WINTER MAINTENANCE – DEWATERING
CONCRETE SUPPLY AND DELIVERY
1. GENERAL
The work shall consist of the concrete being supplied for Lock 4 Winter Maintenance. The placement area includes the downstream bulkhead sill beam. Options for placement for vertical concrete repair located on the Land and Intermediate wall inside the lock chamber are included. The quote shall provide for all labor, equipment, materials, and supplies necessary for this work.
2. CONSTRUCTION SCHEDULE
56 CY of concrete shall be supplied and placed by method of pumping (up to 8 hours of on-site pumping in accordance with paragraph 6) for the downstream bulkhead sill beam. Placement can begin any time after submittal approval and shall be completed by 12 March 2021. The contractor should coordinate the delivery date and time with the Government representative identified at contract award.
3. OPTIONS
As options, the Government may require up to 7 additional deliveries/placement of up to 10 cubic yards (CY) of concrete per placement. The option deliveries may require the use of a pump truck, at the request of the government (up to 6 hours of on-site pumping in accordance with paragraph 6). The use of the pump truck is included in 2 options of 21 hours each. Should the pump truck be required with the additional concrete delivery/deliveries, the Government will exercise the option at that time. And, the contractor shall only charge the government for the actual hours the pump truck is utilized to place concrete. The Government shall notify the contractor a minimum of 2 business days prior to the need for the additional concrete delivery. Pricing for the option CLINs shall include the price for delivery and method of placement (Pump Truck when requested) of up to 10 CY of the approved concrete mix. The options may be exercised any time prior to 1 March 2021 for completion no later than 12 March 2021.

5. SUBMITTALS
The following shall be submitted to the Government for approval no later than 10 days after the award of contract.
1. CONCRETE MIXTURE DESIGN
A mix design shall be submitted for each concrete mix to be used on the project. Each mix design shall list the proportions by weight of cement, weight or volume of water, weights of aggregates in a saturated surface-dry condition, and type, quantity, and name of admixtures per cubic yard of concrete. All materials included in the mixture shall be of the same type and from the same source as will be used on the project.
Each mix shall be accompanied by evidence that demonstrates the mix will produce concrete having the characteristics and quality as specified:
a. MIX DESIGN STUDY Submit a mix design study complying with ACI 211.1 conducted in the past 12 months. The mix design shall be completed by a testing laboratory complying with ASTM C 1077. For SCC (Self- Consolidating Concrete) submit evidence of the design mix for this project. The evidence shall include test data from the Slump Flow Test including the Visual Stability Index (VSI) per ASTM C 1611 and its appendix. A registered professional engineer knowledgeable and familiar with self-consolidating concrete mixes shall conduct these tests or have them done under his immediate supervision.
b. PROJECT DATA Project data or mix design studies shall be obtained for the exact mix as submitted. Minor mix alterations or substitutions may be accepted if approved by the Contracting Officer. Any alternations or substitutions shall be clearly identified and shall be accompanied by recommendations from the admixture supplier or a registered professional engineer indicating the expected effects on the concrete.
2. GENERAL CONCRETE REQUIREMENTS
The concrete shall be a self-consolidating concrete (SCC) that is able to flow under its own weight and completely fill the form work, even in the presence of dense reinforcement without the need of any vibration while maintaining homogeneity. The concrete shall be composed of a cementitious material, water, fine and coarse aggregates, and admixtures. The admixtures shall include High Range water reducers (HRWR), which are an essential component of SCC to provide the necessary work ability; viscosity modifying agents (VMA) for stability and air entraining admixtures (AEA) to improve the freeze-thaw resistance. The design compressive strength as determined by ASTM C 39 shall not be less than 4,500 pounds per square inch in 28 days. The water-cementitious (w/cm) ratio shall not exceed 0.40. The maximum water-cementitious ratio will be determined by the weight equivalency method as described in ACI 211.1 (cement plus pozzolan, and or silica fume). This w/cm ratio may cause higher strengths than required. The cementitious material content shall be a minimum of 500 and a maximum of 620 pounds per cubic yard. Materials shall meet the requirements of the respective publications and other data specified below.
a. SLUMP FLOW:
For SCC (self-consolidating concrete) the slump flow of concrete is identified as the flow of concrete as measured by the Slump Flow Test. The slump flow should be between 27 and 33 inches, with a visual rating of static stability equal to zero or one as determined by the Visual Stability Index (VSI) as described in ASTM C 1611 and its appendix.
b. ADMIXTURES:
Admixtures to be used on the project shall be included in the mix design submittals. Accelerating admixtures shall be used only when approved in writing.
c. AIR ENTRAINMENT:
All concrete shall be air entrained to contain between 4-1/2 and 7-1/2 percent total air.
