ADDENDUM TO FAR 52.212-2 EVALUATION COMMERCIAL ITEMS (JANUARY 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. This acquisition will utilize a best value approach, in which the Government seeks to award to an offeror who provides the greatest confidence that they will meet the Government’s requirements affordably. The Best Value technique chosen for this particular acquisition will be Lowest Priced Technically Acceptable offer. Contract award will be made to the responsible offeror whose proposal conforms to the solicitation requirements, is considered technically acceptable, and will provide the best value to the Government, considering price and past performance. Each proposal will be evaluated for all factors listed below.
a. Proposals that are unrealistic in terms of technical or price may be rejected at any time during the evaluation process. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make an award based on initial offers received, without discussion of such offers.
2. Technical Proposal: The offeror’s proposal shall include documentation addressing the qualification requirements in Part 5 (Janitorial Service Requirements) of the PWS. Evaluator(s) shall assign a rating which falls within one of the following ranges according to the degree to which the offeror meets the minimum requirements described above:
(1) Acceptable—Meets evaluation criteria and minimum requirements. Proposal is acceptable. Minor clarifications/corrections can be readily made.
(2) Unacceptable—Fails to meet minimum requirements. Deficiencies are significant and require major revisions to proposal to make it acceptable. If determined to be unacceptable, this will render the entire proposal as technically unacceptable and eliminate the offeror from further consideration.
3. Past Performance Evaluation: Using information provided in your proposal, the contracting officer will review performance information for only those offerors rated technically acceptable.
a. The offeror must submit the required reference information in the form of a PAST PERFORMANCE INFORMATION COLLECTION SHEET as provided in the Proposal Preparation Instructions. The Government will evaluate the offeror’s previous performance in the following areas:
Adherence to progress schedules; technical experience of key personnel and administrative experience of management; quality of the deliverable products; timely submission of submittal data; timely resolution of any problem areas; and ability to meet the contract performance schedule. The Government may evaluate information on problems identified and encountered on previous contracts and corrective actions taken by the offeror. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance.
b. The Government will conduct a performance confidence assessment rating, based upon past performance of the offerors as it relates to the probability of successfully performing the solicitation requirements. The rating may be determined initially or as a result of discussions. The ratings are defined as:
The most relevant provided past performance will be given preference and will be considered a lower risk.
Exceptional/High Confidence: Based on the offeror’s performance record essentially no doubt exists that the offeror will successfully perform the required effort.
Very good/Significant Confidence: Based on the offeror’s performance record, little or no doubt exists that the offeror will successfully perform the required effort.
Satisfactory/Confidence: Based on the offeror’s performance record, some doubt exists that the offeror will successfully perform the required effort.
Neutral/Unknown Confidence: No performance record identifiable
Marginal/Little Confidence: Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort. Changes to the offeror’s existing processes may be necessary in order to achieve contract requirements.
Unsatisfactory/No Confidence: Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.
4. Price/Cost Evaluation: Each offeror’s price will be evaluated for completeness and reasonableness. Unrealistically low proposed costs/prices may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement or the offeror has made an unrealistic proposal.
(a) Technical acceptability and past performance, when combined, are equal to cost or price.
(b)A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(c)The Government reserves the right to require the offeror to submit additional information as necessary to support a pre-award determination of responsibility.
