About this file
This document contains an amendment to a solicitation and related questions and answers. The Kansas City District Corps of Engineers requires wetland mitigation credits utilizing an approved in-lieu fee program in Kansas to fulfill adverse impacts from the R471-460 Levee Flood Damage Reduction Study. Specifically, 18.7 acres of wetlands would need to be mitigated. The response date for proposals was extended from December 17, 2019 to January 3, 2020 at 1:00 PM, while the time for responses remains unchanged. Replacement wetlands must be located within the designated "Missouri" In-Lieu Fee Service Area in Kansas. Clarification was provided that an offeror need only provide their bid number and approved in-lieu fee program agreement initially, and does not require identifying specific land parcels, but the location must eventually be acquired within the service area.

Below are replies to questions that were asked by an intrested vendor also the response date has been extended from 17 December 2019 to 3 January 2020 . The time for when responses are due has not changed.
Questions and Answers
1. Are you seeking only a bid number without any proof of technical abilities to preform since we have already been accepted and a Statewide ILF provider?
R: We are seeking a bid number. "For the technical abilities, we would require the agreement to establish the mitigation bank or in-lieu fee program. All bank or in-lieu fee programs are reviewed, evaluated and approved subject to the 2008 National Mitigation Rule guidelines."
2. All of our previous conversations seemed to imply that the USACE was looking for wetland replacements anywhere in the State of Kansas. Usually we are asked to place replacement wetlands in the same ILF designated area which has suffered the loss. In reviewing the bid document this appears to not be the case, as you well know the Corps has officially released a new STATEWIDE ILF Coverage Map. On page 5 of the bid sheet the statement directly above the Kansas map reads, "The watershed area for Kansas in-lieu fee programs are shown on the map below."
R. For anywhere in the state of KS is not accurate; it needs to be within or as close as possible to the same watershed of the project. Specifically somewhere with Kansas 8 digit HUCs: Independence-Sugar (10240011), Tarkio-Wolf (10240005), Big Nemaha 10240008), and South Fork Big Nemaha (10240007) also now called "Missouri" Service Area.
3. Taken literally then the replacement wetlands are to be within the Missouri area of the new Kansas In-Lieu Fee Proposed Service Area. Are we interpreting this correctly, and if so would this require us to find and locate a potential or several potential sites prior to placing a bid? PLEASE CLARIFY.
R. Correct, the new Kansas In-Lieu Fee Proposed Service Area reference name: Missouri. The understanding is that we purchase the wetland credits at a set price, then the proponent acquires the land, constructs and maintains the wetland in perpetuity forever with no further cost. The exact location or acquisition of the land is not required prior to the purchase of the in-lieu fee credits. However, the location must eventually be within the "Missouri" In-Lieu Fee Service Area.
