Justification for an Exception to Fair Opportunity
1. Contracting Activity: U.S. Army Corps of Engineers (USACE), Humphreys Engineering Support Center (HECSA), 7701 Telegraph Road, Alexandria, Virginia 22315.
2. Description of Action: A new Firm‐Fixed‐Price, Term Form Task Order (TO), issued against the IWR Water Resources ‐ Indefinite Delivery/Indefinite Quantity (IDIQ) contract number W912HQ‐16‐D‐0003 with:
CDM FEDERAL PROGRAMS CORPORATION (CDM Smith) 1050 N Reed Station Rd, Ste D Carbondale, IL 62902‐7305
The Period of Performance will be approximately 120 days from the date of award. The estimated amount of this Task Order is $221,206.25.
3. Description of Supplies/Services: The purpose of this Task Order (TO) to provide contracted professional service support to the Government for operations and maintenance (O&M) of the Civil Works Business Information Link (CWBI) and its components. Activities within major task areas will be evaluated and prioritized by the CWBI Program Manager and CorpsMap Project Manager in consultation with the Contractor. Activities will reflect program requirements, user issues, and available resource levels. Four major task areas are to be managed through this TO and are listed below:
Data Updates and Maintenance – This task addresses general refresh and update activities. The Contractor will refresh all production modules and perform regular quality assurance evaluations to insure system integrity.
User Assistance – The Contractor will provide timely and responsive user assistance for all members of the USACE community relative to the Operations and Maintenance Business Information Link (OMBIL) web site for data entry and CWBI analytical modules.
General OLAP and OLTP Operations and Maintenance – The On‐Line Analytical and On‐ Line Transactional (OLTP) modules for all O&M business areas are to be evaluated for functionality under this task. All components including data entry screens, reports, user manuals and work flow diagrams are to be validated.
Project Delivery Team (PDT) Support. Contractor will provide support to various Product Development Teams (PDTs) that the CWBI team is involved in. These PDTs consist of both users and national business line managers that guide the direction of the various modules inside CWBI.
4. Authority Cited: Section 41 U.S.C. 253j (b), as implemented by the Federal Acquisition
Control No: 16-010
Regulation (FAR) Subpart 16.505(b) (2) (i) (B), entitled “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized”.
Reason for Authority Cited:
CDM Federal Solutions, dba CDM Smith, under Contract W912HQ‐10‐D‐0004, Task Orders 0145 and 0172, has gained expertise in all associated CWBI analytical modules. No other firm under this IDIQ MATOC has this level of expertise in CWBI systems. CDM Smith has the unique ability to perform both database operations and maintenance, and data manipulation for decision support. No other IWR Water Resources IDIQ Task Order contract holder currently possesses the necessary knowledge to start work immediately as is needed to avoid a serious lapse in CWBI coverage. This TO is intended to serve as a “bridge” contract until this requirement can be subdivided into discreet modular components that other firms may be able to support, thereby creating a more competitive future environment. See section 7.
5. Fair and Reasonable Cost Determination: “The Contracting Officer hereby determines that the anticipated cost to the Government for this contract action will be fair and reasonable.
Price reasonableness will be determined by comparison to the pre‐approved Labor rates published within the IDIQ base contract and negotiations, if necessary, for any associated Other Direct Costs (ODCs).
6. Other Facts supporting the justification:
Each of the Task Orders listed below was awarded to CDM Smith in support of CWBI
W912HQ‐10‐D‐0004‐0172 ‐ awarded 27 March 2015 in the amount of $882,183.51
W912HQ‐10‐D‐0004‐0172 ‐ amended 11 September 2015 increased by $295,011.33 and POP to 29 February 2016
W912HQ‐10‐D‐0004‐0172 ‐ amended 29 February 2016 no cost time extension until 25 May 2016
W912HQ‐10‐D‐0004‐0145 – awarded 17 January 2014 in the amount of $1,176,976.94
W912HQ‐10‐D‐0004‐0145 – amended 21 February 2015 no cost time extension until 31 March 2015
7. Actions to overcome barriers that led to this Exception:
IWR is in the process of creating new Performance Work Statements (PWSs) that will separate the Database Operations and Maintenance portion of the CWBI support from the Data Manipulation and Decision Support Systems components. IWR plans to add Geospatial Analysis and Support functions to the CWBI which should result in the ability to compete these separate requirements among the current IWR Water Resources IDIQ contract holders, including possible set‐asides for the Small Business awardees.
