SECTION 00 70 00 - CONDITIONS OF THE CONTRACT

52.217-5 EVALUATION OF OPTIONS (JUL 1990)
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor anytime between date of contract award and 28 February 2019. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

The following have been modified:
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the days specifed in the chart below for each project. The time stated for completion shall include final cleanup of the premises.

If FL037 Electrical Reset is not exercised until after task order award, a separate pre-construction kick-off and NTP will be issued and it will have its own separate completion date, which is 240 calendar days from NTP. The option will not extend the established completion date of the base bid. Those established dates will become interim completion milestones. Interim evaluations will be issued and entered into the Contractor Performance Assessment Reporting System (CPARS) to appraise performance with regard to meeting interim completion milestones within the required time periods. These interim evaluations will contribute to the final performance rating.
HVAC System Testing: In the event the Heating and/or Air Conditioning Systems cannot be tested at or near design temperatures during the above period, beneficial occupancy and use of the facilities may be accepted and final testing and adjustments of the heating and/or air conditioning deferred as specified in the appropriate testing clauses of the Technical Provisions. The HVAC Testing that the Contractor schedules after substantial completion has a value to the Government of 10 percent of the value of the equipment to be tested. The Contractor shall reserve that amount to be paid on any equipment that will require testing after substantial completion pursuant to the above referenced specification paragraph.
