SECTION 00 00 00 - PROCUREMENT AND CONTRACTING REQUIREMENTS

SUMMARY OF CHANGES

SECTION 00 70 00 - CONDITIONS OF THE CONTRACT

The following have been modified:

52.236-4 PHYSICAL DATA (APR 1984)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) Physical Conditions. The physical conditions indicated on the drawings and in the specifications are the result of site investigations by surveys and widely spaced in-situ test borings and soundings. Soil test boring results and laboratory soils test data are also included on the drawings. Materials within the disposal area (used for borrow) consist of sands, silts, and clays containing organics. Water levels are known to vary depending on the location and the materials present. Contractors are strongly encouraged to visit the work site and determine for themselves the characteristics of the project site and the extent of the work to be performed.

Survey information shown on the drawings was reviewed and considered accurate at the time the survey was performed. The survey information for the dike will most likely no longer be accurate upon contract award. The interior of the containment area may also differ from the survey data indicated. Neither are changed conditions. The Contractor acknowledges that the materials placed within the interior were hydraulically placed dredged materials from the Savannah River. These materials are consistently undergoing drying and consolidation at a rate of about one-tenth of a foot per month, and will likely exhibit similar properties during the life of this contract. The Contractor shall obtain his own survey data after notice to proceed and substitute such for use during borrow harvesting and project construction.

With the exception of the above mentioned interior elevation difference to be acknowledged by the Contractor prior to beginning this project, the Contractor shall promptly, and before the conditions are disturbed, give written notice within three days to the Contracting Officer noting (1) any subsurface or latent physical conditions at the site which differ materially from those indicated herein or elsewhere in this contract, or (2) unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inherent in work of the character provided for in the contract.

The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If conditions do materially so differ and cause an increase or decrease in the Contractor’s cost or time required for performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made and the contract modified in writing accordingly.

(b) Weather Conditions.

(1) The annual normal rainfall (1950-2004) at the Savannah/Hilton Head International Airport, Savannah, GA, approximately 8 miles west of the site, is 49.7 inches. (Average annual 1961-1990: 48.3 inches).

(A) Record (40 years)

Maximum Monthly – 20.1 inches July 1964

(B) Record (40 years)

Minimum Monthly -- 0.02 inch October 1963

(C) Record (40 years) Maximum 24 Hour – 7.04 inches August 1971

Normally about 25 inches of rain falls during the thunderstorm season of 15 June through 15 September. The remainder of the annual rainfall, produced principally by squall-line and frontal showers, is spread over 9 months with a minor peak in March. Considerable periods of fair, mild weather are experienced in October, November, April, and to a less extent, in May. Snow is a rarity and even a trace does not occur on an average of once a year. The greatest recorded fall was 3.6 inches in February 1968. Severe tropical storms affect this area about once in 10 years. Rainfall from these storms constitutes our heaviest sustained precipitation.

Instances of this are the 22.79 inches in August 1898, and 22.88 inches in September 1924, most of which was from tropical storms, (1950-85) 20.10 inches in July 1964.

(2) The average normal monthly temperature at Savannah, Georgia, is 66.3 degrees F. with seasonal averages as follows:

Season Degrees Fahrenheit Winter 51 Spring 66 Summer 81 Fall 68

Extreme temperatures are as follows (normals based on 1951-80):

(A) Normal Daily Maximums ------ 105 degrees F. July 1986

(Normal maximum 90.8)

84 degrees F. January 1957 (Normal maximum 60.3)

(B) Normal Daily Maximum 76.1 degrees F.

(C) Daily Minimums ------ 3 degrees F. January 1985

(Normal minimum 37.9)

61 degrees F. July 1972 (Normal minimum 71.5)

(D) Average Normal Daily Minimum 55.1 degrees F.

Average Normal Daily Maximum 76.7 degrees F.

(E) Record (40 years) Maximum -- 105 degrees F. July 1986

(F) Record (40 years) Minimum -- 3 degrees F. January 1985

(3) The annual average wind speed is 7.9 mph, southwest, with the highest monthly mean occurring in February (NE) and March (WNW) at 9.2 mph, and the lowest monthly mean in August at 6.6 mph, southwest. Extreme winds (fastest 1 minute value) vary from 46 mph west in March 1981 to 68 mph southwest in May 1984.

(c) Transportation Facilities. Railway facilities are available at Savannah, Georgia. Areas of work are accessible by barge through the Atlantic Intracoastal Waterway and the Savannah Harbor. Docking, fuel facilities and marine supplies are available at the Port of Savannah.

(d) Location. The location of the work is within the limits of the Savannah Harbor, Chatham County, Georgia and Jasper County, South Carolina. The project consists of maintenance dredging of the Savannah Harbor between Stations 0+000 to 112+500, Jasper, South Carolina and Chatham County, Georgia.

(e) Local Tide Conditions. The areas of work are not subject to severe wave action and exposure to severe storm is slight. The mean tidal range is 7.2 feet and the spring range is 8.4 feet. Current velocities in the Ship Channel average 3 to 4 feet per second with maximum of 5 feet per second. The working season lasts throughout the year.

(f) Channel Traffic. The traffic that may be expected to use the channel during the progress of the dredging consists of ocean‐going vessels, towboats, barges, and various small craft. According to Waterborne Commerce Statistics, in 1989 about 7,757 vessels trips were made in and out of Savannah Harbor. Based on these statistics, an average of over four deep draft vessels per day may enter or leave the harbor.

