BIDDER INQUIRY Q&A
Q&A responses for the amendment.
Q1. No information is given as to where the fencing material s will be staged. Should we assume the Work Center or Campground, and that we must move the material from there to the planting units?
A1. The government plans to have fencing materials divvied up and delivered to the various planting units; however, this is not a commitment to do so. Worst case scenario is materials is staging at the Long Creek Work Center.
Q2. The difference between 8 foot vs 10 foot t-posts, and 6 foot vs 8 foot exclosure wire is not insignificant from an installation perspective. The difference between installing wire cage material that meets the 60-inch minimum vs "layering" material to meet the minimum specification is also not insignificant from an installation perspective. We assume we must accept the unknown of material s to actually be provided by the Government, and bid for 'worst case scenario', necessitating a potentially higher bid price. But, if more information is available before bid due date, please provide.
A2. Correct, some of the provided material will have to be layered, and there is currently no accurate inventory of the total amount. In the case layering is necessary, a 1-foot overlap and an 8-foot t-posts could be used.
Q3. Please note that the 'Tall One Gallon" size of plant specified for this project is well beyond a "plug" or "seedling " size.
A3. Noted; however, regardless of nomenclature, the information regarding the plant size has been provided.
Q4. Please note: 3800 plants minus 10% allowable without protection = 3420 minus 300 cages = 3120 plants to be installed within 100 exclosures = 31 plants/exclosure. Exclosures are 16' x 16' = 256 sf So, 31 plants into 256 sf (without even subtracting for the perimeter) equates to a plant less than every 3 foot spacing. This is contrary to other language in the specifications concerning plant placement and spacing. Please consider if further information will be provided.
A4. Per paragraph 5.5.1, each exclosure will be a minimum 16’ x 16’ (they can be larger). 10% of placement within protective fencing shall be considered an optimum goal, but the Government recognizes this may not be possible.
Q5. We are assuming that Options 1001, 2001, 3001 are for years 2023, 2024, 2025, but this is not stated. Please verify.
A5. This contract is for one performance period/planting season only. The schedule is amended to remove the referenced option period.

PERFORMANCE WORK STATEMENT
DWORSHAK ELK FORAGE SEEDLING PLANTING AND PROTECTION (2022)
Part 1 – General Information
1.1 General: This is a non-personal services contract for Elk Forage Seedling Planting and Protection in the Grandad Elk Mitigation Area on Dworshak Reservoir. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor, who in turn is responsible to the Government.
1.2 Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform redstem ceanothus planting and protection as defined in this Performance Work Statement (PWS). The Contractor shall perform to the standards in this PWS.
1.3 Purpose: The US Army Corps of Engineers, Dworshak Dam & Reservoir, desires to increase the abundance, quality, and availability of winter forage for the North Fork Clearwater River elk herd by planting and protecting additional shrubs in the Grandad Elk Mitigation Area. For this effort, the primary goal is to achieve maximum survivability of planted seedlings.
1.4 Background:
1.4.1 Dworshak Dam and Reservoir has several congressionally authorized purposes, one of which is to develop and sustain fish and wildlife habitat. In addition, it has a federal mandate to provide elk habitat (Design Memorandum 15 “The Plan for Development of Rocky Mountain Elk Habitat”). The planting of preferred browse species has been used on Dworshak Reservoir in the past to meet the mandates prescribed in the design memorandum. Shrub planting and protection from elk herbivory prior to seedling establishment and seeding is primarily a tool to increase and enhance the amount and availability of preferred winter browse for elk.
1.4.2 Approximately 3,000 acres of the 5,000-acre Grandad Elk Mitigation Area was clear-cut and burned in the 1970s to promote the production of winter browse species for elk. Although the efforts in the ’70s were generally highly successful, today some of the clear-cut and burn units have very little woody vegetative growth. The Government desires to restore the woody browse species component within these units.
