PERFORMANCE WORK STATEMENT (PWS)

DWORSHAK REDSTEM CEANOTHUS SEEDLING PLANTING

Part 1 – General Information

1.1 General: This is a non-personal services contract to provide the care, planting, and protection of shrub seedlings (primarily Redstem Ceanothus) in the Grandad Elk Mitigation Area on Dworshak Reservoir. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor, who in turn is responsible to the Government.

1.2 Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Redstem Ceanothus Planting as defined in this Performance Work Statement (PWS). The Contractor shall perform to the standards in this PWS.

1.3 Purpose: The US Army Corps of Engineers, Dworshak Dam & Reservoir, desires to increase the abundance, quality, and availability of winter forage for the North Fork Clearwater River elk herd by planting and protecting additional shrubs in the Grandad Elk Mitigation Area. For this effort, the primary goal is to achieve maximum survivability of planted seedlings.

1.4 Background:

1.4.1 Dworshak Dam and Reservoir has several congressionally authorized purposes, one of which is to develop and sustain fish and wildlife habitat. In addition, it has a federal mandate to provide elk habitat (Design Memorandum 15 “The Plan for Development of Rocky Mountain Elk Habitat”). The planting of preferred browse species has been used on Dworshak Reservoir in the past to meet the mandates prescribed in the design memorandum. Shrub planting is primarily a tool to increase and enhance the amount and availability of preferred winter browse for elk.

1.4.2 Approximately 3,000 acres of the 5,000-acre Grandad Elk Mitigation Area was clear-cut and burned in the 1970s to promote the production of winter browse species for elk. Although the efforts in the ’70s were generally highly successful, today some of the clear-cut and burn units have very little woody vegetative growth. The Government desires to restore the woody browse species component within these units.

1.5 Scope: The scope of this contract includes providing the care, planting, and protection of shrub seedlings (primarily Redstem Ceanothus). The seedlings will be provided by the Government. The Contractor shall plant 5,000 seedlings, plus or minus 5%, each performance period of the contract. Part 5 of this document details the specific requirements of this contract.

1.6 Period of Performance: This will be a firm-fixed-price contract with a base performance period and four option periods. The work is completed primarily between February and October, but the contractual Periods of Performance are as follows:

Base Period Contract Award through December 31, 2018 Option 1 January 1, 2019, through December 31, 2019 Option 2 January 1, 2020, through December 31, 2020 Option 3 January 1, 2021, through December 31, 2021

Option 4 January 1, 2022, through December 31, 2022

1.6.1 Planting Schedule. All planting shall be completed as early as possible on or after February 1 of each Period of Performance. The Government will determine when the planting units can be traversed and notify the Contractor; the Contractor must be able to begin planting operations within three weeks of such notification.

Access to planting units during the planting period may entail driving on snow-covered roads and trails, requiring the use of track machines or snowmobiles. The planting work shall be accomplished over a period of not more than fourteen consecutive days.

1.6.2 Plant Survival Measures. Application of plant survival measures shall be completed in late summer / early fall. The Contractor shall coordinate the performance period with the COR or Technical POC.

1.6.3 Variances. Requests for variances to the schedule, 14-day timeframe, or plant periods must be submitted by the Contractor in writing and approved by the Contracting Officer’s Representative (COR) in writing. The Government reserves the right to deny any variance request.

1.7 Place of Performance: All planting will occur within the Grandad Elk Mitigation Area on Dworshak Reservoir. Base year planting (2018) will be within the Telephone Creek Q unit (see Attachment 1, Area Maps, for greater detail). Planting areas in subsequent option periods are not yet firmly defined; however, they will be similar in distance, access, and terrain.

1.8 Coordination:

1.8.1 Key Contractor Personnel. The Contractor shall provide an English-speaking Contract Supervisor to oversee the onsite work.

1.8.2 Contracting Officer’s Representative (COR). The COR ensures all technical aspects of the contract are monitored and assists in contract administration. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.8.3 Post-award Conference. The Contractor agrees to attend a post-award conference convened by the Contracting Officer’s Representative (COR) within 30 days of contract award and prior to commencement of work, during the base period. This initial meeting may be held at Dworshak Project, at the work site, or via teleconference and will be approximately 1–2 hours duration. The purpose will be to discuss contract requirements and clauses and provide clarifications, if any are needed, on the work statement.

