FY 18 UPPER HARBOR DREDGING:
The w ork consists of maintenance dredging approximately 1,720,000 cubic yards of unclassif ied material from Charleston Upper Harbor, TC
Dock, MARAD Piers S, T, U, and Joint Base Charleston Channel, Charleston and Berkeley Counties, South Carolina shall be deposited in the
Clouter Creek Placement Area, Middle Cell and Highw ay Cell, and Joint Base Charleston Placement Area. The w ork includes complying w ith the requirements of the Endangered Species Act and the Marine Mammals Protection Act.
MAGNITUDE OF WORK: $5,000,000 TO 10,000,000
The North American Industry Code (NAICS) is 237990, Other Heavy and Civil Engineering w ith a SBA Business Size Standard of
$27,500,000.00 for Dredging.

In compliance with the solicitation, the bidder agrees, if this bid is accepted within 60 calendar days from the date specified in the solicitation for receipt of bids, to furnish any or all items upon which prices are bid at the price set opposite each item, delivered at the designated point(s), within the time specified in the Schedule.

52.216-1 TYPE OF CONTRACT (APR 1984)
The Government contemplates award of a Firm Fixed Price contract resulting from this solicitation.

52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
52.233-2 SERVICE OF PROTEST (SEP 2006)
(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from

52.249-5000 BASIS FOR SETTLEMENT OF PROPOSALS
Basis for Settlement of Proposals Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis under FAR 49.206‐2(b). In evaluating a terminations settlement proposal using the total cost basis, the following principles will be applied to determine allowable equipment costs:
(1) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the contractor's accounting records to determine total actual equipment costs.
(2) If equipment costs have been allocated to a contract using predetermined rates, those charges will be adjusted to actual costs.
(3) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.
(4) Ownership costs (depreciation) will be determined using the contractor's depreciation schedule (subject to the provisions of FAR 31.205‐11).

FAR 52.211-0010 - COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract (see supplemental instructions), (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than (see supplemental instructions). The time stated for completion shall include final cleanup of the premises.