(g) Obstruction of Channel. The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of such regulations, if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor Act approved 8 August 1917. The Contractor will be required to conduct the work in such a manner as to obstruct navigation as little as possible, and in case the Contractor's plant so obstructs the channel as to make difficult or endanger the passage of vessels, said plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon completion of the work the Contractor shall promptly remove his plant, including ranges, buoys, piles and other markers placed by him under the contract in navigable waters or on the shore.

(h) Records of previous dredging in the vicinity of the project are available in the office of the District Engineer, U.S. Army Engineer District, Savannah, 100 West Oglethorpe Avenue, Savannah, Georgia 31402.

(i) Submerged Pipelines. In the event the Contractor elects to submerge his pipeline, the top of the submerged pipeline shall be no higher than the project required depth for the channel in which the submerged pipeline is placed. The location of the submerged pipeline shall be marked with signs, buoys or flags to the complete satisfaction of the Contracting Officer. The Contractor shall notify the Contracting Officer 7 days in advance of submerging or raising pipelines so that a “Notice to Mariners” can be issued.

Existing authorized project depths are as follows:

Station 0+000 to 103+000 -42 feet mllw Station 103+000 to 105+500 -36 feet mllw

Station 105+500 to 112+500 -30 feet mllw

(j) Subsurface Investigations: No subsurface investigations (drilling or core boring) have been performed for this work.

(A) The Contractor shall promptly, and before the conditions are disturbed, give a written notice, within 3 days, to the Contracting Officer of (1) subsurface or latent physical conditions at the site which differ materially from those indicated in this contract, or (2) unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inherent in work of the character provided for in the contract.

(A) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor’s cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.

(B) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor’s cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.

(C) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in (i)(A) above for giving written notice may be extended by the Contracting Officer.

(D) No request by the Contractor for an equitable adjustment to the contract for differing site conditions shall be allowed if made after final payment under this contract. (FAR 52.236-2 DIFFERING SITE CONDITIONS.)

(E) The Contractor acknowledges that he has taken steps reasonably necessary to ascertain the nature and location of the work, and that he has investigated and satisfied himself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during work performance. The Contractor also acknowledges that he has satisfied himself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.

(F) The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this contract, unless that understanding or representation is expressly stated in this contract (FAR 52.236-3 – SITE INVESTIGATION AND

CONDITIONS AFFECTING THE WORK).

(G) Disposal Areas. The designated disposal area is shown on the contract drawings and is listed in paragraph DISPOSAL AREA OPERATIONS in Section 352023 DREDGING. The Contractor will not be allowed to use any disposal area for this work other than those identified in paragraph DISPOSAL AREA OPERATIONS in Section 352023 DREDGING.

(H) Channel Condition Existing channel side slopes may not have been previously dredged to required depth, as shown on the contract drawings, in areas covered by this contract. The latest dredging in the Sediment Basin were completed as follows:

SECTION 01 00 00 - GENERAL REQUIREMENTS

The following have been modified:

Scope of Work

The Savannah Inner Harbor Contract provides construction services, including furnishing personnel, transportation, mobilization and demobilization, equipment and materials required in connection with maintenance dredging. This contract is traditionally performed with a hydraulic cutterhead dredge (maximum 24”) and the duration is expected to be one year from time of award. Up to four million cubic yards of maintenance material is expected to be removed from the inner harbor.

The work is located in the Savannah Harbor Georgia deep draft navigation project. The Savannah Harbor project is a located in Savannah, Georgia (GA) on the border of Georgia and South Carolina (SC) in Chatham County.

Savannah Inner Harbor channel is 42 ft. deep MLLW and 500 ft. wide to the upper end of Kings Island Turning Basin: 36 ft. deep MLLW and 400 ft. wide to the upper end of Argyle Island Turning Basin; and 30 ft. deep MLLW and 200 ft. wide to the upper limit of the project.

Savannah Harbor’s Kings Island Turning Basin (KITB) is the primary turning basin lying adjacent to the Georgia Ports Authority docks and is the primary turning basin not only for large civilian ships but also for the large military ships. KITB requires dredging twice a year to allow the loaded ships to freely turn when using the port. KITB is expected to be the first dredging event of the contract. Approximately 1.6 million cubic yards of maintenance material is removed from the KITB annually (depends on availability of funds).

Advanced Maintenance Depths and Locations for Savannah Inner Harbor is as follows:

All material dredged from the Savannah Inner Harbor shall be placed in upland confined disposal areas adjacent to the Savannah River, with either DMCA-12A or DMCA-13B receiving the majority of the maintenance material.

Savannah confined upland disposal areas DMCAs 12A, 13A, 13B and Jones Oysterbed Island are owned by local sponsor Georgia Department of Transportation. Disposal areas DMCAs 14A and 14B are owned by the Joint Project Office of the Georgia and South Carolina Port Authorities and portions of DMCAs 2A and Jones/Oysterbed are owned by the Georgia Department of Transportation and the US Fish and Wildlife Service, and DMCA 1N is owned entirely by the US Fish and Wildlife Service. The Federal Government holds existing easements on all confined upland disposal areas in the Savannah Harbor except DMCA 1N which has a Memorandum of Understanding.

Environmental windows limit the timing of dredging in the Savannah Inner Harbor. The environmental windows in Savannah include a Striped Bass spawning window (1 April through 15 May) which limits the amount and timing of dredging of above station 63+250 (River Mile 12), and a dissolved oxygen window July 1 through September 30).