1.8.4 Annual Pre-work Meeting. The Contractor agrees to attend a pre-work meeting at the commencement of work each year, either at the work site or via teleconference, to discuss specifics pertaining to the particular year’s planting (i.e., locations, terrain, distribution, scheduling), review the general contract specification, and review the contractor’s Activity Hazards Analysis.

1.9 Quality Control & Quality Assurance:

1.9.1 Quality Control. The Contractor shall provide a written Quality Control Plan detailing planting methods and quality control methods to be implemented to ensure work is performed in accordance with, and meeting the standards of, this Performance Work Statement.

1.9.2 Quality Assurance. The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards.

It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.10 Contractor Employee Verification: The Contractor must pre-screen candidate employees using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements.

The Vendor must ensure that the candidate has two valid forms of Government-issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified / eligible Candidates must be provided to the COR within 30 days after initial contract award and prior to any onsite work.

1.12 Safety and Environmental Considerations:

1.12.1 Protection of Water Resources. Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, and waste washings from entering drainage ditches, ponds, and rivers.

1.12.2 Safety Standards. The Contractor shall comply with all applicable Occupational Safety and Health Act (OSHA) Standards, as well as the Corps of Engineers’ Safety and Health Requirements Manual EM 385-1-1, which can be referenced at http://www.usace.army.mil/SafetyandOccupationalHealth/SafetyandHealthRequirementsManual.aspx.

The Contractor shall ensure that all personnel are trained to the level of expertise required for proper performance of the task, general first aid procedures, and use of safety equipment. Personal protective equipment shall be provided by the Contractor and must be appropriate to the task. Contractor personnel and equipment shall be subject to safety inspections by Government personnel while on Federal property.

1.12.3 Contractor Accident Prevention Plan (APP). The Contractor shall develop an Accident Prevention Plan.

The APP should include the minimum requirements described in EM 385-1-1, Appendix A, Minimum Basic Outline for Accident Prevention Plans and should include: plans for maintaining continued job cleanup, safe access and egress, and certifications for specialized work; and plans for dealing with emergencies (ambulance service, fire, evacuation, etc.) and accident reporting.

1.12.3 Activity Hazard Analysis (AHA). The Contractor shall create an Activity Hazard Analysis for the work under this contract. The AHA shall address the hazards for the activities to be performed and shall present procedures and safeguards necessary to eliminate the hazard or reduce the risk to an acceptable level.

1.12.4 Contractor Exposure Hours. In accordance with EM 385-1-1 paragraph 01.D.05.c, the Contractor shall submit project work hours to the COR by the 5th business day of each month for work completed in the month prior. Work hours include all hours on the project where an employee is in an on-duty pay status.

Part 2 – Definitions

Desiccation. The state of extreme dryness.

J-root. An improperly planted seedling that takes a J-shaped configuration in the planting hole. Such seedlings often die prematurely, grow poorly, and are susceptible to windthrow.

Part 3 – Government Furnished Materials

3.1 Seedlings: The Government will provide 5,000 seedlings (plus or minus 5%) annually (normally all Redstem Ceanothus; occasionally another species may be substituted) to be planted by the Contractor. For the base period and first option period, the seedlings will come with a 20 cubic inch root plug (approximately 2.25″ x 6″). In the remaining three option periods, the 5,000 seedlings will come with a 60 cubic inch root plug (approximately 2.5″ x 14″).

3.2 Animal Repellent: The Government will provide a sufficient quantity of pre-mixed Plantskydd or other similar repellant product with which the Contractor shall treat each seedling in late-summer/early-fall as a plant survival measure.

3.3 Gate Keys for Lands Access: If keys are required for access through gates to USACE lands, the COR will issue keys or provide access, as needed. If keys are issued, the Contractor shall establish and implement methods to ensure all keys are tracked and not lost or misplaced and are not used by unauthorized persons. No keys issued to the

Contractor by the Government shall be duplicated. The Contractor shall also immediately report any occurrences of lost keys to the COR. In the case of loss or theft of keys, the Contractor may be held liable for the cost of re-keying affected locks.