d. SIZE OF COARSE AGGREGATE:
Nominal maximum size coarse aggregate shall be 3/4-inch.
e. CONCRETE TEMPERATURE:
When the ambient temperature during placing is 40 °F or less, or is expected to be at any time within 6 hours after placing, the temperature of the concrete as delivered shall be between 55 and 75 °F.
f. CEMENTITIOUS MATERIALS:
Cementitious materials shall be portland cement, or portland cement in combination with pozzolan and or Silica Fume. Optional pozzolan replacement of cement shall be limited to 25 percent of the total cementitious material of a mix by weight. Optional Silica Fume replacement of cement shall be limited to 5 percent of the total cementitious material of a mix by weight. Cementitious materials shall conform to appropriate specifications listed below. Use of cementitious materials in concrete which will have surfaces exposed in the completed structure shall be restricted so there is no change in color, source, or type of cementitious material.
i. Portland Cement:
ASTM C 150, Type I with a maximum 15 percent amount of tricalcium aluminate, or Type II.
ii. Pozzolan (Fly Ash):
ASTM C 618, Class C or F with the optional requirements for multiple factor, drying shrinkage, and uniformity from Table 3 of ASTM C 618.
iii. Silica Fume:
Silica Fume conforming to ASTM C1240.
g. AGGREGATES:
i. Composition:
Fine aggregate shall consist of natural sand, manufactured sand, or a combination of natural and manufactured sands. Coarse aggregate shall consist of gravel, crushed gravel, crushed stone, or a combination thereof.
ii. Quality:
The aggregate particles shall be clean, hard, unweathered, and uncoated. The shape of the particles shall be generally cubical or spherical. Where required, fines shall be removed from the aggregates by adequate washing. The aggregates as delivered to the mixer shall meet the quality requirements of ASTM C 33, table 3 for the appropriate type or location of concrete construction for use in a severe climate.
h. CHEMICAL ADMIXTURES Chemical admixtures, when required or permitted, shall conform to the appropriate specification listed.
i. Air-Entraining Admixture.
ASTM C 260 and shall consistently entrain the air content in the specified ranges under field conditions.
ii. Accelerating Admixture.
ASTM C 494, Type C or E, except that calcium chloride or admixtures containing calcium chloride shall not be used.
iii. Water-Reducing or Retarding Admixture.
ASTM C 494, Type A, B, or D.
iv. High-Range Water Reducer.
ASTM C 494, the admixture shall be a Polycarboxylate-based HRWRA, Type F or G, except that the six-month and one-year compressive strength test requirements are waived.
v. Viscosity-Modifying Admixture.
The Viscosity-modifying admixture shall be a commercial formulation specially developed for producing concrete with enhanced viscosity controlling properties that when used with a high-range water reducing admixture will produce a self-compacting concrete.
6. METHOD OF PLACEMENT
For the initial concrete delivery of 56 CY, placement by pumping is required. The concrete pump shall conform to the following specifications: The inside diameter of the pipe / hose shall be at least 4 inches and able to reach 200 feet in length (minimum). The distance to be pumped shall not exceed limits recommended by the pump manufacturer. The concrete shall be supplied to the concrete pump continuously. When pumping is completed, concrete remaining in the pipeline shall be ejected without contamination of concrete in place. After each operation, equipment shall be thoroughly cleaned, and flushing water shall be wasted outside of the forms and into a government supplied onsite waste container.
7. SAFETY
All work shall be in conformance with the latest version of the Corps of Engineers Safety and Health Requirements Manual EM 385-1-1.
8. SITE RESTORATION AND CLEANUP
The contractor shall clean up and dispose of all job-related debris in accordance with all Federal, state, and local laws, ordinances, and regulations. All surface areas damaged by the Contractor’s operations shall be restored.
9. EPA Designated CPG Under the Comprehensive Procurement Guidelines (CPG) program, the Environmental Protection Agency (EPA) designates products that are or can be made with recovered materials, and recommends practices for buying these products. Any designated product that is being offered or supplied under this contract shall meet the minimum recommended content levels as identified under the CPG program. Offerors must be able to demonstrate that each offered product meets minimum content levels upon request.
10. MEASUREMENT AND PAYMENT
Payment shall constitute full compensation for furnishing all labor, materials, equipment, and incidentals required and performing all work in a satisfactory manner and in accordance with the requirements described herein.

This is a 100% Small Business Set-Aside solicitation. The Contractor’s quote shall contain sufficient information so that the U.S. Army Corps of Engineers can determine whether the proposed elements are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the proposed methods of performance and materials to be supplied.
The Contractor should be prepared to defend any discrepancies between the quote and a fair and reasonable estimate prepared by the Government. It should include sufficient information to demonstrate that the work effort is reasonable pertaining to the site and scope. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
i. Price
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (AUG 2020)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision--
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms.