1.5 Scope: The scope of this contract includes providing the care, planting, and protection of redstem ceanothus seedlings, which are highly selected for in elk diets, particularly during the winter. Seedling protection will be accomplished by establishing small exclosures and/or plant cages as needed to prevent seedling herbivory and mortality by elk prior to seedling establishment and maturity (e.g., seed-producing). The Government will provide the seedlings. The Contractor shall establish small exclosures where possible, plant, and protect 3,800 (plus or minus 5%) seedlings. It is the Government’s intent that no more than 10% of the total seedlings may be planted without protective fencing from elk herbivory. All unprotected seedlings must be marked with an accurate GPS waypoint for survival monitoring. Part 5 of this document details the specific performance requirements.
1.6 Period of Performance:
1.6.1 Planting Schedule. The period of performance for this work is the fall of 2022 – October 1, 2022, through November 30, 2022, inclusive. It is the Government’s intent that all planting work shall be scheduled and accomplished within the fewest consecutive calendar days possible within this timeframe. This is also in the Contractor’s best interest, as once the Contractor mobilizes to site, they shall become responsible for the care and survival of the seedlings (see paragraph 5.2).
1.6.2 Variances. Requests for variances to this schedule must be submitted by the Contractor in writing and approved by the Contracting Officer’s Representative (COR). The Government reserves the right to deny any variance request. Any approved variance must be accomplished at no additional cost to the Government.
1.7 Place of Performance: All seedling planting and protection activities will occur within the Grandad Elk Mitigation Area on Dworshak Reservoir. Most or all planting and protection activities will be within the Grandad Creek Units (see Attachment 2, “2022 Planting Map: Priority Areas”), but may also occur within adjacent planting Units with similar access (see Attachment 3, “2022 Planting Map: Secondary Areas”).
1.8 Coordination:
1.8.1 Key Contractor Personnel. The Contractor shall provide an English-speaking Contract Supervisor to oversee the onsite work.
1.8.2 Contracting Officer’s Representative (COR). The COR ensures all technical aspects of the contract are monitored and assists in contract administration. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.8.3 Post-award Conference. The Contractor agrees to attend a post-award conference convened by the COR within 10 days of contract award and prior to commencement of work. This initial meeting may be held at Dworshak Project, at the work site, or via teleconference and will be approximately 1–2 hours duration. The purpose will be to establish communications, discuss contract requirements and clauses, and provide needed clarifications to the work statement.
1.8.4 Preparatory Meetings. A Preparatory Meeting, to include Contractor and Government personnel, shall be conducted onsite on the first day of planting each season. The purpose of this meeting will be review parameters for the planting season (i.e., locations, terrain, distribution), review the planting and caging specification, as well as to review, amend if needed, and accept the contractor’s Activity Hazards Analysis prior to commencement of work.
1.9 Quality Control & Quality Assurance:
1.9.1 Quality Control. The Contractor shall prepare and maintain a written Quality Control Plan (QCP) detailing its quality control methods to ensure work is performed in accordance with this Performance Work Statement.
The QCP must be available for review by Government personnel, if requested.
1.9.2 Quality Assurance. The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards.
It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.10 Project Security Requirements:
1.10.1 General: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements.
Questions regarding security matters shall be addressed to the Contracting Officer Representative (COR).
Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
1.10.2 Physical Security: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.
1.10.3 Contractor Employee Verification: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/ eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
1.12 Safety and Environmental Considerations:
1.12.1 Protection of Water Resources. Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, and waste washings from entering drainage ditches, ponds, and rivers.
1.12.2 Safety Standards. The Contractor shall comply with all applicable Occupational Safety and Health Act (OSHA) Standards, as well as the Corps of Engineers’ Safety and Health Requirements Manual EM 385-1-1, which can be referenced at:
https://www.usace.army.mil/Missions/Safety-and-Occupational-Health/Safety-and-Health-Requirements- Manual/.
