W912GY-16-T-0008- Tire Flat proofing (Polymer)
Q: would you please clarify or remove "Commercial Warranty" language that was included on page 31 of the solicitation, which states:
COMMERCIAL WARRANTY
The contractor agrees that the supplies or services furnished under this contract shall be covered by the most favorable commercial warranties the contractor gives to any customer for such supplies or services and that the rights and remedies provided herein are in addition to and do not limit any rights afforded to the Government by any other clause of this contract.
A: The local clause for the commercial warranty is a standard clause used for all solicitations that pertains to offering the government the standard warranty given any particular supply/service. It is broader than the language set in 52.212-4 as it pertains locally to our installation.
Q: This quote is for product only, correct? The Government will be actually installing the foam fill in the tires per MFG instructions--which it appears that you have had success with this product before per the J & A.
A: yes, the solicitation is only for a product and Sierra will be installing the foam fill in the tires per MFG instructions.