Supplemental Instructions:
1. Charleston Upper Harbor (Shoals 1-8) AND JOINT BASE CHARLESTON (JBC 4 & JBC 4A)
(a) Prosecution of Work
The Contractor will be required to commence dredging under this contract within 30 calendar days after the date of receipt by him of Notice to Proceed. The Contractor will be required to prosecute the said work at an average rate of not less than 300,000 cubic yards per month and to complete it within the number of days after the limiting date fixed for commencement; determined by applying the average monthly rate above stipulated to the total quantity of material actually removed and to be paid for under the contract; provided that the quantity of material removed in any one month shall in no case be less than 250,000 cubic yards; provided, further that no waiver by the Contracting Officer of any failure of the Contractor to make in any month or series of months the rate of progress required by this paragraph shall be construed as relieving the Contractor from the obligation to make up the deficiency in future months and to complete the entire work within the time allowed by the contract. The time thus determined for completion shall include final clean-up of the premises.
(b) Continuously Working
The Contractor shall maintain adequate plant on site to have an average production rate of 300,000 cubic yards per month and shall work continuously for every consecutive calendar month until the project is completed.
The number of days allowed for completion after the limiting date fixed for commencement shall be determined by applying the average monthly rate above stipulated to the total quantity of material actually removed and to be paid for under the contract; provided, further that no waiver by the Contracting Officer of any failure of the
Contractor to make in any month or series of months the rate of progress required by this paragraph shall be construed as relieving the Contractor from the obligation to make up the deficiency in future months and to complete the entire work within the time allowed by the contract. The time thus determined for completion shall include final clean-up of the premises.
(c) Performing Dredging Work for Others Outside the Requirements of this Contract
In the event the Contractor elects to perform dredging work contiguous to the project area but outside the requirements of this contract, (i.e. for Federal, state or local activities - “third party”) the Contractor shall have approval of the Contracting Officer prior to moving off construction site to perform third party work.
Reasonable adjustments in time may be granted the Contractor to perform this work at the discretion of the
Contracting Officer. Time allotted may include time to relocate pipelines, dredge plant, and to perform the third party work; however, it shall not include time for plant maintenance or similar delays that postpone resumption of work under this contract. The Contractor shall also be responsible for the cost of any additional surveys required due to delays caused by this interruption of work.
2. TC Dock AND MARAD PIERS S, T, U
(a) Prosecution of Work
The Contractor will be required to commence dredging work under this contract when directed by the
Contracting Officer and to prosecute the dredging work at an average rate of 3,000 cubic yards per day and to complete it within the number of days allowed after the commencement of dredging on this shoal.
(b) Continuously Working
The Contractor shall maintain adequate plant on site to have an average production rate of 3,000 cubic yards per day and shall work continuously for every consecutive calendar day until the project is completed.
The number of days allowed for completion after the limiting date fixed for commencement shall be determined by applying the daily rate above stipulated to the total quantity of material actually removed and to be paid for under the contract; provided, further that no waiver by the Contracting Officer of any failure of the Contractor to make in any daily or series of daily the rate of progress required by this paragraph shall be construed as relieving the Contractor from the obligation to make up the deficiency in future days and to complete the entire work within the time allowed by the contract. The time thus determined for completion shall include final clean-up of the premises.
(c) Scheduling of Dredging
TC DOCK
Due to regular scheduled TC Dock usage, the dredge may have delays, required pull offs, standby time, etc., until TC Dock is clear of vessels and available for dredging work. The Contractor shall coordinate dredging work with the Joint Base Charleston personnel and schedule the dredging of the TC Dock around the pier usage.
In addition, the Contractor must comply with Joint Base Charleston safety and security requirements which could result in temporary movement of all vessels to a safe zone, etc.
MARAD Piers S, T, U
Due to regular scheduled pier usage, the dredge may have delays, required pull offs, standby time, etc., until piers are clear of vessels and available for dredging work. The Contractor shall coordinate dredging work with
MARAD personnel and schedule the dredging of the piers around vessel usage. In addition, the Contractor must comply with MARAD safety and security requirements which could result in temporary movement of all vessels to a safe zone, etc.
(d) Performing Dredging Work for Others Outside the Requirements of this Contract:
In the event the Contractor elects to perform dredging work contiguous to the project area but outside the requirements of this contract, (i.e. for Federal, state or local activities - “third party”) the Contractor shall have approval of the Contracting Officer prior to moving off construction site to perform third party work.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1907.00 calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
52.211-18 VARIATION IN ESTIMATED QUANTITY (APR 1984)
If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
52.236-1 PERFORMANCE OF WORK BY THE CONTRACTOR (APR 1984)
The Contractor shall perform on the site, and with its own organization, work equivalent to at least 40 percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting
Officer determines that the reduction would be to the advantage of the Government.
52.236-4 PHYSICAL DATA (APR 1984)
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) The indications of physical conditions on the drawings and in the specifications are the results of surveys performed for the Charleston District, Corps of Engineers and site investigations performed by Charleston District personnel.
(b) Weather conditions, transportation facilities and other pertinent information are specified in Section 01 10 00, Paragraph “PHYSICAL CONDITIONS AND DATA”.
DFARS 252.236-7001 CONTRACT DRAWINGS AND SPECIFICATIONS (AUG 2000)
(a) The Government will provide the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.
(b) The Contractor shall-
(1) Check all drawings furnished immediately upon receipt;
(2) Compare all drawings and verify the figures before laying out the work;
(3) Promptly notify the Contracting Officer of any discrepancies;
(4) Be responsible for any errors which might have been avoided by complying with this paragraph (b);
and,
(5) Reproduce and print contract drawings and specifications as needed.
(c) In General—
(1) Large scale drawings shall govern small scale drawings; and
(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.
(d) Omissions from the drawings or specifications or the misdescription of details of work which are manifestly necessary to carry out the intent of the drawings and specifications, or which are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

DFARS 252.236-7004 PAYMENT FOR MOBILIZATION AND DEMOBILIZATION
(a) The Government will pay all costs for the mobilization and demobilization of all of the Contractor's plant and equipment at the contract lump sum price for this item.
(1) Sixty (60%) percent of the lump sum price upon completion of the Contractor's mobilization at the work site.
(2) The remaining forty (40%) percent upon completion of demobilization.
(b) The Contracting Officer may require the Contractor to furnish cost data to justify this portion of the bid if the
Contracting Officer believes that the percentages in paragraphs (a)(1) and (2) of this clause do not bear a reasonable relation to the cost of the work in this contract.
(1) Failure to justify such price to the satisfaction of the Contracting Officer will result in payment, as determined by the Contracting Officer, of-

Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or