The Contractor shall ensure that all personnel are trained to the level of expertise required for proper performance of the task, general first aid procedures, and use of safety equipment. Personal protective equipment shall be provided by the Contractor and must be appropriate to the task. Contractor personnel and equipment shall be subject to safety inspections by Government personnel while on Federal property.
1.12.3 Contractor Accident Prevention Plan. The Contractor shall develop and submit an Accident Prevention Plan (APP). The APP must include the minimum requirements described in EM 385-1-1, Appendix A, Minimum Basic Outline for Accident Prevention Plans. The APP must be specific to the work on this contract and should include: plans for maintaining continued job cleanup; safe access and egress; plans for dealing with emergencies (ambulance service, fire, evacuation, etc.); and accident reporting procedures.
1.12.4 Activity Hazard Analysis. The Contractor shall prepare an Activity Hazard Analysis (AHA) that meets the standard of EM 385-1-1, Section 01.A.14, for the work to be performed under this contract. The AHA shall address the hazards for the activities to be performed and present mitigation actions to reduce or eliminate the hazard. A template containing all required elements will be provided to the Contractor upon request.
Part 2 – Definitions
Desiccation. The state of extreme dryness.
Hydrogel. A type of hydrophilic biodegradable gel or powder polymer frequently used during planting in forestry applications. Hydrogel acts as a soil conditioner and water reservoir to increase seedling survival and growth rates.
Application rates typically vary based on prevailing soil conditions.
J-root. An improperly planted seedling that takes a J-shaped configuration in the planting hole. Such seedlings often die prematurely, grow poorly, and are susceptible to windthrow.
Part 3 – Government Furnished Materials
3.1 Seedlings: The Government will provide 3,800 seedlings (plus or minus 5%) for planting by the Contractor during the Fall of 2022. The seedlings will come in tall one-gallon containers having a 185 cubic inch root plug (approximately 3–4" x 14" root plug).
3.2 Fencing Materials: The Government will provide a quantity of fencing materials, generally described below, to establish up to 100 small temporary exclosures and up to 300 wire plant cages, to be installed by the Contractor as specified in Section 5.5, Plant Survival Measures. The following list identifies the materials that may be provided:
For small exclosures:
o 8- to 10-foot studded t-posts o 6- to 8-foot woven or welded wire fencing and/or utility or livestock panels
For wire plant cages:
o Minimum 7-foot studded t-posts o Minimum 60-inch woven or welded wire fencing and/or utility or livestock panels o Approximately 78-inch rebar posts, ½-inch #4, or equivalent-strength metal doweling
Part 4 – Contractor Furnished Items and Services
4.1 General: The Contractor shall furnish all tools, materials, supplies, equipment, and services required to perform work under this contract, except those listed under Part 3 of this PWS. The Contractor shall maintain an adequate, trained, and equipped workforce at all times during the performance period to ensure timely completion of all work.
4.2 Hydrogel: The Contractor shall provide hydrogel in sufficient quantities to mix with backfilled soil, based on manufacturer recommendations. The Contractor shall submit product name and specification to the COR for review and acceptance prior to purchase by the Contractor.
4.3 Fencing Installation Equipment and Materials: The Contractor shall provide all equipment and additional supplies and materials not listed in Section 3, Government Furnished Materials, that are required to utilize any fencing materials provided by the Government to install small exclosures and wire plant cages as specified in Section 5.5, Plant Survival Measures.
Part 5 – Specific Tasks
5.1 Elk Forage Planting: The Contractor shall plant elk forage seedlings in accordance with the objectives of this PWS and in the manner that meets the objectives detailed in this section and provides the greatest chance for survivability of the young plants.
5.2 Seedling Handling:
5.2.1 Seedling Delivery. The Government will deliver the seedlings to the Grandad Elk Mitigation Area, typically to the Long Creek Work Center or Grandad Campground. If it is practicable, the Government may deliver the seedlings to a staging area within closer proximity to the planting units.
5.2.2 Seedling Possession. The Contractor shall take possession of, and responsibility for, the seedlings upon mobilization to the worksite and shall be responsible for transporting plants from the delivery/staging location to the planting sites.