Part 4 – Contractor Furnished Items and Services

4.1 General: The Contractor shall furnish all tools, materials, supplies, equipment, and services required to perform work under this contract, except those listed under Part 3 of this PWS. The Contractor shall maintain an adequate, trained, and equipped workforce at all times during the performance period to ensure timely completion of all work.

4.2 Hydro gel: The Contractor shall provide hydrogel (Terra-Sorb, or equal), in sufficient quantities to mix with backfilled soil, based on manufacturer recommendations. If an equivalent hydrogel is requested, the Contractor shall submit product name and specification to the COR for acceptance prior to application.

Part 5 – Specific Tasks

5.1 Shrub Planting: The Contractor shall plant seedlings (Redstem Ceanothus) provided by the Government in accordance with the objectives of this PWS and in the manner that meets the objectives detailed in this section and provides the greatest chance for survivability of the young plants.

5.2 Seedling Handling:

5.2.1 Delivery. The seedlings will be delivered to a staging area within close proximity to the planting units.

The Contractor shall take possession of and responsibility for seedlings provided by the Government prior to or at project commencement.

5.2.2 Storage and Handling. If not immediately planted, the seedlings shall be stored and handled in such a manner that prevents desiccation or causes any undue reduction in seedling health.

5.2.3 Transportation. Seedlings shall be protected from wind, elements, and other potential damage when transported from the staging area to the planting sites. Boxes of seedlings shall be handled gently and carefully when loading and unloading. Seedlings may be transported by all-terrain vehicle (ATV), snowmobile, or similar vehicle from the trailer to the planting crew in the field.

5.3 Planting Locations:

5.3.1 Spacing. The Contractor shall make every attempt to disperse the seedlings evenly through the planting unit(s) while selecting the best possible micro-sites. Within years having multiple units, plants shall be evenly distributed per unit based on unit acreages provided by the Government.

5.3.2 Microsites. Seedlings must be planted in appropriate microsites that reduce plant desiccation (e.g., reduce exposure to the sun) and provide more available moisture throughout the growing season. Appropriate micro-sites would be the north or northeast sides of stumps, logs, rocks, etc., which provide protection from animal, sun, and wind damage. If adequate microsites are not available the Contractor must provide natural or man-made objects (e.g. shade cards) to create adequate micro-sites. Natural materials may be transported from surrounding areas within or adjacent to the planting unit.

5.4 Planting:

5.4.1 Scalping and Orientation. For each planting location that is not exposed to mineral soils, the Contractor must clear/scalp to mineral soil to a minimum of 12 inches in diameter to remove any vegetation, gravel, or slash to reduce direct plant competition. All seedlings shall be planted in the center of the scalped area and oriented at an angle between perpendicular to the slope and true vertical.

5.4.2 Planting. The seedlings must be planted in such a manner as to maximize plant survival and allow for adequate expansion of roots. An opening shall be created large enough to allow for the plug (2¼″ diameter x 6″ tall or 2-1/2″ diameter x 14″ tall, depending on the seedling) to easily fit and provide room for the placement of the hydrogel. Planting the 20 cubic inch plugs is typically accomplished using a hoedad and making two perpendicular entries into the soil creating an “X” and expanding the slit created from the second entry. Planting the 60 cubic inch plugs requires a much larger hoedad or the use of an auger. The Contractor must place the seedling in the opening so that the roots are not J-rooted nor planted with debris in the hole. The Contractor shall then place the hydrogel product around the plug and inside the planting hole. The soil shall be firmly packed around the plug and root collar so that the soil reaches the top of the root collar.

5.5 Plant Survival Measures: The Government-provided seedlings will come already treated with Repellex animal repellent. The Contractor shall return to the planting site during late summer/early fall, as coordinated with the COR or project Technical POC, and shall treat each seedling with Government-provided pre-mixed Plantskydd, or other similar repellent product, according to manufacturer’s recommendations.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(b)

(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to expiration of the contract.
