and handled using a method designed to ensure their safety and viability. Turtles shall be released over the side of the vessel, away from the propeller, only after ensuring that the vessel's propeller is in the neutral or disengaged position. For example: not rotating.

3.2.4.6 Take and Release Time During Trawling

Turtles shall be kept no longer than 12 hours prior to release and shall be released not less than 3 nmi from the dredge site. If two or more released turtles are later recaptured, subsequent turtle captures shall be released not less than 5 nmi away. Dredging operations shall not be hindered by the relocation of captured turtles. This can be accomplished by relocating turtles during the discharge cycle or by carefully transferring them to another vessel for transport to the release area to enable the relocation trawler to keep sweeping the dredge site without interruption of dredging.

3.2.4.7 Handling Fibropapillomatose Turtles

Anyone handling sea turtles infected with fibropapilloma tumors shall either:

(1) Clean all equipment that comes in contact with an infected turtle with a mild bleach solution before processing another turtle or

SECTION 35 20 23.14 45 Page 7

(2) maintain a separate set of sampling equipment for handling turtles displaying fibropapilloma tumors or lesions.

3.2.5 Reports

The results of each trawl shall be recorded in Appendix D - SEA TURTLE TRAWLING REPORT forms developed for this purpose. An example is attached at the end of this Section. A Final Report shall be prepared and submitted upon completion of dredging that summarizes the results and includes all forms, total trawling times, number of trawls, and number of captures.

Turtles captured during the trawling shall be measured and tagged in accordance with standard biological sampling procedures with sampling data recorded on the "Sea Turtle Tagging Report" forms developed for this purpose. An example is attached as Appendix C at the end of this Section.

Captured sea turtles shall be relocated south of the work area at least 3 nmi from the location recorded on the Sea Turtle Tagging and Relocation Report Form. Submitted copies of these forms shall be legible with a minimum of smudges or blackened areas.

3.2.6 Repair and Replacement of Damaged Trawl Nets

At the time of mobilization, the Contractor shall provide trawl nets that meet the requirements specified in Appendix B - TURTLE TRAWL NET SPECIFICATIONS at the end of this Section. Trawl nets that are damaged shall be repaired or replaced by the Contractor at no additional expense to the Government. Tools, supplies, and materials for repairing nets shall be kept aboard the trawler. If trawl nets are damaged, repair or replacement shall be attempted as soon as possible to ensure that dredging work is not adversely delayed due to trawler down-time. The Contractor shall have at least one set of replacement nets immediately available at all times. It is recommended that a second set of replacement nets be available aboard the trawler.

3.2.7 Suspension of Dredging and Relocation Trawling

If nets become torn or the equipment breaks down causing the trawler to leave the area where dredging is underway, the dredge may continue to operate for up to 48 hours, as long as no turtles are taken and subject to the discretion of the Contracting Officer. If there are dangerously high seas that can cause the trawler to leave the dredging area, the dredge may continue to operate as long as no turtles are taken and as directed.

3.2.8 Water Quality and Physical Measurements

Water temperature measurements shall be taken at the water surface each day using a laboratory thermometer. Weather conditions shall be recorded from visual observations and instruments on the trawler. Weather conditions, air temperature, wind speed and direction, sea state-wave height, and bottom type shall be recorded on the Sea Turtle Trawling Report appended as Appendix E to the end of this Section. High and low tides shall also be recorded.

3.7 TURTLE MONITORING EQUIPMENT

3.7.1 Sea Turtle Requirements

Sea Turtle Requirements are in effect year round. The dredge shall have 100 percent in-flow screening of dredged material. Also, when possible, hopper overflow screening shall be correctly installed as a secondary measure. If conditions prevent 100 percent inflow screening, inflow screening may be reduced gradually, as further detailed in the following Subparagraph, but 100 percent overflow screening is then required. At commencement of dredging operations, the screens shall have openings no greater than 4-inch by 4-inch. The screens shall sample 100 percent of the in-flow or overflow, as applicable, and shall remain in place for the duration of dredging activities. The screen structure shall be designed to withstand the forces exerted on the screens during dredging operations.

Screen design and operation shall be approved prior to commencement of dredging. No dredging can proceed until screen design and operation is installed and approved. When detected, damaged screens shall be repaired by the Contractor before commencing dredging on the load.

3.7.2 Inflow Screens

The hopper's inflow screens shall have 4-inch by 4-inch screening. If the observers and the draghead operator determine that the draghead is clogging and reducing production substantially, the screens may be modified sequentially as follows: mesh size may be increased to 6-inch by 6-inch, then 9-inch by 9-inch, then 12-inch by 12-inch openings. Further clogging or other difficulties may compel partial or complete removal of the screening altogether, in each of these situations, effective 100 percent overflow screening is mandatory.