5.2.3 Seedling Care. The Contractor shall protect seedlings from wind, elements, and other potential damage during transport; shall handle seedlings gently and carefully; and shall store seedlings not immediately planted a manner that prevents desiccation or causes any undue reduction in seedling health.
5.3 Planting Locations:
5.3.1 Spacing. The Contractor shall make every attempt to disperse the seedlings evenly through the planting unit(s) while selecting the best possible micro-sites and should not greatly exceed 100 seedlings per acre.
5.3.2 Microsites. Seedlings must be planted in appropriate microsites that reduce plant desiccation (e.g., reduce exposure to the sun) and provide more available moisture throughout the growing season. Appropriate micro-sites would be the north or northeast sides of stumps, logs, rocks, etc., which provide protection from animal, sun, and wind damage. Natural materials may be transported from surrounding areas within or adjacent to the planting unit to create adequate micro sites, when needed.
5.4 Planting:
5.4.1 Scalping and Orientation. For each planting location that is not exposed to mineral soils, the Contractor must clear/scalp to mineral soil to a minimum of 12 inches in diameter to remove any vegetation, gravel, or slash to reduce direct plant competition. All seedlings shall be planted in the center of the scalped area and oriented at an angle between perpendicular to the slope and true vertical.
5.4.2 Planting. The seedlings must be planted in such a manner as to maximize plant survival and allow for adequate expansion of roots. An opening shall be created large enough to allow for the plug (3¼″ diameter x 14″ tall) to easily fit and provide room for the placement of the hydrogel. Planting the 185 cubic inch plugs requires a much larger hoedad or the use of an auger. The Contractor must place the seedling in the opening so that the roots are not J-rooted nor planted with debris in the hole. The Contractor shall then place the hydrogel product around the plug and inside the planting hole. The soil shall be firmly packed around the plug and root collar so that the soil reaches the top of the root collar.
5.5 Plant Survival Measures: To maximize seedling survival, the Contractor shall install up to 100 small exclosures and up to 300 protective wire plant cages. Final quantity will depend on availability of Government-provided fencing materials at the time the work is completed. The Government will select the plant protection installation areas. To propose any alternative to the Government’s methods described here, the Offeror shall provide a detailed description of their proposal with their quote for Government evaluation.
5.5.1. Small Exclosures. The Contractor shall assemble and install up to 100 small exclosures meet the basic installation parameters listed below. All areas designated for small exclosure establishment will be adjacent to a road to facilitate access by the Contractor required for hauling and placing material.
Minimum dimensions shall be 16 feet L x 16 feet W x 6 feet H.
T-posts shall be driven a minimum of 16 inches into the ground.
Woven or welded wire fence and/or utility or livestock panels may require layering to reach the minimum height requirement of six feet.
5.5.2 Wire Plant Cages. The Contractor shall assemble and install up to 300 wire plant cages. One seedling shall be planted in the middle of the wire cage installed.
Minimum cylindrical dimensions shall be 2 feet in diameter x 5 feet H T-posts shall be driven a minimum of 18 inches into the ground, where possible.
If the plant cage is to be constructed on sloped ground, one t-post shall be oriented directly uphill to limit damage or shifting of the cage during snow melt.
When rebar is used for plant cage construction, the Contractor shall weave the rebar or metal dowel a minimum of five times through cage and pound into the ground a minimum of 18 inches.
Ideally, each plant cage will be constructed with two t-posts, each configured opposite each other for maximum structure of the circular plant cage.
However, if the number of t-posts provided does not allow for the ideal construction of all plant cages, two pieces of rebar may replace one t-post. In this case, the three supports shall be placed equidistant from one another, forming a triangular shape, to provide maxim strength of the cage.

CLAUSES INCORPORATED BY FULL TEXT
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
(NOV 2021)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition--
(1) Is set aside for small business and has a value above the simplified acquisition threshold;
(2) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or
(3) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.
