NAB 19-009
Justification for Mettler Toledo Maintenance and Support
1. Contracting Activity: USACE, Baltimore District, sets forth the following justification in accordance with FAR 13.106-1(b).
2. Description of Action: This acquisition is to establish a calibration and maintenance service contract for the residual solids truck loading scales located at the Washington Aqueduct’s Residual Processing Facility (RPF) through Mettler Toledo.
3. Description of Supplies/Services: The RPF facility uses three (3) METTLER TOLEDO truck loading scales to measure the weight of the residual wastes loaded onto the trucks. Installation of the truck scales was completed in 2011. The proposed contract is required to provide calibration, repair, and maintenance services for the truck scales to ensure they continue to function properly. The estimated cost of this acquisition is $23,139.43 for the base year and includes four
(4) option year periods for a total contract estimated cost of $60,121.42. Mettler Toledo maintains certified technicians that are trained to service this specific equipment.
4. Authority Cited: The authority rationale 13.106-1(b) only one source reasonably available.
Mettler Toledo is the sole manufacturer of the existing truck loading system. The scope of the maintenance and repair work, replacement of the load sensors, a terminal/controller, and calibration, represent about 10% of the scope or cost of an entirely new system. Any other vendor will not be able to effectively provide a guarantee of the integration of the replacement items into the entire truck loading system with SCADA communication systems.
5. Reason for Authority Cited: The referenced contract is necessary to maintain the operability, accuracy, and reliability of the three truck loading scales that are essential to the water treatment process and applicable regulations and consent decrees of the Washington Aqueduct. Any maintenance or calibration conducted to the truck scales must be completed by a technician certified by Mettler Toledo.
6. Efforts to Obtain Competition:
a. Effective competition. There is effectively no competition as Mettler Toledo is the only company capable of providing guaranteed integration and reliability for maintenance on the existing truck loading weighing system at the RPF.
b. Subcontracting competition N/A
7. Actions to Increase Competition: Washington Aqueduct can neither practically nor cost-effectively increase competition for truck loading maintenance nor support services.
8. Market Research: There was no previous contract on the truck scales. Mettler Toledo provided calibration and repair services through warranty and on one-time government credit card payments when requested by the Washington Aqueduct. Market Research was conducted based on previous payments and Service Contract Act Wage Determination 2018 data from https://www.wdol.gov/sca.aspx.
9. Interested Sources: The manufacturer of the truck scales Mettler Toledo stated that there are local technical representatives in the DC area to provide services. The J&A will not be posted as it is not required according to FAR 13.106-1.
10. Other Facts: Mettler Toledo has unique experience and knowledge of the existing Washington Aqueduct truck scales system since they manufactured the equipment and participated in the startup and commissioning process. They possess a complete understanding of the control program, safety features, and SCADA communication systems on this equipment. The technical assistance to be provided requires background knowledge and understanding of the truck scale system’s operational controls and setup.
11. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.

12. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief.
